Question

Once a complaint has been filed in Family Court by a party, can that party cancel that complaint if it was for a hearing for temporary relief in the case of child custody? The mother and I want to work this out without lawyers, which we have found to be possible.



Answer

You can dismiss the case altogether if you want to do so, or you can continue the temporary hearing - which will postpone it until you reschedule it. Working it out without attorneys might sound like a good idea, but if you don't know what options are available to you, how the Court would decide certain issues, and what the law allows/requires, I question whether you are doing yourself any favors. If you hire the "right" attorney, he will be able to help you work toward the best agreement possible.
