Your question is really confusing. Basically, if your husband had anything before the marriage it is his alone. If he inherits anything during the marriage, no matter whether there are kids or not,it is his property. Those are the basics. Details always affect the basics. A person's child is the first to inherit from his parent as long as there is no will disinheriting them or they did anything to the parent that would disinherit them.

This might also be something the abuser uses to get the Injunction dismissed. However there is no such thing as a reciprocal Injunction and you as the Petitioner cannot violate the Injunction just by going to a family members home where the abuser also lives

on may 25th i gave 30days notice, on this day she brought over an amended reagreement changing my month to month to a yearly lease. i gave her notice prior to her handing that to me, and she accepted the 30 day notice. i moved my trailer on june 15th 2011 and cleaned my space, the manager came over and took pictyres said everything was great and that i would recieve my balance of $1533 (45 deposit & 1083 rent balance) in 21 days. to day, day 21 she sent me an email letter, unsigned and not on letter head and no name on the page anywhere, said it was from the owners, it said they were keeping 1000 for having me give up the space since i implied i'd be there and that was a breach of contract, they were going to charge me 300 a month for every month the space sent empty and charge me for the advertising of said space. is any of this even legal and how do i go about getting my deposit and rental money back

It does not appear there was ever a valid year long rental agreement. As long as it was a month to month lease you had to give only 30 days notice. Even if you did imply you would stay longer, that is not sufficient to renew the tenancy. They can not keep more than the rent up to 6/23 and have to refund you the rest as you do not owe any additional rent.

You probably need a sharp letter from an attorney to scare them into believing you would file suit against them, seeking twice the amount with held and your damages of attorney fees, etc. I charge $100 per hour for that type of work.

You are a plaintiff in pro per. Whoop-ti-do. You can amend your complaint, but if you don't know what you're doing, and it sounds like you don't, their next demurrer will be sustained without leave to amend, you'll lose the case, and if you're like most pro pers you'll go away whining about the unfairness of it all.

That sounds highly unusual. A contingency fee agreement with an attorney must be in writing. An oral agreement is insufficient. The attorney who fails to get a written contingency fee agreement with the client is limited to recovery for the reasonable value of his or her services. You mention signing an agreement, but I assume that was the settlement agreement with the other side.

My situation is confusing. I have a PFA on my husband and the PFA gave me custody of my stepson who is 5 and my biological son who is 1. My stepsons mother hasnt seen him in 2 years and I was wondering if I would be able to take her to have her rights terminated. Another question I have is how long do I have to wait before I can file to have their fathers rights terminated since I have a PFA. You don't say what form the business is (corporation, llc, proprietorship) and if you have been operating in New Hampshire. If you are doing business as a separate legal entity (corporation, llc, etc), you must observe the formalities of that separate legal entity, and they are other possible consequences or issues to look out for, ie. taxation, operations, others involved in the business, and more. You should consult with an attorney at once.

Replace all rubber bushings, install new shocks, replace all worn hardware (bolts, washers, etc and probably a good idea on a 30+ year old car anyway) most noticable difference will come from installing a new set of coil springs. Be careful when ordering springs, most "performance" springs will actually make the car sit lower than the factory height, thereby completly defeating the end result you desire, there should be a few places where you can still get the original factory springs or exact reproductions. There are a number of possible issues here. First of all, if you had a chance to inspect the truck and/or purchased it "as is", you may not have recourse. If they do owe for the repair, they have to be given the opportunity to remedy the situation. Only if they do not do right by you would you have the possible option of demanding a refund and return of your original truck. But this all has to be done properly and correctly, so have an attorney help you---don't try to be a do-it-youselfer.

I understand every school has rules but if the information was shared do to the information sharing then they are using this information wrongly. The probation Officer told her that after the class it was over done nothing would happen because she was very scared. The liason Officer shared this information with people who have no good reason to have it and she was told she was suspended in front of 2 other children.

This is a child who has a IEP because she is dylexic she is in her freshmen year and she has a 3.5 grade point average.

You haven't said whether the information shared-whatever it was-was part of her permanent record which is what chapter 280 covers-was a basis for a disciplinary action. In any event I do not see that there is a cause of action attached to this chapter of the code as it is an administrative setup.

Yes, the State usually tries to recover Medicaid funds, and may very well have a claim against your brother's estate. You would need to get all of the facts and then determine whether Medicaid has a valid claim at this time, how much that claim is, how much money is in the bank account, and whether it will be worth it to go after the bank account. You would want to determine if any other assets need to be probated, or whether you could use an Affidavit of Heirship or a Small Estate Proceeding to avoid filing for a full-blown probate.

Power of attorney is for people who are living only. It ends at death so if you are an agent under a valid power of attorney, your only duties will be to provide a final accounting and turn over any property to the personal representative of the estate.

If you would be the personal representative, then your duty would be to figure out what the deceased person owmed and owed, pay any just debts and deliver what is left to the beneficiaries. The personal representative would not be personally liable for lot rent.

However, the lot rent would have to be paid from the estate assets of the deceased. If she did not have any funds at the time of her death to pay the lot rent, the personal representative could do a couple of things: (1) make a deal with the owner of the mobile home park to pay lot rent out of the proceeds of the sale of the mobile home; (2) figure out who the beneficiary would be and if the beneficiary wants the mobile home, make arrangements to make an early distribution of the mobile home to the beneficiary such that the lot rent would now be the beneficiary's responsibility; or (3) get the beneficiaries' to give enough money to the estate to enable it to pay any bills with the understanding that they would be re-paid as creditors when the mobile home is sold.

Which of these options would work depends on the circumstances and whether there is enough money in the estate and whether the beneficiaries could afford to chip in.

Hello...Question for you Guru's! I apologize in advance if it gets to wordy. A boyfriend and girlfriend sharing a residence for 6 years get into an arguement, the girls moves into the guest bedroom. They continue to argue, so she decides to get a few things and leave. The guy goes into the guest bedroom locking the door behind him. So now he's in the room with her purse, keys, clothes, laptop, etc...the door is locked and he is refusing to unlock it. After asking him repeatedly to unlock the door so she can get her things, she decides to break the bedroom door down with a hammer. However, before she began her unsuccessful attempt, she gave him the choice...unlock the door so she can get her things or get prepared for her to break the door down...seems fair to me. As you guessed, he chose the latter. After several holes were put in the door she gives up, puts the hammer back in the garage, goes into the master bedroom to calm down and wait for him to come out. A few moments later a police officer walks in, tells her to stand up, put her hands behind her back, cuffs her and carts her off to jail refusing to even tell her why she is being arrested. After spending almost 24 hours in jail and still unaware of what she is charged with she sees the Judge who reads her her rights, then her charge...terroristic threat with a deadly weapon and ends with slapping her with a 90-day protective order which prevents her from going anywhere near her home. Is it me or is this insane? This was her home, her door and her hammer...if she wants to destroy her own property in order to gain access to, again, her property, shouldn't that be her call? May be a stupid call, but nonetheless her call. Even the boyfriend was shocked when he heard the charge! Is this right? Can she get this dropped? If so, how? If not, what punishment can be expected? Your advice and opinions are very much needed and please know that they will also be very much appreciated. Oh, and the arguement that started this chaos...it's been long forgotten!

First - boyfriend may be acting shocked but he is not that shocked since his story is what got her arrested in the first place. . . . The police didn't just come in and come up with a story - it came from somewhere (and even if a neighbor called, they didn't know about the hammer.)

Second - she is not charged with damaging the door - that would be criminal mischief. She is charged with threatening the boyfriend although it can be that the threat was via damaging the door. Here is the relevant portions of the statute:

Sec. 22.07. TERRORISTIC THREAT. (a) A person commits an offense if he threatens to commit any offense involving violence to any person or property with intent to: (2) place any person in fear of imminent serious bodily injury; (c) An offense under Subsection (a)(2) is a Class B misdemeanor, except that the offense is a Class A misdemeanor if the offense:(1) is committed against a member of the person's family or household or otherwise constitutes family violence; (f) In this section: (1) "Family" has the meaning assigned by Section 71.003, Family Code.(2) "Family violence" has the meaning assigned by Section 71.004, Family Code .(3) "Household" has the meaning assigned by Section 71.005, Family Code.

So, she is accused of a serious Class A misdmeanor which carries up to 1 year in jail & up to a $4,000 fine as the maximum punishment. One reason it is serious is because if she is convicted, if she is ever charged with family assault in the future, it is automatically a felony.

Even if the bf wants to drop the case, it is not his decision. It will be up to the prosecutor. However, it sounds like she has a good defense in that she was attempting to protect her property which she reasonably expected would be damaged.

She really needs a good lawyer. And, BTW, the protective order can be dropped at the request of the bf to the magistrate who signed it. Her lawyer can help make that happen.

The answer, in a nutshell, is no. It is not legal. If you filed in the 2nd judicial district court you and he were issued a temporary domestic order. The temporary domestic order probably prohibits the taking of the bank account that you describe. If you are representing yourself pro se then you need to file a motion called "motion for order to show cause" and you attach with it a document called "order to show cause" and court will sign the order to show cause directing him to appear at a hearing (you go to) and he has to tell the court why he took the bank account and why he should not be punished for doing that. If you are representing yourself go to the self help center and ask if they have a "show cause" packet. I would suspect that they will and that should get you to where you need to be on this matter. The self help center at the court house can tell you what you have to allege in the motion for order to show cause but they cannot tell you specifically. So, you will end up writing the specifics yourself. It will say something like: (1) this court issued a temporary domestic order; (2) the TDO restrained both parties from taking over any of bank accounts and preventing the other party access to the bank account; (3) I found out from the bank that husband took over the bank account . (4) now I do not have access to the bank account. (5) this court should order husband to appear and demonstrate to the court why he should not be held in contempt of court. (6) husband should be held in contempt of court; wherefore, this party (thats you) prays that this court order him to appear and find him in contempt of court and order that he turn the band account over to joint control and that he does not take any money out without strict direction from this court or by stipulated order; last the court should order him to repay the community any funds he has taken and spent. then you sign it and file it and get it served.

First, you need to consult with a family law attorney as soon as possible. You need to file a response to the TRO (you do not state who filed it). You will also need to contact CPS and determine whether your daughter has (a) simply been placed in her paternal grandparents' care or (b) if she has been made a ward of the juvenile court.

In either event, you as the biological father should be allowed to petition for custody and visitation rights. A couple of things to consider: (a) where are you with respect to any child support payments; (b) are you in a position to house and actually care for your daughter (i.e. do you have your own home or apartment, do you have any unresolved issues with drugs or alcohol or your own mental health issues, etc.); (c) are you prepared to engage in a supervised reunification process?

Since the child is in the care of your parents, provided you have a positive relationship with them, you should be able to at least establish an informal visitation arrangement which with time may result in full custody, Unfortunately there is no way to fully advise you without your meeting with a family law attorney and providing them with solid answers to the questions I have identified in this response.

Your statement does not mention, however, whether a lawsuit has been filed against your husband. Executing on a judgment is how they could come after your husband's income. I am not familiar with the provisions of the SRA... However if you file a Ch. 7 it would make that debt and all other unsecured debts (even if lawsuit filed) go away permanently. About a year ago I moved into an apartment, and began paying the landlord on the first of the month. I never signed a lease agreement, but had asked the landlord numerous times to please write one up. This never got done. A few months ago, he moved the dumpster that was outside off of the property, which left us nowhere to put our trash. When I contacted the landlord, he told me to call the town to try to get a trash sticker. I called the town of Middleton, and they then informed me that they could not give me a trash sticker because the place I was living was not registered as a rental, and it was only a single family home. It is currently I, and one other family living there. The city then told me that my landlord was in some trouble with the town, and they suggest that I stop paying the landlord till all of my issues were fixed because my landlord was illegally renting the building out, and it was not up to code. My issues include a leaky shower, broken floor tiles, no second means of egress, and no place to put my trash. So over the past 3 months I have been withholding rent, and letting my landlord know that I was not going to pay till my issues were fixed, and also that I knew that the building was not a rental. Two days ago, I got a letter taped to my door starting the process to evict me. In this letter it states something about non payment of rent. When I asked my landlord this, he told me it was a formality for the town because they told him he can no longer have rentals. The letter is asking me to be out by December 31st. I was wondering if anyone had any insight on this, and would like to know if my landlord has a case. I am nervous he is trying to be sneaky about something and not letting me know, and I feel that I am not in the wrong.

In agreement with the previous post, I must say that anytime someone runs into a parked (non-mobile) vehicle or object, the moving vehicle is obviously at fault. This is what steering wheels are made for. Keep in mind that, as the previous post mentioned that while it is illegal in most states to not have insurance on a licensed vehicle, this varies from state to state, so check with your legal counsel. Also, you did not state whether the accident occurred on private property, which in most states would preclude you from generating a police report (in lieu of injuries, driving under the influence, hit and run or reckless operation [again in most states]), therefore this may add some problem in getting insurance involved. Aside from who is at fault here, it could get tricky, so check with your attorney. As a 'good' neighbor, your neighbor should just pay for the damages and get over it. In Criminal Law, the Prosecutor is asserting the State's right to enforce its power over the Accused. A crime is an affront to all citizens and not just the specific victim of the crime. In Civil Lawsuits, the Plaintiff is a citizen asserting his or her rights over the Defendant, another citizen, and the State is merely the judge deciding how to balance both citizen's claims. Our taxes pay for the Prosecutor to protect our rights against criminals, but either the loser or both parties end up paying the bill for court costs in a Civil suit.

There are also different standards of proof required in Criminal and Civil lawsuits. In general, Criminal cases must be proven "beyond a reasonable doubt" whereas Civil torts must be proven by a "preponderance of the evidence" (aka "just slightly more likely it happened than it didn't). On top of that, the evidence allowed in a Criminal case must meet a much more strict standard than what would be allowable in a Civil lawsuit.

There are also differences in the standards that must be met for a crime versus it's civil counterpart, i.e. Civil Negligence may be deemed as failing to follow the normal standards of society whereas Criminal Negligence may require a reckless disregard for normal standards of society.

No, even poor people can get divorced. There is even a petition that they can file with the court to have the filing fees waived if they cannot afford it. North Carolina requires that one of you must have lived here 6 months and that you be separated (living separate and apart) from your spouse fro a period of one year.

If you qualify, contact Legal Aid. If you earn too much for legal aid, then Wake County has a self-serve center so that you can do your own divorce. They also provide some limited legal services. I don't know if you are actually in Wake or Johnston County. If you are in Johnston, then you should contact the clerk of the Johnston County court to see if they have a pro-se divorce kit.

Regarding child support, both parents have an obligation to support their children. once you separate from your spouse, if the children are living with you, then contact your county child support enforcement agency. If you can't find it, go to www.ncchildsupport.com, click on the link for parents and look up the information for your county. They will help get a child support order in place and garnish your spouse's pay if need be.

Of course, its far better and cheaper if you and your spouse can amicably work things out by deciding on how to divide your property, who will primarily have the children and who will pay the custodial parent (the parent with whom the children live) support. Even if your husband gets unemployment, you could draw up an agreement requiring him to pay something for child support and put in that the support will be revisited if your husband gets a job.

As long as you and your husband draw up an agreement, you both sign it and make full disclosure to each other, and get it notarized its valid. If you know what you want, I can draft an agreement for you, but the price may depend on your circumstances.

No. Assuming the debt was incurred prior to the marriage and you were not a co-borrower or co-applicant, then the answer is no. You are not liable by virtue of getting married.

However, you may want to think about this - what kinds of debts does the man have and how much? If he has a lot of debt, he may want to file bankruptcy before you get married so that he can have a fresh start with you and you and he can get a home or other things.

Also, why is there poor credit and outstanding debt? Job loss? Pay cut? Or something else like lack of financial savvy or responsibility with money? If its the former, its ok, but if the latter, then do you want to marry someone like this? Has the man changed his ways and become more responsible? If the answer is NO then do NOT marry him. The biggest reason why people get divorced is over money - if there are money issues going in and he has totally different attitudes than you do about money, then this relationship is not going to work out in the long run . You will get tired of supporting him or having his debt collectors hound you. So he needs to take positive steps to resolve his debt - either by filing bankruptcy or something else and proving he is financially literate and responsible before you marry.

You need to file a dispute with the credit bureau, contact the mortgage holder and get copies of the loan documents. (which it appears you have seen???) It is important that you do all of this in writing, or if you have phone calls keep the date you speak with anyone, the person's name and diary of what you discussed. If this is fraud, you may need to file a criminal action against him.

However, if you were ever on the loan with him, your divorce decree did not take you off the loan. The creditor may still have you on the loan legally - find out where the documents notarized, when where they signed, and on and on. . . Does he still live in the home???

This may take a lot of work and costs to get cleared up. It points out how important it is to get a credit report soon after a divorce. Because it all happened a long time ago, it may be difficult to prove that you did not sign the documents.
