i was in an a.t.v. - automobile accident. i was issued a check to pay medical expenses. my insurance covered the expenses. the check is written out to the medical center and myself. but, because the medical center was paid. does this insurance check become legally mine???

Who issued you this check? What kind of insurance paid the medical center? Your question leaves out key facts and is difficult to understand.

If this new check is from the insurance company for the other driver, don't be quick to accept it as a settlement without consulting a personal injury attorney. If all you got was your medical expenses, and nothing for "pain and suffering," lost wages, lost earning capacity, etc. you're probably leaving money on the table. If you do take the check, have the issuer re-issue it, or have the medical center endorse it to you. If they give you a hard time have a lawyer write them a letter.
