Once they get a judgment, they can go after your car, your home, your pay and your bank accounts. I assume since you have been sued that you immediately went to see a lawyer as you have a very short period to act, be it an answer, counterclaim, bankruptcy or whatever. That lawyer will tell you what your best option is.

It depends. Credit card companies can do nothing until they get a judgment. Once the judgment has been entered (and they do not have to give you notice as to when that will be) they can do nothing for 30 days until the judgment becomes final.

Once filed they can get a writ of execution called a fieri fascias (latin) or "FiFa."

They will then use the FiFa to have the sheriff look for any bank accounts that you have or any other assets that are owned free and clear. If your car is worth more than $3500 and is owned free and clear it is at risk. If the car is still being financed, then it cannot be seized.

Judgment creditors look for easy sources of money to pay the judgment. They don't really want your stuff as it costs money to have the sheriff seize, store and sell your things. And sheriff's sales do not bring in anywhere near what the car or other assets would be worth.

The easiest sources are (a) wage garnishment and (b) levy on bank accounts. Unless you are are retired or self-employed, they can garnish up to 25% of your disposable pay, There is a handy chart that you can use at the US Department of Labor - here is the link:

If you have just been served and if you have any valid defenses, then maybe you should get a litigation lawyer who specializes in credit card defense. Valid defense are generally that: (1) collection of the debt is barred by the statute of limitations (the statute is 6 years in Georgia; it begins with the last payment on the debt); (2) its not your debt because of identity fraud/theft; (3) you don't owe as much as is claimed (them adding interest since the delinquency has occurred does not count as a defense) or (4) that you already paid.

I did get the address but I decided not to take him back to court to pay for the 1/2 of our son's tuition ($10,000 per year) Now the ex has listed me in his bankruptcy as a creditor to discontinue paying this support. Unless the Bankruptcy Code has been revised, child support obligations are not dischargeable in bankruptcy. You may want to consult with a BK attorney and discuss filing an objection to dischargeability in the BK court.

We have a commercial building we have been working on for a couple of years. We recently hired an electrician to do some electrical work in the building. We had asked for a contract and estimate a number of times and he failed to do so. He had started the work and knew the limit we had set for him was $12,000 from a verbal agreement previously. After working only a few days he had done a good amount of the work but had been showing up periodically and not in any predictable fashion. Soon after not having shown up for a couple of weeks we called to confirm his next work day when we were told that he was done. From the work he was not done at all he had a lot more work to do. We even took pictures of his unfinished work. We later contacted the Better Business Bureau after having paid the contractor $10,000 for the work that he had already done, and he claimed that we owed at least $2,500 more. The negotiations failed because he wanted more money and we stated that he had been paid a fair amount and we no longer wanted him to work on the building because we couldn't trust him. We even have copies of his emails from the bureau stating that he knew that he wasn't done with the work and that the limit was originally set at $12,000. This all happened in October of 2010, he has now filed a Mechanic's lien on a house that was not the commercial property he worked on just recently March 11th of 2011 to be exact. The most I could make out in the state law was that he had 90 days after the last day of work or labor to complete this filing and he obviously failed to do so as it has been nearly six months later. So our question is what do we do now? (We also don't have a problem taking this person to court because we have plenty of photographic evidence and written evidence of all the unfinished work and contradictory statements he has made.)

This is very confusing, and if I misunderstand, please rephrase and repost your question. If you are asking if an estranged wife can dictate if a child of the marriage is around an live-in girlfriend, the short answer is maybe. Many courts will uphold the requirement of a 'morals clause' in the decree as in the best interest of the child. Generally it is phrased that the possessory parent may not have unrelated overnight guests of the opposite sex between midnight and 8 am during periods of possession.

Your ride will be in the back of a sheriff's van where you'll be handcuffed once they writ you out of whatever jail you'll be in once they catch up with you. You have an attorney so why are you asking questions here? Its not fair to either your attorney or the attorneys here. Your attorney has access to information and facts about your case. No attorney here does. And its unethical for other attorneys to intervene when you are represented.

Your post suggests that you are on the mortgage to the home. Divorce has no bearing on you being on the title or mortgage. You will still be on the deed to the home and on the mortgage after the divorce. The only difference is that your ownership of the home will be as tenants in common rather than as tenants by the entirety (available to husband and wives).

The problem is that if you divorce and you are still on the mortgage then the mortgage loan is reported on your credit. So all of those late pays are affecting your credit. And if your husband one day stops paying the mortgage you will still be liable on it.

If the husband is not cooperating, then you need to buy out the share of the husband and sell the property and get yourself out from under the mortgage. This will only get worse once the divorce is granted as there will be issues. The time to resolve this is now.

Technically it may be theft to remove flowers that are placed on a grave by someone else. However, it is theft from your Brother's estate. Therefore, as wife, she is the person most fit to bring a civil action for theft. From a civil standpoint, the cemetary probably has retained the right to mow and remove temporary objects (trash, flowers, cards) from around the grave markers and stones.. They may be able to direct the owner(s) of the plot to do that. As the widow, your sister-in-law may have the authority to do that.

But, if doing so, one is trying to cause emotional distress to the people that left the flowers, that person might be subject to a civil suit from the flower placer(s). In that sense, you and your mother may have a civil action against your sister-in-law for infliction of emotional distress.

From what it says, he can come in and act as if the agreement never existed - if the property was part of the purchase, then you are out of luck. Liquidated damages would equal whatever rent you had paid to date - you would owe hiim that amount. If you pay the balance all at once, the interest will stop. If you cannot pay off the debt, and you believe teh new garnishment interrogatories are including an old principal figure, then you should fiel a Motion to quash or recall the iterrogatories.

As to the four months of inactivity. The Judgmetn creditor has years in which to start collecting a judgment. The post judgment interest accrues during this period. If you feel that you are being charge dinterest on interest, you may want o hire an attorney to try to stop the collection. there appears to be a dispute in Misssouri as to whether you get interest on interest, or jus on the outstanding principal. If it is the former, then they may be figuring yours correctly, or close to it. If it is the latter, then you have been overcharged, and may even have money coming back. under the figures your mentioned, I do not see how your debt could accrue a $1000 interest in one month. Something does not sound right there.

Since the Amendment doesn't specifically name my mom as settlor/trustee and then state her wishes to amend her 2006 Trust to make my brother to be co-trustee, is it valid?

You are blinded to the fact that a third party is involved here, which is not a party to your divorce.

When you were together you both signed a promissory note for a loan. That loan was secured most likely by a deed of trust that you both signed, which encumbered the property as security for the loan. You call it a mortgage, but you don't really have a mortgage, as that is a different security instrument that is hardly ever used in California.

The third party is the bank. The bank could be the original bank, or a bank that bought the promissory note from the original bank. You promised to pay back the loan, and as it stands right now, you are personally liable to repay the loan, even though you are no longer on title. The bank is not a party to the divorce, and it is up to them whether or not they want to release you from the promissory note.

The only way this is usually done is with a refinance. The economy is not good for this right now, and if the bank does not want to refinance, you can't force it to refinance. It simply is not your husband's decision on who is going to be on the promissory note to the bank, and the joint debt that you signed is not considered a joint account.

It is true that the lender is under no obligation and cannot be ordered to release you from the debt or give your ex a refinance to take you off the account. But that doesn't really matter. The bank must take the money if your husband pays off the loan, and there are two ways to do that. 1. is just pay it off if he has the cash, 2. is to take out a new loan in just his name. The divorce decree contemplates that he will do one or the other. He should not have signed the MSA, or accepted a court order that he remove you from the mortgage if he did not intend to or was incapable of doing one or the other. Your remedy is to file an "OSC" (order to show cause) why he should not be held in contempt of court for failing to comply with the terms of the divorce decree. If he is found in contempt he will be ordered to get a new loan within a certain time. If he fails to do so, you go in on a second contempt proceeding and ask that the house be sold.

On the return line be careful not to lose the little compression washers. Remove the two bolts that hold the injector in place. The injector should pull out. Be careful not to lose the copper washer that usually comes out with it.Inspect the end of it. There should be tiny holes in the end where the fuel sprays out.Unless you have a injector tester you will have to take them to a Diesel mechanic and have them tested. They will hook them up to a machine that can apply the PSI required to see if they are working properly. It shouldn't cost that much.

A few years ago I went threw Friend of the Court when my ex girlfriend had my daughter. First, I was ordered to pay child support, and arrears (which have long since been caught up), and I had weekend visitation. About a year after that order was put in, she attempted to file a change of domicile, and during that time, we ended up going back to court because she was unfit to raise our child. The court agreed that my daughter should live with me, and they wrote up the order. She now stays with me Sunday night threw Friday night. In addition, the removed all of my child support fees. There however is still a fee coming out of my check ( and has been for awhile) for "current cash medical support". I provide all health coverage for my daughter threw my job, which I pay for out of my check. Is this just a fee that I have to deal with, even though I do not have support payments anymore, and I am taking care of my daughter, or can I get this removed?

This fee should be removed. Contact the Friend of the Court. The mother should now be paying child support to you.

A computer is fine and it is best to do multiple originals with each one signed and notarized.

Depending on the age of the tax bill, it may simply vanish in a court order. The older the bill, the more likely that is to happen.

If you are still within the timeframe that the state can collect taxes from your business, you will be personally liable for your business taxes if the business cannot pay them. If you cannot pay them, it's still very, very difficult to discharge them in bankruptcy. You'll need to work out a payment arrangement with the taxing authority. They're generally fairly easy to work with because they know that the money will come to them (with interest and penalties) regardless of the timeframe involved.

You need to get a certified copy of the judgment. It is not a simple thing to do. Many lawyers do it wrong. There is no form.

During our relationship I was asked by my ex to be in charge of all the financial aspects of our relationship including his bills. He is now suing me in civil court claiming he never gave me permission to use his checkbook. I am vigorously fighting this lawsuit, however now he is being sued by credit card companies and has told them they are not his debt and I used the cards fraudulently. At no time was any of this ever an issue until I broke off the engagement and ultimately had to file a restraining order against him. He was invited in by the customer, was giving his demonstration, and was never asked to leave. There should not have been charges filed. Is there something we can do within the legal system to ensure this abuse doesn't continue to happen without consequence? The officers response, was they shouldn't let a person his size be a door to door salesman. What happened to "Life, Liberty, and The Pursuit of Happiness?"
