How do I sue for an overpayment of child support? I recevied a disability award. I was current on child support order. The child was entitled to benefits but the amount was not yet calculated. There was a withholding from my income for support with arrears plus interest. When the child benefits were paid to custodial parent there was an overpayment. The case was closed. Custodial parent recieved child support payments twice. The case was closed. I never received credit for any of the overpayment and feel I am entitled to but the child support agency claims there is no money owed so there is no case. Custodial parent is now representative of payee and has no communication with me. Custodial parent is continuing to recieve monthly payments for the child through my claim from social security. I feel that child support has not been fair to me by closing the case without crediting me the difference in support that was overpaid to the custodial parent. What are my options?

You can file for an order to show cause for child support modification and bring up the issue.
