We are currently renting a town home in New hanover Co. North Carolina on a month to month lease. There is a foreclosure hearing scheduled for the property in January 2014. My question is how long does the bank have to give you to move? I read it was 90 days, but need to know for sure.



Answer

This is partially true. If you have notice of the foreclosure, you need to get in contact with the foreclosure attorneys and tell them that you are a tenant. In that case, you are entitled to live out the remainder of your lease, or 90 days whichever is longer...which is 90 days in your case. But you need to make sure they know you are a tenant. Be prepared to present a lease or other proof of your tenancy such as cancelled checks or other proof of rent payments.
