Question

I am currently married and my husband has a warrant out for his arrest on three different cases. Instead of going to court to be sentenced he left town. All I know is he is currently in a different state but he won't come back and face court. Do I have grounds for divorce and sole custody of our 5 year old daughter? His cases were for domestic violence against my niece, DUI and driving without a license. He has a history of several other DUI's in which he has spent about 4 years over the last 8 in prison.
