Re: lawsuit against new jersey

I don't think you are going to get anywhere with this.

Answer

Re: lawsuit against new jersey

It is virtually impossible to sue the state for failure to prosecute. The state typically has plenary (absolute) discretion in whether to prosecute or not. A civil lawsuit against the state for similar damages has such a high burden to meet that it would not be worth your time.

Answer

Re: lawsuit against new jersey

Hi:

While it is virtually impossible to sue the State for failure to prosecute based on the immunity doctrine, this really depends on the amount of complaints and how many parties are involved, etc.

This may be a long up hill battle and you may not prevail.

Good Luck
