Question

I have filed for divorce in the state of Pennsylvania already. My qesution is how do I Not require the defendant to be obligated to pay child support, but also protect my rights in the future to recieve child support if need be?

Answer

You can't. Child support is owed to the child not you! You may at any time file for court ordered child support. Any agreement to not pay child support is unenforceable.

Answer

Child support claims may be brought inside and outside of a divorce. If the father is on the birth certificate you would file a claim for support when you wanted to. However you can not ak for retroactive support so carefully consider foregoing a claim.
