My 3 sisters and own a house...all 4 of us are on the deed..however I live in the home and I pay for everything taxes ..Insurance. etc...there isn't any morgage as it was my parents home..I want to know if my sisters are by law obligated to help me with the taxes.house insurance or matinence on the house...also since I am paying foe everything do Massachusetts laws entitle me to own this house after so many years...thank you

You can sell the home and split the profits or you can buy them out. The issue is what is a reasonable rent for the home versus the expenses you incurr.

For instance if the market rent for the home is $2000 a month and the insurance, taxes and necessary improvements that a tenant would not be required to pay are more than the rent, then they should contribute a portion of the difference.

My advice is to make a deal to buy them out at some point if you can afford it. At some point one or more of them may want or need the money from the value of the home.

As co-owners, each of them has the right to use and possession of the property, and each of them has an obligation toward its maintenance and upkeep. As attorney Roth has pointed out, you appear to be the only one living there. Generally a co-owner is not made to pay rent to live in their own home, but if you have excluded the others from living there or refused to make the property productive of income, there could be an argument that you should pay rent. You should really speak with a lawyer who practices in this area and put together a well-reasoned offer to buy out your siblings.

Yes it could definitely be a problem. If he is part of your son's life then your relocation to Great Britain would deprive him of that. You will need to settle this issue before you are divorced. The divorce papers will have to specify that you have fully custody, that you are taking your son with you to Great Britain with his consent, and should include whatever visitation is agreed to. If you cannot agree to this I would strongly urge you to get a lawyer familiar with relocation law.

I contacted them about getting my money back because they lied to me and from the people I have talked to in the building, they lied to everyone that signed onto the year contract. Let's say Jeff is a large scale MDMA, Heroin, and Cocaine dealer in Nebraska. He sold 50g of MDMA to Adam from Delaware but also sold 1 kg of MDMA, 1kg of Heroin, and 1kg of Cocaine to other smaller dealers throughout the US. Adam sells the 50g of MDMA to people he knows locally. He also has an assistant Matt from Virginia who helps him sell MDMA sometimes by finding buyers. Overall, Matt helped Adam sell about 10g of MDMA. However, unknown to Adam, Matt also helped another guy (a bigger supplier) from Pennsylvania sell 5g of MDMA as well as 10g of Ketamine.

First, you say that your biological father died many years ago. When? Where did he live at the time of his death? Why did you not do anything about this until now? Was an estate ever probated for your father? Did he have a will? What assets did your father own at the time of his death and how were they titled?

The starting point would be for to go to the probate court in the county/state where your father lived at the time of his death and see if an estate was ever probated for your father. Regardless of whether he had a will, if an estate was probated, it will tell you if there were probate assets and how they were distributed.

The problem is that if these assets were distributed a long time ago, why was no provision made for you since you were a child? Was any trust set up (if there was a will) or was the money paid to the clerk of court?

If no estate was probated, what assets did your father own at the time of his death? If he was not married to your mother, it means that you were born out of wedlock. Was paternity ever established? If not, then you have no automatic right to inherit. There are time limits for establishing paternity. However, the laws will vary depending on the state. Again, the problem here is that a lot of time has passed and it may be too late to try and establish paternity now.

Assuming NC law would apply, if your father had no will and if he was unmarried, your father's assets would pass to you and any children if paternity was established. Your share of the assets, if you were a minor (under 18), would either have been paid to your mother (if she established a guardianship if the assets were over $1500) or directly to your mother (if under $1500) or paid to the clerk of court. If the latter, you can check with the clerk in the county where the estate was pending to see if there is a fund for you.

If paternity was not established, then any assets owned by your father would have passed to his parents if they were alive and survived him. If not, then his siblings. If there was animosity by members of your father's family towards you and your mother or if the father's family was not aware of you, then the assets would have been disbursed and no attempt would have been made to notify you or your mother.

As I said, I would start with the probate court and see what was done if anything. I would check with the clerk of court or entity in the state charged with handling the assets of minors if your share of the estate was paid over. However, if no estate was probated, you might want to talk to your mother or other of your father's family to see what was done and what your father owned at the time of his death and whether there was any kind of effort to establish paternity for you (either through legitimation or some other means). Depending on what you find out, you then might want to talk to a probate attorney who practices in the county/state where your father's estate was probated to find out about the rules in that state.

My guess though is that this is going to be too late and/or your father had little in the way of assets.

Not so simple (like many aspects of law). Two years from the date of injury or when a reasonable person (objective standard) would have realized that their medical problem was work-related. But, after authorized medical/hospital benefits or indemnity checks are provided, the worker gets 1 year from the date of the last treatment by an authorized doctor. I've been helping injured workers for 36 years and I know from experience that some injured workers worry over small details like the Statute of Limitations (S/L) but ignore the bigger issues in the case. For example, trusting the employer and their carrier, the adjuster and the nurse case manager assigned to you is like letting the fox watch the henhouse! They may act like your buddy and you may be afraid to "rock the baby carriage" but that is exactly what they want, and which is the worst thing you can do. I've spoken to at least 100 injured workers who were sent back to light duty or sedentary duty for the same employer and they failed to get lawyer advice until months later when they got terminated or fired. The problem is widespread because the law is written to favor workers who cannot work (they have big cases), and disfavors workers who can return to any work even if unskilled sedentary work (they have little cases). So, the goal of the insurance company from the first day of the injury is to hand-pick the doctors who will treat you but who really are insurance doctors who get most of their patients from insurance companies, and get the doctors to return you to work ASAP and then the carrier tells your employer to make up a job sitting on a chair if necessary just to prove that you are not disabled. Then, months later, when the coast is clear, they terminated you which they have every right to do. Many workers wait until this point to see a lawyer and I've given them the same speech: "I'm a lawyer, not a magician! How can I make a decent case when you went back and worked which proves that you are not disabled? It's black and white....a man is either disabled or not. If he works, even sitting on a chair doing nothing....he is not disabled! Like a woman is either pregnant or not...she can't be half-pregnant! And, an injured worker can't be half-disabled! By going back to the sit-down job, you ruined any chance of making a decent claim. Sure, they'll offer you something to settle...maybe $10,000...maybe a little more. But, your case was worth over $200,000 and by sitting in that made up job, it cost you hundreds of thousands of dollars!"

Please don't wait to get good legal advice from a lawyer who does nothing but handling cases for injured workers. The good ones handle only injured workers and nothing else...they don't represent insurance companies or employers...just workers. If they are board-certfied in workers comp law by the Florida Bar, that's even better. Good luck,

There are only 2 states where it's against the law to record a police officer, Illinois and Massachusetts. In a handful of other states, including Maryland, it is against the law to clandestinely video a police office without his knowledge. In other words, in these states, as long as it's obvious that you are recording to the police officer (and don' have the camera hidden in a bag or some other clandestine way), you may be arrested, but typically it will be for something like breaching the peace or interfering with an investigation. They are bogus charges that will often be dropped.

We had a deposition and went to a temporary trial, but have not yet gone to mediation (and obviously not the final hearing). I have asked my lawyer at least 4 times to send me an itemized bill so I know where I stand with the retainer. I was finally (last week) sent 2 separate bills. One from Sept to Oct of this year in which my retainer fee was almost entirely used up (the bill was printed on Dec 12) and another bill on Dec 14 from Oct through this month showing charges of over $3,000. This seems absolutely unethical to me. In addition... the lawyer also told me not to contact the other parent of my child the day before the trial to arrange visitation... and as it turns out, that advice was used against me in the temporary judgement of the magistrate. I was also billed for a deposition that I never even knew took place until the day of the trial. The deposition was never used in trial but supposedly took place some time in October. I still don't know what questions were asked in this deposition or what was said. In addition to this, the lawyer is charging me $250 an hour for services regardless of whether she is doing the work or her paralegal is doing the work. I have contacted other lawyers who have told me they charge $100 an hour for their paralegals work. I gathered several statements from doctors and therapists to help prove what is in the best interest of my child. However, the lawyer never presented a single piece of evidence at the temporary hearing. I was told this is not the time to present that information or else it was irrelevant. However, the other parent called a therapist to testify at the trial and the magistrate seemed to deem that very relevant to her decision. What are my rights? What is my best course of action? No other attorney is going to be willing to take on a case in which I owe another lawyer $3000. I called 7 different numbers in Florida today (including the State Bar Association). I asked what are the expectations between a client and a lawyer? Surely there is something in writing SOMEWHERE that states what a client can expect from a lawyer they have paid thousands of dollars to? Her answer? (and this is someone from the Bar Association) "I have a lawyer myself... and I can't even answer that question!" I was told it is standard practice to notify clients when you are within $500 of using up your retainer fee. What is my best course of action? I called the lawyer today to go over my bill... I was asked if they could pull my file and call me right back...but, they never called.

Of course you would be subject to the subpeona, if you own or possess the records of the business. If you operate the business under the danger company name, an injunction would still be effective. But, if the new corporations merely buys the assets of the tainted business, the new company might be free to operate. Obviously, the value of the present business is worth very little or nothing until the cloud is cleared up. The only real value would be the inventory, equipment and possibly the buildings and grounds. Based upon what you report, the accounts receivable are probably worthless, and the bad will of the company reduces the value of the assets.

Should not they also be enjoined in a legal argument that they participated in allowing this guy to surreptitiously sell to them knowing he worked for us? There is an easier way to handle your affairs. Name your siblings and parents as beneficiaries on the accounts, to receive payment upon your death. There will be nothing left to pay off the credit card, unless the beneficaries want to pay off the balance, but they are not obligated to. And tell them to not let the creditor pressure them for payment, should they not want to pay off the balance or negotiate the balance down to some lesser sum.

Its not that the grandparents' wills are invalid. However, the grandparents' wills only control the disposition of their assets. Once those assets pass to the beneficiary (your father), they are owned by your father and when he dies, the disposition of his assets will be controlled by your father's will, not your grandparents' wills.

If your grandparents wanted to maintain control, they ought to have set up a testamentary or living trust.

You say you have 2 step-siblings. Did your father ever adopt them? Does your father have a will? If your father has no will, everything will pass to his spoues (if any, as he could remarry intheory) and any natural or adopted children. However, children of his deceased spouse do not inherit by right. If your father has a will, he can leave his assets to whomever he wishes and could disinherit a biological child and include the step-children if he so chooses.

I bought a business from a corporation that I found out after the sale was dissolved. They presented themselves as still being in business and never disclosed that they were dissolved. In fact, they were still buying and selling as usual. I paid much too much for the business because they falsefied their tax returns and In the course of buying the business the sellers also assigned their lease to me which was way above market value. The land lord was aware - and think might have been envolved in what I consider to be fraud. Do I have a case?

It sounds like you were purchasing the business, not the corporation. So I am not sure how significant it is that the corporation was not in good standing. The fact that you relied on false financial information is an issue and an attorney would need to review the purchase agreement to see if you waived any rights. Many agreements contain due diligence provisions that state that you are not relying on information, etc.... The lease they assigned was the lease they had. Many leases entered into before the economic downturn are at rates that are no longer competitive, but I don't think they misrepresented their lease. They offered to assign the lease and you accepted it. They did not have any obligation to renegotiate their existing lease. You need to take your purchase agreement and related documents to a lawyer and have them reviewed.

Depends. If you can prove actual fraudulent concealment and misrepresentation of the books, income, sales, inventory, orders, capital value, etc., then sure, you can sue. If you were simply negligent by failing to conduct an effective 'due diligence' investigation about what you were buying, then a law suit is going to be money and time wasted. The "dissolved corporation" part of your argument is a waste of time, as I tried to point out in my previous answer to your mid-day version of your question. As far as the tax returns go, most businesses that "fudge" their returns will be trying to look LESS profitable than they really are. You should have had them give you permission to ask the IRS for copies of the as-filed originals.

As far as fraud goes, you will need to plead and prove a material mis-representation of fact, or concealment of a material fact; that you relied upon the misrepresented or omitted fact in deciding to buy or how much to pay, that such reliance was reasonable, and that you suffered harm as a result of your reliance.

If you can do so based on admissible evidence, a suit for fraud may be worth while, and you should discuss the possibilities with a lawyer. However, the status of the corporation as dissolved adds nothing to your possible complaint, nor is it likely that the overpricing of the premises lease adds anything unless it was concealed. Courts will not compensate you for paying too much.

Second, I would assume that you have a written purchase agreement that spells out the various seller warranties on such transferring of assets or shares. So, in order to fully answer your question, you will want to select an attorney and provide him/her with a copy of the purchase agreement. Often your rights and responsibilities will be detailed in the signed agreement.

When he gives me the bottle to go in, under the cap i notice there was like a powdery substants under the cap, but never thought to check it out. Atleast i think it was powdery it looked like it. i bet they not suppose to look like that under the cap. So now i just went to my arraingment for 11550 now i go back to court on may 6. I am a pro se litigant who has filed a Motion fro Summary Judgment. The return date was scheduled for March 8th 2012. The plaintiff retained a new counsel who asked for an adjournment stating they did not have enough time to prepare response papers. I objected as the plaintiff has changed lawyers twice so far. The previous lawyer withdrew due to nonpayment of fees. Second lawyer suggested the plaintiff pay and settle. Plaintiff did not like this so hired a third lawyer.

How many adjournments will the judge allow a plaintiff to have? What if he keeps finding cheap lawyers to represent him? What are my options?

One of the problems with being a pro se litigant is the lack of respect afforded to you by the Court.

There is very little you can do to prevent future stalling tactics. A change of attorney is a valid reason for granting an adjournment. Just be patient for now. Even attorneys must deal with these delays.

I assume you are speaking about the 3 day notice or quit. The landlord can not enter by force and can not enter peacefully without giving you reasonable notice. You are entitled to peaceful enjoyment of the until until the sheriff serves you with the eviction notice that comes after an unlawful detainer judgment. But what are your damages? Perhaps a few hundred dollars which would be offset by the rent you owe so you would not really collect anything, just reduce your liability to the landlord.

They were hiring in anticipation of employees retiring and winning contracts. Neither of those happened. Instead of furloughing these guys, they are forcing them to work out of state and are not paying for their lodging. They are payed less now because of the job they are doing. How many time does a person have to be arrested for any reason when the DA fails to pick up any charges prior to the cops being considered harassing of the person. I have been arrested 4 times in the prior year, none of the times were any charges picked up. This has happened several other occasions in the past, how many times does it take before i can file against them for putting me in jail when they knew they didn't have a case or just because they could put me in there so they did put me in jail? It seems unfair that they tell another person that got arrested and not charged that they just "feel we needed a time out, not to worry we are going to write up the case in a manner that the DA will not pick up charges against you or her." That fully supports the cops just arresting us because they could and not for valid purposes. Do I have a case against the police in ca. for this?

My experience in this area is limited to three years as a law clerk in the public defender's office while in law school. I'd say you haven't given us sufficient information about the circumstances of the arrest or what the police reports allege. The DA's office and the courts are clogged with serious matters. Lots of illegal activity goes unprosecuted. Don't push your luck; next time you may get fined or be given 30 days in the slammer. Or worse.

I'm a criminal defense lawyer and I've seen situations similar to what you describe many times. Without more facts I cannot tell you whether probable cause exists. Merely because the DA does not pick up the case is not proof that probable cause does not exist. There are many reasons a DA does not pick up a case. In many jurisdictions there are ongoing fights between the police department and the DA over what should be prosecuted and I suspect that is what is happening in your city. You are unlucky enough to be caught in the middle. You might repost your question for a civil rights attorney who can better answer whether it is harassment.
