There are legal limits on how long an employer can have an unpaid intern or volunteer, if the employer is not a non-profit, before at least minimum wage must be paid. Those limits are, however, to protect arms length employees from being abused. The only person who can enforce those laws are the employee. So unless you file a wage claim, the law is irrelevant. Of course if she wants to totally protect herself, she can pay you minimum wage.

First of all, in all likelihood the chambers conference with your son was not recorded, as it is not considered to be formal testimony. You can have a subpoena served on your ex as your son's custodian by a private process server, and if she disregards it you can complain to the judge who can order her to bring him in.

I see that FL law states the policy holder is responsible however I'm finding it difficult to believe/understand how this guy can hit us, be at fault, and WE have to pay this money out of pocket when he should be responsible. You have a claim for the deductible for your property damage and for your reasonable rental replacement. The problem is you cannot make a continuing claim against some insurance company in order to get these items paid immediately as they are incurred. Often you have to expend the money and then seek reimbursement. This is the reason that having coverage on your own for rental replacement and lower deductibles make recovering from an accident easier. Go ahead and notify the responsible owner and the insurance company if you know it of the pending claim. They will assign an adjuster and likely will give you directions on getting the car appraised for repairs. They may even work out the rental replacement with you. Subrogation is not something that helps you, it is the right of your insurance company to pursue the other driver for the recovery of amounts expended on your behalf. they will seek recovery of any deductibles as well, but not for items not covered by your own insurance.

The advice from Barry is very solid. I will add a little more information to the situation. You have 5 kids and a preganant wife. Florida PIP law changed on July 1st. If you haven't already, I would suggest having your entire family "checked out" by a doctor to make sure everyone is alright. If you wait longer than 14 days, according to the change in the law, you are waiving your benefits under PIP. If you or anyone in your family needs additional treatment the PIP coverage provides a great benefit to you and your family. It is required under Florida law and you have been paying for it for years. If you need it, use it.

This may also be a great time to evaluate your insurance coverage and to make sure your auto coverage is protecting your family. The most important coverage to have is uninsured motorist coverage. It is worth every penny to know you are protecting yourselves in the event another driver does not have the proper insurance. I would be happy to discuss this with you.

Both answers are good advice. $1,000 for the future may be too high. You can purchase deductibles of $500 or $250 for a little more premium. Be sure you are all checked out by a doctor within 14 days. Also, if the repairs to your car are extensive you may have a claim for "dimunition of value" if your car is devalued for a later trade in.

If tour company pays for the repairs you can bring a suit in small claims court for your dedictible,loss of use, towing, storage etc. These things take time to resolve. I was driving near a construction zone and after I passed it I hit a piece of cement in the middle of the roadway. I filed a claim to get my money back from my repairs because of this incident. I later recieved a letter for the City of Rockford saying I had been denied. The letter said the City of Rockford was not liable for my dameges because they had no prior notice of the cement, and they stated that state law requires prior notification. I feel the damages were due to the City not cleaning up the construction zone, also how could I notify them prior to my incident? I didn't know the cement was there until I hit it.

What that means is that the City did not have prior notice that the cement was in the street. The law does not require that they constantly patrol the streets looking for problems. If you could prove that a street department truck had passed the cement or that a policeman had reported the problem, you might have a chance of winning. For example, if a banana peel is dropped, or if the floor of a grocery store is wet,the owner of the property is given a certain amount of time to correct the problem before they are liable for damages.

To win in this case you would have to prove that the cement was in the street an "unreasonable" amount of time, Generally, this would be determined by what judges have considered reasonable in the past. Of course, you would have to prove how long the cement had been in the street to win.

Because it was near a construction site, there would be a strong presumption that the cement was there only a short time. You might have a claim against the construction company - if you could prove that they knew, or should have known, that the cement was in the street because of them you might have a claim against them.

You can consult an attorney if you want, but proving a case like this is very hard. (Hard equals expensive) Still, you never know.

I am the executor for my mothers estate, total assets under 600K. The estate has been open since February 2014 and all assets are gathered in an estate bank account except for about 40K from a 401K account. I would like to wait until 2015 to liquidate the 401K to reduce tax implications.

1) Is it proper to partially distribute the majority of the estate to beneficiaries (my sister and me and our children) leaving a reserve for year end-taxes, then the remainder whn the estate closes?

2) What will I need to do to formally close the estate?

(2) Usually all that is needed are Release and Refunding Bonds by which the beneficiaries acknowledge they have received their entire distribution. These get filed with the Surrogate to close the estate.

Since you are making a partial and a final distribution, I usually obtain 2 R&RBs; - one for the partial and one for the final distribution.

This may run a few dollars more in recording fees, but it assures everyone that things are going as planned and that a final distribution will occur. Plus, it assures you that everyone will sign off that they have gotten what there are entitled to.

Well I was taken out so suddenly that the only things I had were the clothes on back, and now I've been home for a few months, and my father refuses to send me ANY of my things, because apprently it's my fault I left. If you are talking about clothing, books, personal items, etc. that are indisputably yours and were purchased for you, these items are your property *versus a car that your father had perhaps bought for you to use, for example). Your father refusing to return them to you shows what a deadbeat he is, as he obviously has no use for the items and it is only hurting you by him not giving them to you. Children do have rights - obviously - and please know that your removal from his custody was not your fault, regardless of what your father says. Unless there were false allegations, then how could it be your fault? for exercising your right not to be abused or be forced to live in unsafe conditions? of course not - everyone has that right and should definitely exercise it.

if the court or the entity that handled the change in custody did not find merit in the abuse allegations, you would not have been removed. Since he is in a different state, I'd suggest that your mother contact the agency or court that handled the change in custody (the removal and transfer of you to your mom), and ask them for assistance in obtaining your items. What they can do, if anything, I have no idea since this is another state and I don't know all of the facts of your situation and who handled the removal & change of custody. However, even if this particular agency can't help you, they may be able to send you to someone who can, and it may be as simple as contacting the local police agency and requesting a peace officer go retrieve the items. Whether they will do it or not, again, depends on the local police agency and whether they have the time or resources to do this. However, if your mom contacted them, explained the situation, she could ask if they would assist her if she was there personally - like escort her to the house to take your items. Having a court order in place prior to this would help, but the police may be able to assist you without a formal court order, especially since we are talking about a child's items and anyone can tell the difference between what is yours and what belongs to your father (for example, it's different than when two adults have this problem and are fighting over furniture, dishes, lamps, animals, etc).

If the change in custody was handled through the court, then they certainly have jurisdiction and authority to order that your property be returned to you.

If your dad blames you or is otherwise uncaring toward you, then don't speak to him over the telephone - you don't need to hear those lies. Try sending him a letter asking for the items. If that doesn't work and you want to avoid the costs of having to travel out there (or like if the police tell you they can't help you at all), send me an email directly so I can get more information, and I'll send your dad a letter demanding the items - sometimes a letter from a lawyer does the trick. I'll do the letter for free - don't worry about it.

You appear to be confusing your traffic citation case with the civil accident damage reimbursement claim which is apparently being threatened by the insurance company of the opposing vehicle. At least in WI, these two matters would go through different court systems separately. Different outcomes in each of these cases are a fairly common occurrence and is allowed by law. Proof in civil damage cases does not have to be "beyond a reasonable doubt," but rather only by a preponderance of the evidence, at least in WI. In the majority of civil court cases, no court appearance is ever required by either you or the opposing insurance company, if you default by failing to file a timely answer to their complaint in court. If you are serious about fighting this claim, you need to immediately retain an experienced IL civil litigation attorney. The fact that both of these claims involve the same events often leads to confusion in such matters, and, just to add to the confusion there are occasionally areas where one can affect the other. Default judgments against either side, however, are not one of them. Rather, when certain issues are fully litigated in a trial with sworn testimony, findings in one case can occasionally have a preclusive effect in determining issues in the other, but this is rare. The other possibility is that in criminal prosecutions, judges can order restitution, which might have some similarities to the insurer's reimbursement claim. I assume that the court appearance you had related to your getting a citation(s) in Illinois for either not having insurance and/or doing something that violated an ordinance or statute, resulting in the vehicle collision. It sounds as though the case involving the ticket(s) was dismissed because the governmental agency that gave your the citation(s) failed to appear, therefore, they could not prove their case against you. You have not described how the accident happened, therefore, it is difficult to know if you were at fault or not. It would appear that the insurance company for the other vehicle may have paid for property damage or other items for that vehicle and/or driver, and now they are making a claim against you for reimbursement. If there is a reasonable belief that you were at fault, you may wish to contact them and attempt to work out payment arrangements with them. The Power of Attorney only allows her to act for her father when he is unavailable to do something himself and only to do something that he would supposedly agree to. It is actually fairly limited in what it can be used for. If he is mentally incompetent, then the POA is not effective. If he is mentally competent and on good terms with your mother, she should ask him to revoke the daughter's POA because she refuses to co-operate. If he will not, tell the daughter that unless you see the POA you have to assume that it is not binding or non-existant and you will not accept its use.

He cannot sign away his rights unless another man is willing to adopt the child with you. Parental rights cannot be surrendered because parental responsibilities cannot be abandoned, and they go together. He can give you sole legal and physical custody, but he cannot give up the right to go back and try to get some or even primary custody at a later date if circumstances change. As for support, you actually get more support the more you have the child. The idea is that each parent pays their share for the child. They are presumed to be paying it when the child is with them and they owe it to the other parent when the other parent has the child. So if he has zero custodial time he will owe the maximum support.

In april 2012, I was arrested for driving under the influence of marijuana, my charge was "No-Test Drug DUI". I was later arrested on April 2013 for driving on a restricted licence, arresting charges were "Driving on a restricted licence & VUCSA (Violation Under the Controlled Substance Act) for possession". I was released and told by the King County jail that I was not being charged, however, the arresting charges can still be viewed on the King County website.

I live in King County, Washington. Will my VUCSA arrest show up in a pre-employment background check? Will those disqualify me from employment given the nature of the offense? How long will it take for those to drop off my record?

They will never 'drop' off your record, but you will be eligible to make a court motion to vacate them once enough time has passed. Search for a lawyer who practices in that court, who can tell you how long you have to wait and what you have to do. I can't tell from your email what conviction appears on your record, and that is the issue.

On the drug arrest, if no charges were ever filed (and they might still be), then there is a way to petition the WSP to erase "non-conviction data". That could possibly clear the arrest off your history.

During a meeting with a lawyer a friend of mine was left questioning the roll a paralegal played. I know that a paralegal has to be supervised and she was most of the time. While discussing the details of the will the paralegal sat in to take notes, the lawyer had to leave and left the paralegal to gather the rest of the information from the client. This leads me to my first question, is that not the unauthorized practice of law (being that there was no lawyer present). The paralegal also suggested a type of will that she (my friend) might think about having. Is this legal?

A paralegal should not be drafting wills or other documents without review by the attorney. Nor should the paralegal be representing people in court or giving legal advice. That said, I see nothing wrong with leaving the paralegal to gather basic information from the client about the client's estate plan.

With regard to recommending a will, I cannot jump to conclusions as I was not present. I do not know if the paralegal in fact made such a recommendation or if the paralegal was simply stating something along the lines of "based on the information you provided, you might want to ask the lawyer about a _____ will."

However, your statement makes no sense. There is only one kind of will. For people who have trusts prepared, there is a special will called a pourover will, but it is still a will. It just directs assets to be "poured over" into a trust instead of being distributed outright to the beneficiaries. The only other distinctions I know of are where the will directs that a special needs or other type of testamentary trust be created. However, this is still the same type of will and only the directions for how the assets are to be distributed differ.

Unless you are the client, that is between the client and the lawyer. If the client has concerns, she should raise them with the attorney, not you.

Its too soon. Most estates take 1-2 years. The executors may not necessarily be dragging this out. The executor cannot make a distribution of any assets because it would be at risk if there are outstanding claims. The executor also has to get approval from the tax authorities. Final taxes are not due to be filed until 4/15 with the IRS/PA Dept. of Revenue and there are also inheritance tax returns.

And you father only died in September! You do not indicate when the estate was opened and the executor appointed etc. The executor has 90 days to file an inventory of assets. Accountings get filed after 1 year and annually after that. If the estate will take longer than a year, they have to file status reports. Beneficiaries have to be give notice.

So what is the hurry? If, after review of the inventory or accountings, or if the executor is acting contrary to what was stated in the will or just not doing his/her job and something is not right, then consult with your own probate attorney who practices in the county/state where the estate has been probated. An executor can be removed if not acting properly. Also, if you disagree with an accounting, you will be given an opportunity to object to it.

If I were you, I would pay the past-due bills, such as the car payment, and then file a separate motion asking the court to allow you to deduct what you paid from future spousal maintenance payments. Thus if the car payment is $400 per month (as an example), I would pay that amount, file the motion, and asked the court to allow you to automatically make these payments and automatically deducted the corresponding amount from the spousal maintenance that you pay her.

Thus, if at the time of the hearing on the motion, you have paid four months of the car payment you would deduct $1,600 from the next $1,900 spousal maintenance payment, and then in each subsequent month that the payment is not made on time or by the due date, you can then make it before it turns up as a late charge on your credit report, and deducted $400 from the following month's $1,900 spousal maintenance payment.

It seems to me that if you are paying $1,900 a month in spousal maintenance, you can probably afford counsel to help you in this case. You would be wise to do so if you can afford counsel. Just making a motion to ask for what I've laid out above may not be enough. I suggest (if you do not already have an attorney), that you consult with local counsel near you to get an idea of fees and to get a feel for a particular attorney to see if you are comfortable. Don't just settle for the first person you talked to, and don't go purely based on the hourly rate. You need to make sure that you have a good feeling about the attorney you are going to work with. The best situation is if you could get a referral to somebody from a friend or family member who has used them before.

My son is gifted and extremely mature for his age (nearly 7), both academically and intelectually, and a private school environment would be most academically and behaviorally appropriate for his needs and abilities. Though my son's father is a successful highly educated executive who can more than afford to pay for private school, he fundamentally rejects any notion that our son "needs a private school". Both of his adopted children from his current marriage (ages 19 and 15) have been provided private school educations by him since Kindergarten and his youngest is presently attending a fancy prep school so clearly it is not a matter of rejecting the value of a private eucation or not being financially able to pay. I know that the main two motivators in not supporting what he surely realizes would be best for our son comes from a resentful edict from his wife and a protective irrational desire on his part that our child not outshine his other two children, who are troubled students and never without problems but what has that got to do with my child's potential? Also, even though my daughter doesn't live with me, I am on the hook for medical insurance, college, in addition to child support. If you hire an attorney in that County or an adjoining County that does primarily domestic relations law, the fact that your ex is a probation officer or whatever should have absolutely no effect on the representation. A modification has to be filed in the court where it was originally heard unless the child has moved out of state for more than 6 months. If the child and the mother are no longer in the county where the divorce was heard, you can move for a change to the county where the child is or where you are. Most likely a court will move it to where the child is. You should retain local attorney for this. Keep checking with the attorneys as not all attorneys interact with parole officers.
