I short sale my house in Long Island, NY in 2010 due to loss of a job. I had 2 mortgages from the same bank at the time. The first morgage forgave the difference in the short sale, however the second mortgage which is a line of credit is still going after the difference. The bank stopped contacting me and have since getting calls and correspondence from collection agencies. But I never responded to any of them not even the original bank because I do not know what to tell them and I don't have the financial capability to pay them back. Can they garnish my salary or put a judgment against my retirement or even freeze my bank account? Should I just wait until they decided to forgive the difference or should I initiate to call them to settle the difference to an amount I can afford? Thanks.

to give you some details of my situation, i was charged with three misdemeanors when i was 17- shoplifting,obstruction,false information to a police officer. in result the judge put me on conditional discharge, 2 year's probation, and $2300.00 in fines. it's been 1 1/2 now, i volunteered for 40 hours community service and completed it because my probation officer was down my back about paying my fines, however that only covered $300.00. he recently set a court date to revoke my conditional discharge for failure to report and failure to pay fines. now i don't want to make excuses i just want to state the facts, soon after going to court, i became pregnant, however i successfully graduated high school and enrolled in college. i was unable to work because i lived in a small town and had to drive 33 miles to get to a city plus i was having complications with my pregnancy and working was definitely something the doctor was against. i can admit i could have tried harder to find rides to the city and my probation office. i contrary i am doing well in college i have a GPA of 3.5 plus i am currently still looking for a job and working on getting a drivers license and car with the help of my mom. i had planned to join the army when i graduated high school, unfortunately i got pregnant however i still would like to join now to be certified in information technology and hopefully get my certifications to be an air traffic controller by the time i turn 25( i am currently 19).my question is what will happens in court? will i lose my additional discharge? might i add my probation officer issued a warrant for my arrest for violation of probation. my mom was able to get me out of jail by paying my fines(1933.00) in full, which means i have paid my fines and completed my community service. will this help when i go to court?

You need a lawyer to go with you to court. Your GPA and future ambitions may be considered by the court, but the fact that you failed to report (it sounds like multiple times) will be the real issue. YOU chose to live live 33 miles from a city and the judge isn't going to excuse anything because you got pregnant (you had time to get pregnant, but didn't have time to go to mandatory probation meetings?!? Your priorities during this time were clearly not in order) Don't go to court alone -- hire a criminal defense lawyer to represent you, which will give you the best chance of a favorable outcome.

If it is recent construction, you could first check with the building permit issued by the city. Ask the building inspector whether there was any question of the placement of the structures.

You could also examine the land itself for monuments or pins sometimes set at the corners of lots. Finding these might allow you to decide if you have an issue.

Ultimately, the only way to answer this is with a survey. You would have to bear the cost, but it may be recoverable if you are ultimately proved correct.

Also, keep in mind that if the structures have been there for at least 15 years, the owner may have a right to keep them there via adverse possession.

I was not paid after I finished a project (Kitchen renovation). I am new in Florida (came from NJ), and I did not know some of the Florida rules and Laws. I have registered my proprietorship in Florida, and thought that it's enough to install a kitchen (I have done it for 20 years withing home depot services, Sears home improvement an other organizations in NJ very successfully). My client was informed about the absence of the special license -contraction license, and he agreed to start the project.

Making the story short, he did not pay me the balance of $ 4500. I applied to the small claim court and also I put a lien on his condo apartment. During the medication the defendant has refused to pay me anything. Even more: he told to a mediator that he did not satisfied with my performance and wants money from me. He has demonstrated photos of the kitchen with removed counter top (?) and other fabricated "damages" and told the mediator, that he will claim a compensation from me.

I read Internet and realized that I made a lot of mistakes in this situation. But the main of them is: without the construction license in Florida I should not tart this project and once I lost payment of $ 4500, I should not put liens and apply to the court.

A few days ago I got a certified letter from the defendant with a request to release a lien on his property since my lien is not justified and it's unlawful.

My questions to you:

1) Is it true, that since I am not licensed for the work I have done, I:

a) will certainly lose the case ( a trial)?

b) does not have rights to place property liens and especially force the law performance against my defendants?

c) Must release liens based on his written request since liens placed by unlicensed worker are unlawful liens.

And the last, but the most important question:

If case of a counter claim (if defendants would start it against me), is it possible by law to place property lien on my condo apartment IF THIS IS THE ONLY APARTMENT I HAVE AND IF THIS IS MY ONLY PLACE TO LIVE?

If you performed work which requires a license, and you are unlicensed, then you should release the liens, chalk it up to your own ignorance, and hope this guy doesn't call the State's Attorney Office to file a complaint for unlicensed contracting. Unlicensed contracting is a crime punishable by fine and/or jail time. Additionally, the state board of professional regulation can come after you administratively, if it becomes known that you were performing work without a contractor's license.

I'm not sure what you mean about "would we be better off with our lawyer." Lawyers are not suited by training or temperament to be real estate managers. If you're not happy with the managing agent and that thought is shared by the other shareholders, you replace him.

Much may depend on whether the managing agent has a contract, who wrote the contract, and what the contract says. If it is a long-term contract written by the sponsor of the coop development that says it is non-cancelable, we can definitely get the contract canceled, and probably more. I would need to see corporate minutes, contracts, and the like.

Remember that you, the shareholders as a group, own the property. As such, you have the right to select your property manager. If that right has been taken away, or appears to have been taken away, you might wish to engage a lawyer to review the situation and help you to develop and implement a plan to take back control.

If there are drug issues, you have several problems, and hiring someone may not be a bad idea, but unless there's a local ordinance or you are part of a homeowners' association normally there is no such requirement. One problem you do have is that if you know of the use of the property for drug trafficking or use, there are criminal sanctions and a neighbor could turn you in. If the place is vacant and is vandalized or burned, you may not be able to make an insurance claim if you knew of these things and the place is vacant (itself a problem for insurance). In the end you may need to weigh the cost of hiring someone if things are that bad, versus some of the things that could happen that are worse.

You can't sell without your husband. You can file an action in Court to force a partition, but you need to be divorced to do that. A property owned by a legally married couple cannot be partition.

As for your parent's life estate, it will be near impossible to sell it. Anyone you sell it to, will have to take it subject to the life estate, which will essentially make any perspective buyer go away.

This is a tricky situation.

First, there is no duty for the landlord to change the locks before a new tenant moves in unless he has knowledge that this is necessary to protect the tenant and his belongings. It is possible that you can show he had this duty, but it will be difficult.

Second, landlords are not liable for the loss of their tenant's personal belongings unless they caused the loss or it can be shown that they knew the loss would be reasonably foreseeable.

Evidence you need:

Proof that there have been previous break ins under the same circumstances.

Get police reports of the previous break ins

Speak to neighbors or the former tenant if you can find them

Now, your problem: contributory negligence. In NC if it is found that you are also negligent, you can't collect against a person who harmed you. Even if your landlord if found to be negligent, if the Court finds you negligent, you can't collect. Your negligence could be that you did not get a key to the back door and did not take steps to secure or otherwise change the locks before.

You need to speak to a landlord tenant attorney in your area.

It may be that you need to file a claim against your renter's insurance. If you don't have any...start shopping for a policy.

I just got an "First time DWI offender BAC .08" 2 days in Houston TX. My record is clean and this is a first time DWI. I also got bailed bond out. My court day sets on May 10.

The problem that I will need to go out of US back to home country in end of May or June cause of my dad is very weak now (as I already had the ticket on May 4 and I can change/ delay to end of May or June but have to go) so I won't able to take any probation or defensive driving class for the moment.

I can try afford to pay the full fine ($1000 - $2000) and loosing my driver license for one year or whatsoever but have to go back home country see my dad for the last time.

This is a difficult decision for you because it will affect you the rest of your life. In fact, if you are not a citizen & decide to seek citizenship in the future, it could affect your application. In addition, there are some countries, such as Canada, that do not allow people with DWI convictions into their countries.

Also, if you were not intoxicated, then you should not plead guilty. If you return here (and you have take a final conviction), then every time an officer runs your license plate (if the car is in your name) or your driver's license, they will see the DWI conviction. If you have been drinking, you are far more likely to go to jail. Your insurance rates will go up & there will be a surcharge on your driver's license.

In addition, Harris County DA's office currently has a police that first offender DWIs get either probation or 30 days in jail and a $750 fine. The only way around that is if the judge is willing to do something for you if you plead without an agreed recommendation. That will depend on the court. (We have 15 misdemeanor courts in Harris County.)

You MUST have a lawyer regardless of whether you want to go to trial or work it out.

A lawyer MIGHT be able to you permission to leave the country for a short period of time if you provide detailed information about your travels.

Bottom line is that you must have a lawyer.

You are not required to register the business in the US. There may be good reasons to do so, but merely selling items to the US does not mean you are conducting business activities in the US. A DBA offers no legal distinction between the person and the business. It is only a "doing business as" moniker. Further, before you start spending any money in support of this business and really I mean the trademark, you should properly clear the mark and file an application with the USPTO. This way you know you are not investing in a problem.

Whenever you endeavor into investing in a trademark it is very important that you conduct the proper clearance due diligence upfront and before you start spending any money in support of it or submit an application to the USPTO. In the US, this means searching under both federal (USPTO) as well as common law because trademark rights stem from use in this country NOT registration. Indeed, the law would prefer that contracts NOT outline penalties and forfeitures. Penalties and forfeitures are properly the province of a court of law, not the contracting parties. Sure, many contracts do provide penalties for breach, but courts may not enforce them, and if they do, it is because they are more in the nature of a reasonable pre-estimate of damages rather than true penalties or forfeitures.

In your case, you readily admit breaching the contract by departing without giving two weeks' prior notice. Under the circumstances, you are liable for the boarding establishment's actual loss of income, up to two weeks worth, but it has a 'duty' to make reasonable efforts to hold those losses to a minimum by trying to re-rent the space to another boarder, or by equivalent means.

I recommend trying to keep this out of Small Claims Court and negotiating a realistic but small cash settlement, such as you pay them for one week, but you get your tack back.

Your case would have to be reviewed. I am uncertain what you mean when you say the father forfeited all parental rights. Were his rights terminated by a Court? Or were custody and parenting time rights never established? There is a big difference.

Ultimately, if the biological father will agree, you may proceed with an action to terminate parental rights and proceed with a Step Parent adoption.

Sounds like you bought the place and the fence was already there. Most local ordinances require that when you have a fence installed, the "good side" must face your neighbor. What that means is this: are the fence posts on YOUR side of the fence? If they are, this is more likely your fence (it may also show up that way on the survey you should have gotten when you bought the place). If the fence posts are hidden and on your neighbor's side of the fence, the fence is most likely your neighbor's. SOME fences have "2" good sides where the actual fence panels are mounted between the posts. Then there's NO way to tell whose fence it is and you might have to talk to your neighbor about when it was put up and who did put it up. Once you know whose fence it is, then you can tackle the "altar" question. If it's your fence, this is a trespass unless your fence is actually OVER your property line onto your neighbor's (check your survey) in which case you and your neighbor have something to "work out" because your neighbor could also make you MOVE your fence to your property line (you may think it's on your property but it is possible between your survey and your neighbor's it could show up elsewhere!!!! If it is your neighbor's, well, let your neighbor destroy his own fence. Real estate can be a lot of detective work when all you have to go on is what is "visible." Good luck.

Is the car owned free and clear? If so, what is it worth? You will have to get him to sign the title over to you. Depending on the value of the car, you may have to pay him for his share of the car.

If the car is still financed, you will need to approach the lender. You can either get the car refinanced somewhere else, but he will still need to sign the title once you get it, or you can see what can be done with the current lender. They are not likely to release him and title the car just in your name absent payment of some kind.

Most people form LLCs these days instead of S-Corps. The governance formalities for an LLC are simpler than for an S-Corp. You say pass-thru taxation does not matter, but I would check with a tax accountant before making that determination. I would say as to #1, if the back tax is for something pretty basic like failure to pay business license fees, there is no public record and little likelihood of anyone accessing it under a freedom of information type law. If the city had to sue you, or place a lien, that would be a different matter. As to #2, again, if it's just failure to get a business license and pay the fee, no big deal. Even county property taxes may not raise many eyebrows. Unpaid taxes become a big deal when there is a lien, foreclosure, or some administrative or court proceeding.
