Can a person be charged with burglary of a habitation if they knew the people were gonna be gone?

Question

Can a person be charged with burglary of a habitation if they knew the people were gonna be gone?

Answer

Sure. Burglary does not require that the building's inhabitants are present at the time. Since their absence doesn't matter, neither does knowing about their absence.
