Question

I work in inside sales. My paycheck specifies a specific pay for 40 hours/week. My boss is now requiring me to work 55 hours/week with no change in pay. Does federal law require I be paid overtime? I work in Georgia.

Answer

For some reason, although you told us what is printed on your check, you chose to not tell us your actual terms of employment. Do you get a salary, or are you an hourly employee? Since you mentioned sales, do you get a commission? Facts are important.

Answer

The Fair Labor Standards Act (FLSA) generally requires that most employees be paid overtime for all hours worked in excess of 40 in a work week. However, there are a number of exemptions. The answer depends upon whether your primary job duties satisfy one or more of those exemptions. This is very fact specific and would require a more in depth analysis.
