I asked this question earlier and got an answer that it's next to impossible and would be very costly- "I want to know if I can get my parental rights back. I gave them up 3 years ago under coercion and a desperate mindset. I was told giving my daughter up would help my husband get her back by DCF. I want to regain at least partial custody or at the very least visits. She has recently been adopted out. SO I'm wandering is it possible to do this?"- I'm wondering how costly it would range between. Are we talking thousand or hundreds of thousand? Also the response said next to impossible, so that means it is possible but will be extremely difficult right? Or would I just be wasting my time? Generally speaking, as the copyright holder you have the right to ask these sites to take the photos down and you also have the right to ask for compensation. However, unless the photo was registered with the US copyright office, one would not have the ability to force those sites to take it down or pay compensation. Sometimes the law enforcement officer just doesn't get all of his tickets filed with the court. When this happens, the court may simply issue a new court date. The danger is that you may not receive notification in a timely fashion. On a serious charge such as a DWI or DUI, you definitely need to hire the best attorney you can afford. The attorney can probably monitor the new case filings and keep you from being arrested on a warrant. In other cases where there is a history, the prosecutor may be considering refiling the charge at a more serious level. In any event, hire an attorney. Without having any knowledge as to the specifics in a will, it's impossible to say what one person's share would be. If your father dies intestate each surviving heir is entitled to an equal share of the net estate after all debts are paid

With that said, if your father passes on, the assets (including the home) and the debts (including the mortgage) become part of the decedent's estate. Anything purchased from the estate has to be bought at fair market value so your sister's right.

It is strange you haven't filed for divorce or at least legal separation. If you did that, you could request to remain in the home with your children and force him to pay for the mortgage. It might not be too late.

The other LA motors are internally balanced, or "neutral" so any neutral balanced convertor (all aftermarket) will work. If you use a 360 convertor on a neutral balanced motor, you will immediantly know it as it will be out of balance and have a severe vibration at idle. If you are going to use an aftermarket convertor, you need to use a weighted flex late. B&M makes such a flexplate that basically has the 360 counterweight already attached so any neutral balanced convertor will work.

The part in question is the part in quotations. My exwife who is the noncustodial parent of my daughter took her and had braces put on her without my consent or my knowledge. We were moving forward to get braces put on when I lost my job and I told her that it was going to have to wait until I could afford the payments. She did not like having to wait so she went and had them put on her self with a different orthodonist and different treatment plan. She did not make me aware of any of it and she signed the contract on the braces. Also telling the office that we were not in agreement so she was going to do it herself and be the responsible one. Also told them that I was not allowed to any of the information and that I was not allowed to have the braces removed. I had to fax over court documents to prove that I was the custodial parent just to get information on her.

My understanding of our papers is that if she went out on her own then she would be responsible for the cost. She started deducting the payments for her court ordered child support. We did go to court over it and she claimed that I was in contempt of not paying medical bills. The judge ordered her to pay her child support because she was in contempt but as far as the braces told us to work it out and follow the papers. We need claification on the papers and if that is what it means or not.

You are looking at your case in the wrong way. In a workers compensation case what matters most is whether or not your case has permanency. Usually, it takes two (2) years of being out of work before the Law Judge would approve any settlement that a carrier proposes.

The amount of the settlement has to do with a) your age b) your AWW c) the seriousness of your injuries d) what the defendant's IME consultant believes that your degree of disability is e) what your doctor believes your degree of disability is and your chances for going back to work and f) whether or not you have SSD (which will entitle the government to demand a hefty medicare set aside and decrease your settlement) . Typically, a Section 32 settlement in NY is your workers compensation weekly rate times a certain # of years.

However, every case and situation is difference.

You must DENY by TOPIC everything you want to deny at trial, and raise by TOPIC everything you want to raise in defense. You do not have to attach your evidence, although if you can it wouldn't hurt to play it safe.

I would not, personally, attach your evidence. However, if you feel better doing it, you can.

You must describe topically what you deny and what you claim is your defense. If you don't include a defense or denial in the Grounds of Defense, the Court could enter summary judgment against you before the trial even starts.

Technically, there is a rule -- that nobody ever follows -- that the Plaintiff must include in their Bill of Particulars all of their claims and evidence. I have never seen that rule followed, despite my efforts. I am not aware of any such rule about the defendant, but if you want to play it safe, go ahead and attach your evidence to your Grounds of Defense.

I don't know what you mean by can you attack the evidence. They do have to carry their burden of proof. If you want to challenge the credibility or accuracy of their evidence, sure, absolutely, you should do so. Explain why you think the evidence is not accurate. And yes, they have to carry their burden of proof.

If you don't deny something, the Court can take it as TRUE, and the Plaintiff has carried its burden of proof.

ABSOLUTELY YOU MUST SEND A COPY OT THE PLAINTIFF'S ATTORNEY *AND* the Court, on time. You will be screwed if you don't.

In Ohio, the mortgage is not the obligation to pay. The note that you signed with the lender is the obligation to pay. The mortgage is only a possession interest in your property that secures the obligation to pay. A lender does not have to foreclose in order to collect. But a judgment for several thousand dollars is only a piece of paper unless it is secured by something like a mortgage. So the best practice for the lender would be to join in the foreclosure action and pursue its interests against you in the court where the other lender filed its foreclosure action.

It is not strictly necessary that the second lender join the foreclosure lawsuit, but it does not make sense for it not to. Further, there are some civil rules which state that claims for relief that arise out of the same common nucleus of fact should be joined in the same lawsuit. So there might be a defense to a second lawsuit by the second mortgage lender if it did not join in the foreclosure action (of which it would almost certainly have had notice since the first mortgage holder is required to put all of the other mortgage holders on notice.

I fixed this today 3-2-2011----I chnged my cooling fan sensor and sending unit---not sure of the names of the parts --but they screw into the metal pipe just under the distributer (where the 4 spark plugs come together)----they have a small electrical connecter on EACH one and scew in like a spark plug--and are about the size of a spark plug--use a 3/4 inch deep well socket ---this worked for me and my coolant light went out after the second start------I looked all over for a fan relay----there is not one in my 1998 escort-----It must be in the computer. The parts cost me 27$ at auto zone------I took out the air filter housing ( a snap off ring-- no tools needed) and removed the upper hard plastic hose----bent up the remaining rubber corrigated hose and there are the fan sensors---side by side---easy--------good luck and i hope this helps---I looked for hours and got all kinds of answers----this worked for me---no relays--no messing with the computer thing----------

There is no charge for "threatening damage to personal property." Also, I doubt she will actually be dumb enough to do it, now that she's broadcasted to the world that she will. If she does, you'll have good evidence to recover damages from her for your new paint job.

Ask yourself: Why does she think *you* vandalized her car? Why is this woman your "enemy" exactly? Because of some guy both of you used to date? Life is too short for such ridiculous drama. Having the father's name on the birth certificate alone is not enough to establish paternity rights in the father. Using the father's last name does not establish paternity rights either. In short, your son likely does not have any rights to the child regarding visitation or custody. In order to get these rights, your son will likely need to establish paternity. Once he establishes paternity, then he can petition the court for visitation and/or custody of the child.

Visitation/custody decisions are based on the following standard -- "what is in the best interest of the child?" A large number of factors go into deciding what is in the best interest of the child. For instance, you state the child has lived with you since May 2010 -- where did the child live before that? If it's with the mother, the court may be hesitant to make a permanent move to your home. The mother may use drugs (something the court will certainly consider), but does the father have a job? You say that the father lives with you and your husband -- does your son support himself -- judges do not like awarding custody to fathers whose parents let them sleep in their homes but run around at night. Is your son capable of supporting the child without your assistance? Would your son pass a drug test (marijuana included)? Does your son have a high school, college, or vocational education? Do the parents live in different states? Who lives in a "better" school district? Will the maternal grandmother support the mother and her raising of the child (just like it sounds like you are doing with your son)?

Also, the other thing to remember is that once paternity is established, the mother can go after your son for child support. If your son does not pay child support ordered by the Court, he is subject to having his wages garnishes and in some cases imprisonment. Is your son willing to take the risk of establishing paternity, not receiving custody/visitation, but having to pay child support? ONLY HE CAN ANSWER THESE QUESTIONS.

The best advice I can give you is to hire a Maryland family law attorney. Many will give you a free consultation, discuss the specifics of your situation, explain your chances of success, how much it costs, how long it takes, etc., and then you can decide whether to move forward. IT IS UNDENIABLE that your son's chances of success increase with a lawyer on his side. If it's important enough to get his child back, it should be worth paying a few bucks to an attorney to do things the right way.

You most likely missed the deadline. the best way to determine that would be to contact the Class Action Attorney but dont hold out too much hope...dealer sold a used car. I am sure that you eiter had a waarnty or it was sold with the FTC as is...Tires would have been easily visibke when you bought the car... If they misrepresented you may have a cause of action on the lights and tune-up but you probably dont have much in the way of the transmission unless there was an explict warranty.

The result of this arrest for theft was 120 hours of community service which she did and the charge was "dismissed" and "expunged". (in fact, I didn't discover it until years later). Since that time she has also been convicted of three other incidents of theft and another one which was dismissed after attending an offender's class. Can anything be done about this? I know you may be thinking this is just an attempt to "get back" at an ex but nothing could be further from the truth. I am glad to be free of her. The problem is that she has threatened to take our kids out of the country (one of which I have physical custody and both of which I have joint legal custody). This is a green card holder who has violated the immigration laws on numerous occasions and I feel that the US will eventually catch up to her criminal record which would cause her to flee with our children. If the US does discover this will they check to see that their father is a US citizen (as are they) and contact him? Thanks for any help, advice, etc.

I recommend that you contact a family law attorney. You want an emergency order vacating temporarily vacating the custody/visitation agreement based on your daughter's father's conduct and that of his family. It is unclear how the paternal grandmother has any standing in this matter, but you need counsel in order to get this matter resolved appropriately. Do note that visitation and support are not related issues and you cannot deny visitation based on a lack of financial and medical support. Good luck with this.

I would never recommend paying a debt to any collector who proceeds via a phone call without also sending a letter and introducing themselves as a licensed WI collector, and providing their full name, address and contact information. The callers contacting you, on the other hand, could very well be running a scam, posing as collectors, when in fact they do not even have any legal right to collect the debt in question. If you pay them, you could therefore end up paying the same debt twice when the legitimate owner of the account moves against you with proper documentation. All telephonic callers, collectors who are only seeking you online or via email should therefore be presumed to be scammers and criminals until proven otherwise. Such a presumption will rarely be proven wrong in my experience. If you have a problem with collectors, you also owe it to yourself to consult with an experienced bankruptcy lawyer, whether you intend to go bankruptcy or not. bankruptcy lawyers will have the most clout in negotiating debts because creditors knows that they will generally be paid nothing at all of the bankruptcy is filed. The DA will review it to make the determination as what charges will be billed. It is not the amount of alcohol which determines whether or not you will be convicted of a DUI. The BAC is just a piece of the evidence. The BAC, field sobriety, circumstances surrounding the stop, etc will all go towards proving whether you were driving impaired. The charge is driving under the influence, not driving over the presumptive limit of .08.

Have a DNA test done that excludes your husband as the father. That will clear the way for the divorce and will prevent him from having any rights. Also, you can ask the AG to get a DNA test from the prison daddy and establish his rights/duties if you want to. I don't know why you would--child support isn't worth having a guy like that in your life.

First, the insurance company has the right to know what licensed drivers live with you. You should be honest in advising them that your 20 year old lives with you, if that is the case. They will take this into consideration in figuring your premiums, and will want know what cars, if any he drives. If you say "none", then the insurance company may require you to declare the 20 year old as a non-permitted driver, in which case if he has an accident, the insurance company will not pay. On the other hand, a lot depnds on the 20 year old's past driving history, and whether it includes moving violation, accidents, etc. If not , the insurance company might not ask for th is limitation. If that is the case, and so long as he lives in your household, and insurance company knows, you are probably OK so long as he has the owner's permission to drive the car. You should be honest with the insurance company, to make sure that you and your sons are covered in the event of an accident.

If you have a criminal case pending you will have to wait until the case is over. Then you can make a motion for return of property. If there is a forfeiture case pending you will have to fight it out in a civil court action. If you get a forfeiture notice make sure you comply with filing deadlines. But the actual case will have to wait until any criminal case is over. I live in Wisconsin. My husband and I are 3 years into a chapter 13 bankruptcy, and we have now seperated. The payments for the bankruptcy are garnished from my check. Is there any legal way I can get him to pay some of this?



Answer

Yes, your divorce attorney should ask the divorce court to divide the chapter 13 payment obligations in the same way that it divides up all other payment obligations. Normally that would be a 50/50 division of both assets and debts in a typical WI divorce property division. However, this is all negotiable, in which event the court will normally not rule on the issue of dividing this payment, but rather approve whatever agreement you have negotiated with your husband. Then, if necessary, the bankruptcy court can make an appropriate revision in the payroll order to carry out the family court order. If all else fails, bankruptcies which were originally filed as chapter 13's can always be voluntarily dismissed, or can sometimes be converted to chapter 7 cases where no more payments are necessary, but I could not begin to tell you whether that is possible for you or even a good idea, knowing nothing else about your case. For example, if you were using a chapter 13 to save a house from mortgage foreclosure and catch up on late mortgage payments, you may lose that protection if you dismiss and covert to chapter 7. You definitely need to set up office appointments with both your bankruptcy attorney and your divorce attorney to discuss these options. If you and your husband can no longer agree on how best to manage the bankruptcy, you may also need to get a new bankruptcy attorney, since your old one may have a conflict if a major dispute arises within the chapter 13 case between you and your husband.
