Moral Character Determination for CA Bar Admission
I got a ticket for having an open container of alcohol on a beach. It's just an infraction for violating a Business and Professions Code section, not a misdemeanor. Do I need to disclose this on the Moral Character Determination application? When looking at the application and the attachment form for Record of Criminal Cases, it only has questions about misdemeanors and felonies. I really don't want to look like I'm trying to cover it up, but I don't know how I would disclose it under these questions without writing in my own check boxes.
Answer
My advice is to err on the side of caution and disclose it. It is far better for you to disclose it, which is an infraction that does not involve moral turpitude, rather than not disclose it and get dinged by the Committee of Bar Examiners for not disclosing it.
