I recently separated from my spouse, left the state with our two minor children. He is now suing me for sole custody. He has a history of drug, alcohol and domestic violence charges. Can he still get sole custody?



Answer

You should have asked a lawyer before leaving the state as that presents a huge problem for you. That state has jurisdiction so you will have the disadvantage of travelling back to handle the case.

No one on this forum knows what you (or he) can prove in court, so the question you ask obviously cannot be answered here. But do what you should have already done, and retain counsel.
