I have been married for 12 yeas now with 3 boys in common, but my husband is failing to sleep at home. He goes for work or school and he does not come home to sleep. This situation it's been going on for years and I am tired of it, I know I deserve better than this. I recently moved to FL since he was recently released from army, but without him I wont be able to pay the rent and all the bills and I am struggling economically, I want to leave to NY since I have family there, however, I will need to sale my furniture because I don't have the money to take it with me. I told him to get his own apartment and do his life, which hopefully he will do eventually. My question is: Can I sell the furniture and with that money leave to NY? He says that if I do that he will sue me and I will get in trouble...is that true? I really need to know what choices do I have to get to NY.

You cannot relocate with the kids unless you get his written consent, or a court order. You should file your case asap if it is your intent to move. Also you have a case for alimony.

YOu need to find out what is really going on. If he has custody - he is living with his mother - then who is raising these children. If the bio mom comes and gets the children - why does he have full custody? As to child support - yes I would be concerned - is she planning on saying that she has the children as much as he does and should not be paying any support? I would be worried.

Unfortunately many people in this situation are left with no good options. The general rule is that you are entitled to a rental vehicle, but the duration of this is limited to the time reasonably necessary to obtain a new vehicle. This is typically a few weeks. The law essentially imposes a duty on the person with the damaged car to purchase (or lease, borrow etc.) another vehicle after a reasonable period of time. In theory, most people could simply finance a new vehicle, but sometimes this is not possible due to, e.g., their credit status.

The above responses were all good. I'd like to add one point however, DO NOT AGREE with your insurance provided lawyer or adjuster to provide testimony that is untrue. At the end of the day, your insurance company AND the lawyer they provide are primarily in it to protect THEIR pocketbook!

If you think that you were at fault, even partially, make sure to write - this is important must be in writing - to your adjuster AND your lawyer a letter demanding to settle your case within your policy limits! If you do that and they refuse, any excess judgment will become your insurance company's problem, not yours. For example, if you only had minimal coverage (15/30) and the judgment is $100K, you will not be responsible for the balance if you follow what I suggested. Of course the plaintiff must be willing to accept your policy limits if the above situation is the case, otherwise it won't work. Nonetheless, you must have the proof that you asked to resolve this within your policy limits and your insurance company took a gamble with your credit and at your peril.

If you do these things and your insurance company fails to pay any excess judgment, you call me and we will sue them for bad faith which is a whole different ball game.

Stated simply, he can leave his property to anyone he wishes, subject ONLY to his wife's right to elect against the will (which is not an issue in his case.) His heirs at law, the neices and nephews and cousins, have no claim on his estate unless he dies without a will and after his wife has died.

He needs to get his will prepared by an attorney in accordance to his wishes, and executed before two witnesses, which could be you and another person; you really can't do anything else other than help him make arrangements to get that done.

Consult a Maryland lawyer. That lawyer can write her a stern "cease and desist letter" to stop. With a name change request, if nothing else, the court usually will hyphen the last name, including the last names of both parents. Most likely, the court will leave the name as it exists and simply add, after the hyphen, the father's last name. As to what name you use for all purposes, that is a personal choice, although, from what I have seen, most will use the first of the two names, as hyphenated, for most purposes (although there is no legal rule for that). Very sorry to hear you recently lost your father.

Regarding probate administration in Ohio, once the estate is opened (by the Will being admitted to probate) and the Executor appointed, the first significant deadline would be the requirement to file an Inventory of all the probate property. This is normally required within 90 days of the Executor's appointment, though extensions can be granted. If your father passed in December 2011, then you may just be getting to that time, depending on when the estate was opened.

If in fact there are multiple pieces of real estate as you indicated (10) that must be sold by the Executor, then I would anticipate the probate process will indeed take a significant amount of time -- likely longer than 12 months. Even if the will states 12 months, this would be what is considered "precatory language," meaning it would be desirable and within the decedent's wishes, but it would not be controlling. If the estate administration is likely to take longer than 6 months, the Executor can request and be granted an extension; in fact, this is done quite routinely.

The next significant deadline for the Executor would be to file an accounting at 13 months after being appointed. A copy of the account must be provided to you for review and you then have an opportunity to object if you believe something has been mishandled, etc.

Now, having said these things, the implication is that you will have to be somewhat patient; however, this does not excuse your brother's lack of communication with you. In fact, as the Executor, he has a duty to act honestly and fairly in relation to all the beneficiaries. Part of this is to keep you reasonably informed, and if he refuses to do so then you may have grounds to have him removed as the Executor. This would require a motion to remove be field with the Court and probably an evidentiary hearing to prove the grounds for removal.

I would recommend you discuss all the details with an experienced probate attorney so you can evaluate whether or not removal should be pursued, or possibly the situation could be smoothed out just by having an attorney represent you and keep tabs on the administration to ensure your rights are protected.

It would appear the action of your father is not legal, and you can contest the will as being invalid on the ground the will was executed under menance, fraud or duress, especially since your brother and yourself are what is called pretermitted heirs, meaning not being included in the will, as to at least some sum, which would show your father thought about the two of you. Secondly, if the witnesses to the will were also gifted by the terms of the will, then the will is presumed to have been executed under menace, fraud or duress, and the burden is on the witnesses to prove otherwise. Lastly, obtain probate litigation counsel in San diego county, San Diego, California to file a petition to have the will declared invalid and obtain distribution for the two of you. The last thing mitigating in your favor, is the fact the will was executed just before your father's death, which leads me to be suspicious of his ability to understand the seriousness of his actions.

You (and your brother, if he is so inclined) need to contact a California estates litigation attorney to pursue your challenge of the will. This may include probate litigation in San Diego County Superior Court, to determine whether the will is valid, how the estate should be distributed, and who should manage the estate before its distribution.

A will witnessed by an interested person in California is not automatically invalid. If the will is not witnessed by two disinterested people in addition to the interested person, however, the gift to the interested person is presumed invalid. Your grandson's boyfriend would then have to prove that there was no fraud, undue influence, or other issue with respect to that gift. The relevant statute is California Probate Code Section 6112.

In an initial interview, you would want to share with the attorney any and all information you have about your father's state of health at the time he made the will, the size of the estate, any prior will that he had made, the nature of the relationship between your father and the named beneficiaries, and a host of other matters. It would help matters greatly if you could provide the attorney with a copy of the will you wished to challenge, and any prior will your father had.

Visitation is reserved means that the court retains jurisdiction to consider awarding visitation upon your requesting it. What you have to do is file a petition in the case requesting visitation, serving it on the father. Unless there would be some demonstrable harm to the children by allowing you to have visitation, you will be granted it. The real issue will be the schedule, locations, terms and at whose expense. I strongly suggest you retain or at least consult with a MD family attorney who can assist you in this matter.

Your question makes this sound like you are doing something very foolish - negotiating a major insurance claim without a lawyer. In cases where someone is underinsured, you need an experienced lawyer to see if there is other coverage (possibly your own) or assets the drunk driver may have that can be pursued, and also to determine if your health insurer does or does not have a right to reimbursement (we don't have enough information here to answer).

To answer your specific question, the health insurer will try to BS you into paying it all of the liability insurance to it initially then will act like it is doing you a favor by reducing what it takes somewhat. If your health insurance is a private policy you or your son purchased then that is regulated under Georgia law. The Law of Georgia states that in order for health insurers to be able to enforce such a subrogation claim the injured person (your son in this case) has to be "made whole" from all losses including both economic and non-economic.The amount of the DUI driver's liability insurance is not enough to satisfy that requirement so you would not owe the health insurer anything back. If the health insurance policy came about as a result of someone's employment (either your son, you or another family member) then the situation is a little different. The subrogation would then be governed by a Federal Statute called ERISA. The "made whole" requirement would still exist but it is possible that such was waived by the language of the policy and you might owe the liability coverage amount back to the health insurer depending on the language of the policy. This is complicated stuff and I strongly urge you to get legal advice from an attorney experienced in such matters. Most lawyers will not know about this.Only the most expert personal injury attorneys will understand this issue.

I disagree with Mr. Betinol. Although I often advise clients to form a corporation or LLC, neither is universally desirable. Both have record keeping, accounting and tax requirements that can be burdensome for a small business. Each also has its own rules about how investments, ownership, and control interrelate that can be desirable or undesirable in any given business model. For a small, low-liability-risk business with limited administrative time, resources or skills, a partnership with good insurance may well be all that is needed and may provide needed flexibility in management investment and control for a new business. There is no reason a partnership cannot incorporate or become an LLC at a later date if it grows to a point and becomes complex enough that a more formal form is required. The bottom line is that you need to consult with an attorney who can familiarize themselves with your business model, and preferably with a good tax accountant as well, go over your business plan and get their advice on the best way to form your business entity.

Not sure what an "o.e. agency" is. There is no law against getting another credit card account while you have two in collection. The Fair Debt Collection Practices Act sets out a great many of your rights with regard to what a debt collector can and can't do.

You are in GA but where is the estate pending? In GA? An executor should never make a final disbursement to any beneficiary prior to getting final approval by the court. That is not the way things are handled. If all bills have been paid and the estate is ready for closure, the executor sends a release to the beneficiary and indicates that payment will be made once the estate is closed out. The executor needs the release because that will be part of the final accounting..

The final accounting for the court showis the property that was in the estate and any disbursements; releases and receipts are attached. The clerk or court goes over the final accounting and if all is in order gives the stamp of approval. Then the final checks are sent out. If a beneficiary will not sign a release (it includes a statement about the accounting and not objecting to it) then the executor files the proposed accounting and sends to the beneficiaries They can object or not. The court or clerk will then hold a hearing on the accounting and any objections and rule.

I would contact a probate lawyer who practices in the county/state where the estate is pending because state laws differ and county practice can vary. You want someone familiar with the practice and procedure for the county where the estate is pending. If nothing else, I would pay for a consult with a probate attorney.

They requested additional work towards the end of the contract that was outside the initial scope of work- they paid for some of the work and decided, although they accepted the work, they were not to pay the rest of the work- the final invoices (8,500). I only found out after the work was done and received by the company- in Feb 2011 when I sent them the invoice. Their excuse not to pay was, they have no liability to me because I did the work without a contract- But I have documentation (the work and emails of employees telling me to go ahead with the work and them asking me questions about the project during this time).

The problem I have is- I recently became an LLC. I filed a case in Small Claims court as a sole proprietor because throughout the contract I was a DBA, and I am still a single person, but now I am a Single Member LLC. The company filed an SC105 saying I cannot sue for more than $5,000 because although I was a DBA throughout the contract, I am now a LLC. I am not sure how to proceed? Will SC court dismiss this based on this or will SC court still consider me a DBA, as we will be in court for something that happened over a year ago when I was indeed a DBA and had they paid, would have been paid as a DBA? Would it be better if I keep the court date in SC court and then file in another court (limited jurisdiction court) for the rest, is this possible? If not, how can I recover the full amount? Should I have the SC case dismissed and re-file in limited jurisdiction court? If so, how will the dismissal later be view by the other court? And can I still represent myself limited jurisdiction court as I am a SM LLC?

I don't know and I cannot predict what the court will do, but it seems to me your lawsuit is based on the contract between you as an individual with the defendant, and not the LLC that you formed later. It seems to me the matter is a "red herring."

Under Code of Civil Procedure section 116.221, an individual may bring an action in small claims for amounts up to $10,000. That statute has exceptions which are set forth in Code of Civil Procedure sections 116.224, section 116.220 subdivision (c) and section 116.231, subdivision (a).

I'm not sure what section they are citing in their papers, and I hate to assume, so could you provide the specific code section they are relying on?

I finally was hospitalized due to my mental illness, treated for my condition, and returned to my healthy state of mind. During the period of illness I enrolled in classes which I subsequently "refused to finish" (the reasons being an unstable frame of mind). I have tried to have my academic records from that time period expunged because I was not mentally fit to enter into contracts of enrollment in the first place, and in the second place my education was disrupted due to medical conditions. The issue that my school keeps bringing up, is whether I have medical records during the academic semesters affected. I do not. However, I visited a mental-health specialist just prior to and at the end of my mental break, both of which support my statements about my mental health. I think it is unreasonable for the school to expect me to have had the presence of mind to see a doctor at the time of my enrollment (in between those bookended doctors visits), when the issue of having no presence of mind is what affected my academics. If I had had the presence of mind to see a doctor, I would have been treated and not ended up in the situation I was in.

To answer your question: it depends. Did the County Sheriff do something that was negligent, or was the County Sheriff's office simply a victim of crime as you were? Also, have you been damaged? Did your insurance company pay you for the loss? You would need to present more facts to get a more complete answer.

understanding that the new law preempts the regulation of handguns

exclusively to the state. It is also my understanding that the City

of Chicago bans laser sights.

I would like to know if a person carrying a firearm with an integrated

laser sight could be subject to any criminal penalties or seizure of

property, if they were to carry a firearm with an integrated laser, in

the City of Chicago under an Illinois Concealed Carry license?

There are a number of subcompact handguns that have "built in" laser sights such as subs designed by S&W, the XD9, other co.'s.

Regarding the laser sights, the CPD Chief McCarthy is still ordering his officers to seize and the owner forfeits their ownership of the weapon. (I have a copy of the "order" in .pdf format if you would like one, email me.)(Department Notice D13-10)

Your case would then most likely have to be litigated in the courts. This is a new and unexplored area in Illinois law, The courts and how they interpret the City Municipal Code will have a heavy impact on the new CCL law.

I would advise against carrying so not to be the "guinea pig", test case for the State/County/City.

Your 401(k) has plan documents, which state that certain things that are allowed or not allowed. I doubt that they are entitled to keep your money. There may be a vesting schedule for company contributions. Perhaps they think that you are taking out a loan. Where are the assets held? Perhaps you should be dealing with the plan sponsor and not the employer.

No. As the childhood sing-song said: Sticks and stones may break my bones, but names will never hurt me. Add to that "... but depressed and sad looks will never hurt me." Criminal assault is a lot like that. Bad words or bad looks alone are not enough. It might be uncivil to act that way, but our society doesn't make it "criminal." There has to be (i) an intent to frighten or place a person in fear of immediate unwanted physical contact [a "battery"] ... plus ... (ii) some act in furtherance of that intent ... plus ... (iii) the present ability to do the job. The defendant must intend to injure the victim or make the victim reasonably fear being struck. An assault must be intentional, not an accident. The intent isn't judged on how the victim interprets the look or conduct of the suspect, it's the suspect's subjective intent (which can be proven by piecing together what he does, how he does it, what he says, etc.). Here's an example that distinguishes similar conduct but one might be criminal while the other clearly isn't: someone comes up to you and hits you on your back several times very hard; if it's a friend you haven't seen in years and he's saying at the same moment "Hey, buddy, it's so good to see you!!!" then it's not an assault even though you got hit pretty hard because the assaultive intent is lacking ... but if you get hit just as hard, the same amount of times, in the same location by a stranger right after you got the last Black Friday door-buster video game that the stranger wanted and the stranger was yelling in a loud/mean voice "Hey, buddy, that was MY video game!!", it might well be criminal because there's circumstantial evidence of criminal intent (a desire to injure you or put you in fear of an unwanted, forceful touching / battery). Another example is when boxers or MMA participants square off in the ring/cage and punch/kick each other; there is a clear intent to injure the other person and put him in fear of being slugged, but it's not an assault & battery because they are mutually agreeing to participate in this event, so there is not an "*unwanted* violent touching" involved. The differences between the these various situations make all the difference! This is what cops, prosecutors, defense attorneys, judges and jurors have to do: look at ALL of the circumstances and separate criminal acts from non-criminal acts, look at the crimes' elements (parts), and see if EVERY part is provable beyond a reasonable doubt.

If this is not your debt and you have been named and served, then get to a lawyer and get this dismissed because the creditor has sued the wrong person.

If this is your debt but the creditor got the name wrong, you do have a moral duty to correct this so that a judgment is entered correctly.

If you do not do so, a judgment will be entered but the creditor will probably have a hard time trying to collect as this person does not exist. Sooner or later the creditor will find out they have the wrong person.

On cold days, you should let the engine warm for a minute or two. Then, if you press the accelerator to the floor for just a second and then let it up. This is done really fast. Floor it and let it right up. The fast idle should release, and hopefully you won't get that kick any more. You may have to press the accelerator down more than once to get the idle to release. Just today I recieved 2 notices from 2 different collection agenices one for the HOA fees that are past due and the other for the full balance of the 2nd mortage that was on the home. Can both of these be disputed and removed from my credit or am I under obligiation to pay these debts even after the home was sold?

If the CC&Rs;provide that you are personally responsible for the HOA fees, then yes, even though the house was sold, you are liable for those fees that were not paid at the closing of the sale to your buyer. Check the HUD statement to see if any or all of the HOA fees due, were actually paid.

Regarding the second mortgage, it depends upon what the funds were used for which will determine if it falls under the anti-deficiency statute protection. You are liable for repayment of that loan if the funds were used for anything other than buying or improving the home.

If a telemarketing company is trying to collect a debt alleged to be owed to someone other than the telemarketer, they are a collector under the law, and must obey certain guidelines. If they did not send you a n otice of debt, and notice oh how to dispute in writing letter before calling you, htye violated those guidelines, and may owe you money. You shoudl consult directly with a civil practice attorney in your area. Provide that attorney with all the information and documentation you have regarding this matter. Perhaps they can give youadvice specific to the facts of yoru matter.

Besides walking away from the deal what right do I have to make the seller repair the home to the agreed condition?

You could go through with the deal and then sue the seller for the cost of repair on the basis that what is being sold is less than what was agreed to, but filing such lawsuits is never a good economic solution because you would probably hire an attorney and with court costs might only get 70% of the value of the repairs required. It is best to get another inspection and lower the sale's price by the cost of repair.

You need to consider the doctrine of equitable conversion, which may make the buyer the equitable owner of the property from the time the deal is signed and before the closing date. I'm not sure this will affect the net result, but it should be taken into consideration, as it may.

A quotation from the case of Town & Country Title Services, Inc. v. Martinez (2007) follows:

"This doctrine provides that when a binding executory contract for the sale of real property is entered into, an equitable conversion occurs whereby the buyer is deemed the equitable owner of the property and the seller is deemed the owner of the purchase money, with an equitable lien on the property for the balance of the unpaid purchase price. (Mamula v. McCulloch (1969),275 Cal.App.2d 184.) The seller is regarded as holding the legal title in trust for the buyer, and the buyer is considered the trustee of the purchase money for the benefit of the seller. (Id. at pp. 193, 194.) If the buyer performs all conditions precedent that entitle him under the purchase agreement to a conveyance of the property on a given day, he will be considered the owner of the property on that day, and the seller will be regarded as the owner of the purchase money. (Ibid.) The fact that the seller refuses to perform his part of the purchase agreement and refrains from making the conveyance to which the buyer is entitled on compliance with the provisions of the agreement does not affect the status of the parties or their rights in the property. (Ibid.) When a buyer has performed or offered to perform his covenants, he will be treated in equity as the owner of the property from the time provided in the purchase agreement for conveyance of the property, and the seller will be regarded as merely holding the legal title to the property in trust for the buyer. (Ibid.) Stated more concisely, "[a]n unconditional contract for the sale of land, of which specific performance would be decreed, grants the purchaser equitable title, and equity considers him the owner. I believe California statutes have modified the doctrine of equitable conversion somewhat, but that's not showing up in the cases I looked at and I didn't find it in the books I keep at my desk....... I'll search a bit further and post a second answer if I find anything pertinent.

The bottom line is that the buyer might be responsible for damage to or destruction of the purchased property before closing, particularly if the damage is due to third parties, acts of God, or the passage of time rather than deliberately done by the seller.
