If I marry a man with poor credit and outstanding debt, will I then be legally responsible for his debt ?

We may end up living in either FL or PA if that makes a difference.



Answer

No. Assuming the debt was incurred prior to the marriage and you were not a co-borrower or co-applicant, then the answer is no. You are not liable by virtue of getting married.

However, you may want to think about this - what kinds of debts does the man have and how much? If he has a lot of debt, he may want to file bankruptcy before you get married so that he can have a fresh start with you and you and he can get a home or other things.

Also, why is there poor credit and outstanding debt? Job loss? Pay cut? Or something else like lack of financial savvy or responsibility with money? If its the former, its ok, but if the latter, then do you want to marry someone like this? Has the man changed his ways and become more responsible? If the answer is NO then do NOT marry him. The biggest reason why people get divorced is over money - if there are money issues going in and he has totally different attitudes than you do about money, then this relationship is not going to work out in the long run . You will get tired of supporting him or having his debt collectors hound you. So he needs to take positive steps to resolve his debt - either by filing bankruptcy or something else and proving he is financially literate and responsible before you marry.
