If two married couples are equal partners in a buisness and one couple divorces (and one spouse forfeits all rights) does the remaining spouse obtain that portion or does it split equally among the remaining three.



Answer

It depends upon the partnership. If Bob and Carol are one partner, and Ted and Alice, and Ted and Alice divorce, then Ted probalby retains Alice's partnership interest. (Bob & Carol are unaffected) But, if Bob, Carol, Ted & Alice are all individual partners, then the partnership has probalby ended. Bob, Carol and Ted can form a new partnership.
