have outstanding collections on my credit that are not yet judgments due to medical problems.

My fiance is going to buy a house here in NC that is owned by my daughter and her husband, who recently divorced. THEY actually live in a foreign country where he is stationed with the military.

HER husband's credit was used to qualify for the mortgage at the time of purchase, and the plan is that he will sign a quitclaim but it won't be registered until right before my fiance goes to close on the purchase of said house.

Presumably the current outstanding mortgage couldn't be called in BEFORE the NEW sale is completed due to my daughter's insufficient income to qualify to maintain the mortgage after her husband's name is registered as OFF the deed for the short period before the house is sold to my fiance.

Is this possible without it getting into some huge complex situation? I've been trying to figure out a way that my bad credit will not affect my husband to be adversely before I get a job and negotiate settlement or --worst case scenario--have to file bankruptcy.

Since you are not married, nothing can be in your name, because if you don't have judgments, you may. And even if you don't, mortgage lenders are not going to lend to you with outstanding credit issues.

I don't understand what you are asking. Daughter and her ex-husband own the house. Why does son-in-law have to sign a quitclaim deed? Why not just give your daughter power of attorney to sign for him? Why is this an issue with the mortgage lender?? They sell the house to your fiance, the mortgage gets satisfied out of the proceeds of the sale, the deed is put in your fiance's name and he gets his own mortgage or pays cash. What is the problem here?

If you are not married yet how can this person be a husband? If you are seriously thinking about bankruptcy, then file it BEFORE you get married. Once you are married, then you can add your name to the deed so that the home will be owned as a tenancy by the entireties (husband and wife).

The short answer is "no." There is a lot of law about what constitutes the same cause of action, mostly in cases involving an amended complaint after a statute of limitations may have run. But in your case there's no need to go into all that, because it can never be the same cause of action when each person is the plaintiff on one claim and the defendant on the other.

My suggestion would be to avoid Florida companies and have them immediately resell the home to you on an installment basis. Using a land trust initially may also be helpful. This is very cursory advice and an attorney should review things more specifically. No matter how you look at it, your grandparents are going to have an asset, whether it is limited equity in real estate with rental income or contract payments due them from you. The questions include whether they would discover it easily and whether it would be worth trying to collect from it. Another thought, although I am not very familiar, would be to use an IRA for ownership.

I would consult with a Florida attorney. There are at a minimum three areas of concern that jump out at me, and likely more more:

1. My understanding of Florida homestead is that they can not exempt it from judgments since it will not be their personal residence. Putting it into a trust makes no difference.

2. Any transaction that attempts to put you in title to the house (installment sale or otherwise) using their money as part of the purchase price could be considered a "fraudulent conveyance" and undone by the courts. Putting the house into a trust could be considered evidence of the intent to hide it.

3. If either of your grandparents wind up needing public assistance within the 5 years after any kind of transfer that amounts to a gift, the State could come in and undo it too.

Hope this is enough to motivate you to see a real estate/estate planning attorney.

I discovered at the Registrar of Deeds there is a Mortgage as of May of this year, listing my 2 siblings as lenders, and the executor sibling had signed for the Estate of my Mom who was deceased several months earlier. The amount was for approx. amount that I had offered the siblings to buyout their shares. I did not go through with the buyout because we could not agree on concessions for repairs on the property or selling price. Is this lien on the Estate without my knowledge of, or approval of the amount, considered illegal and it did not go through the Probate Court ? Presently there is a Buyer that has a contract to purchase. Does this mortgage present an encumbrance which Title Co. would not approve sale, nor will Probate Court approve, and they also need my Signature as a heir-beneficiary. I would like to stop this sale, and renegotiate for my buyout, and go to Probate Court as needed.

The Executor has the power to do almost anything that your mother could have done. She would have had the power to lend money and sign a mortgage to guarantee its repayment. She would also have the power to sell the property to whomever she would want to, no matter what the price. That is one of the things, however, that the Executor cannot do. The Executor is required to do what is in the best interest of all of the siblings, meaning that he/she must sell for the highest and best price.

With all of that being said, the house cannot be sold without your siblings releasing their mortgage and being repaid. I would assume that would occur at the time of the closing of title. Your signature is not required to sell the house; it is required to settle the estate, but the house would likely be sold at that time and you would then not be able to get it. It is therefore in your best interest to immediately seek the advice of an attorney to see what can be done.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion.
