Once they get a judgment, they can go after your car, your home, your pay and your bank accounts. I assume since you have been sued that you immediately went to see a lawyer as you have a very short period to act, be it an answer, counterclaim, bankruptcy or whatever. That lawyer will tell you what your best option is.

It depends. Credit card companies can do nothing until they get a judgment. Once the judgment has been entered (and they do not have to give you notice as to when that will be) they can do nothing for 30 days until the judgment becomes final.
Once filed they can get a writ of execution called a fieri fascias (latin) or "FiFa."
They will then use the FiFa to have the sheriff look for any bank accounts that you have or any other assets that are owned free and clear. If your car is worth more than $3500 and is owned free and clear it is at risk. If the car is still being financed, then it cannot be seized.
Judgment creditors look for easy sources of money to pay the judgment. They don't really want your stuff as it costs money to have the sheriff seize, store and sell your things. And sheriff's sales do not bring in anywhere near what the car or other assets would be worth.
The easiest sources are (a) wage garnishment and (b) levy on bank accounts. Unless you are are retired or self-employed, they can garnish up to 25% of your disposable pay, There is a handy chart that you can use at the US Department of Labor - here is the link:

If you have just been served and if you have any valid defenses, then maybe you should get a litigation lawyer who specializes in credit card defense. Valid defense are generally that: (1) collection of the debt is barred by the statute of limitations (the statute is 6 years in Georgia; it begins with the last payment on the debt); (2) its not your debt because of identity fraud/theft; (3) you don't owe as much as is claimed (them adding interest since the delinquency has occurred does not count as a defense) or (4) that you already paid.

He paid all child support until my son was 19 (because his birthday is 10/5/92). The divorce decree also stated that if my son attended post secondary school the ex was to pay half of the college tuition plus living expenses. In 2011 I filed a petition for the ex to comply. I went back to court 3 times because I didn't have an address to serve him the summons to appear in court. So the judge entered a default judge for $320 (based on the orginal divorce decree) per month for our son's education support until I was able to get a valid address. I did get the address but I decided not to take him back to court to pay for the 1/2 of our son's tuition ($10,000 per year) Now the ex has listed me in his bankruptcy as a creditor to discontinue paying this support. Can he? Is this legal>

Unless the Bankruptcy Code has been revised, child support obligations are not dischargeable in bankruptcy. You may want to consult with a BK attorney and discuss filing an objection to dischargeability in the BK court.

We have a commercial building we have been working on for a couple of years. We recently hired an electrician to do some electrical work in the building. We had asked for a contract and estimate a number of times and he failed to do so. He had started the work and knew the limit we had set for him was $12,000 from a verbal agreement previously. After working only a few days he had done a good amount of the work but had been showing up periodically and not in any predictable fashion. Soon after not having shown up for a couple of weeks we called to confirm his next work day when we were told that he was done. From the work he was not done at all he had a lot more work to do. We even took pictures of his unfinished work. We later contacted the Better Business Bureau after having paid the contractor $10,000 for the work that he had already done, and he claimed that we owed at least $2,500 more. The negotiations failed because he wanted more money and we stated that he had been paid a fair amount and we no longer wanted him to work on the building because we couldn't trust him. We even have copies of his emails from the bureau stating that he knew that he wasn't done with the work and that the limit was originally set at $12,000. This all happened in October of 2010, he has now filed a Mechanic's lien on a house that was not the commercial property he worked on just recently March 11th of 2011 to be exact. The most I could make out in the state law was that he had 90 days after the last day of work or labor to complete this filing and he obviously failed to do so as it has been nearly six months later. So our question is what do we do now? (We also don't have a problem taking this person to court because we have plenty of photographic evidence and written evidence of all the unfinished work and contradictory statements he has made.)

This is very confusing, and if I misunderstand, please rephrase and repost your question. If you are asking if an estranged wife can dictate if a child of the marriage is around an live-in girlfriend, the short answer is maybe. Many courts will uphold the requirement of a 'morals clause' in the decree as in the best interest of the child. Generally it is phrased that the possessory parent may not have unrelated overnight guests of the opposite sex between midnight and 8 am during periods of possession.

Oh, don't worry, you'll eventually get a ride to court for an arraignment on the bench warrant for your failure to appear. Your ride will be in the back of a sheriff's van where you'll be handcuffed once they writ you out of whatever jail you'll be in once they catch up with you. You might be an absconder for quite a while before this happens, but, when it does, it will be immediately apparent to you that you made a truly stupid decision for a very lame reason. Make sure you carry enough money to make bond when you get caught. Call the court clerk after you don't show up and she'll tell you how much it is. Oh, and kiss your driver's license goodbye.

my attorney sent my husband a settlement agreement stating he has to refinance the house to buy out my portion and pay for the quit claim deed i will have to file. unfortunately, he is not co-operating.
my question is: what are the consequences of leaving my name on the house if i finalize the divorce (the waiting period is past 2 years and i don't need his signature)? he pays the mortgage late but i does get paid. i understand i run the risk of maybe him not paying at all and it going in to foreclosure.

You have an attorney so why are you asking questions here? Its not fair to either your attorney or the attorneys here. Your attorney has access to information and facts about your case. No attorney here does. And its unethical for other attorneys to intervene when you are represented.
Your post suggests that you are on the mortgage to the home. Divorce has no bearing on you being on the title or mortgage. You will still be on the deed to the home and on the mortgage after the divorce. The only difference is that your ownership of the home will be as tenants in common rather than as tenants by the entirety (available to husband and wives).
The problem is that if you divorce and you are still on the mortgage then the mortgage loan is reported on your credit. So all of those late pays are affecting your credit. And if your husband one day stops paying the mortgage you will still be liable on it.
If the husband is not cooperating, then you need to buy out the share of the husband and sell the property and get yourself out from under the mortgage. This will only get worse once the divorce is granted as there will be issues. The time to resolve this is now.

Technically it may be theft to remove flowers that are placed on a grave by someone else. However, it is theft from your Brother's estate. Therefore, as wife, she is the person most fit to bring a civil action for theft. From a civil standpoint, the cemetary probably has retained the right to mow and remove temporary objects (trash, flowers, cards) from around the grave markers and stones.. They may be able to direct the owner(s) of the plot to do that. As the widow, your sister-in-law may have the authority to do that.
But, if doing so, one is trying to cause emotional distress to the people that left the flowers, that person might be subject to a civil suit from the flower placer(s). In that sense, you and your mother may have a civil action against your sister-in-law for infliction of emotional distress.

1. You need to record the contract right away with your county recorder of deeds.
2. You need to contact an attorney right away to determine your rights under the contract.
3. They can keep your prior payments. This is how these contracts are typically written.
4. They cannot make you move unless they serve you with a five day notice (requiring payment) and then file a forcible entry case against you. This process will probably take about 6 weeks.

It tells you what the Seller can do, not what he has to do. From what it says, he can come in and act as if the agreement never existed - if the property was part of the purchase, then you are out of luck. Liquidated damages would equal whatever rent you had paid to date - you would owe hiim that amount. I agree that you need an attorney to review the whole contract - otherwise you will not get correct advice.

my wages are being garnished and have been for almost a year. i understand that in the state of missouri wages can only be garnished up to a 180 days maximum and then a new order is obtained if not paid off. my question is regarding the accumulating interest because the interest has accumulated almost a 1000.00 in 1 month and as this was for vehicle repossession and the interest was figured into the original loan how can it still be accumulating at this rate. it will never be paid off. also, each new order does not reflect what has been paid to date which again allows for inreased interest-i still owe a total of 2585.13 of which 2289.75 is interest. does not seem right to me. one other item. the original order was established 12/2005 and i have been told was not enforced for almost 4 months because no one kneww where i was. this information from the loan company to the court or whoever when in face they-loan company-did know where i was living as vehicle was take from the home and knew my place of employment as they informed by myself of the address and i received telephone calls from them at work. again interest accumulating. this just does not seem right. is there any recourse i have in this matter

If you pay the balance all at once, the interest will stop. If you cannot pay off the debt, and you believe teh new garnishment interrogatories are including an old principal figure, then you should fiel a Motion to quash or recall the iterrogatories.
As to the four months of inactivity. The Judgmetn creditor has years in which to start collecting a judgment. The post judgment interest accrues during this period. If you feel that you are being charge dinterest on interest, you may want o hire an attorney to try to stop the collection. there appears to be a dispute in Misssouri as to whether you get interest on interest, or jus on the outstanding principal. If it is the former, then they may be figuring yours correctly, or close to it. If it is the latter, then you have been overcharged, and may even have money coming back. under the figures your mentioned, I do not see how your debt could accrue a $1000 interest in one month. Something does not sound right there.

His friend and him got into an arguement with a neighbor who called the police and told them that they had a gun and were trying to steal his car. I begged the police to fingerprint the car to prove my husbands innocence but they never impounded the car nor did they fingerprint it. Lots of good question! Contests are merit-driven, sweepstakes are luck-driven. The laws in each state are not totally in harmony one with the other so you have to be careful and may have to exclude citizens/residents of particular states to suit your needs. As to the granting of IP rights in the entered content this is of course possible but you need to remember that contestants can only give what they have -- if their work is a derivative or otherwise their rights in it are limited they can only give you the rights they have. So strong liability limitations and indemnifications are called for. Of course, this raises the question of how strong the indemnification can be as a practical matter -- and this has to be a risk profile that your company is comfortable with.

Sometimes. Statutes can create exceptions to common law, but then must be strictly construed so as not to do harm.
However, statutes must be constitutional. When a federal law superscedes a state law, that's called preemption. Usually if there is a law on point the State law prevails unless the Federal one specifically says it preempts.

If the abstract was recorded properly, you can pursue the property against the new owner.

I assume you are the judgment creditor or someone who holds the claim in due course. It remains a lien against the property. You now have a choice of going after the debtor or the liened property even though it has a new owner. Selling a property doesn't discharge the lien of the recorded abstract of judgment. Usually, a buyer will insist that the lien be paid from escrow or otherwise as a condition of the purchase, but not always. Also, the recording of the abstract is "notice to the world" of the lien it represents.

However, the amendment starts out stating - This first amendment of Trust made 2010 executed between mom as Settlor and mom and my brother as Co-trustees. It then goes on to say "Whereas, the Settler and the Trustee entered into a 2006 Trust Agreement, and..." etc., etc.
Since the Amendment doesn't specifically name my mom as settlor/trustee and then state her wishes to amend her 2006 Trust to make my brother to be co-trustee, is it valid?

Does it matter? Your mother may amend the trust again if she doesn't want your brother to be a co-trustee any longer.
The amendment is probably valid, but you should have a lawyer look at it to be sure - it's not really required for the amendment to state the history of the creation and prior modifications of the trust (although it's good form to do so).

If you are one of these things, then one of the applicable rules of ethics or other may prohibit you from revealing client confidences. Certainly, there is no drunk-to-drunk privilege. In our divorce decree it specifically states that he is to remove my name from all joint accounts, but he still has my name listed on the mortgage of his house. I have asked my ex several times to remove my name from the mortgage, but my requests have fallen on deaf ears. Since our divorce, I put a lien on his house in order to collect on the alimony payments which he still owes me should he decide to sell. Since my name is still listed on the mortgage of his house, does this mean that the house is still partly mine?
Also, how can I enforce that he removes my name from the mortgage?

You are blinded to the fact that a third party is involved here, which is not a party to your divorce.
When you were together you both signed a promissory note for a loan. That loan was secured most likely by a deed of trust that you both signed, which encumbered the property as security for the loan. You call it a mortgage, but you don't really have a mortgage, as that is a different security instrument that is hardly ever used in California.
The third party is the bank. The bank could be the original bank, or a bank that bought the promissory note from the original bank. You promised to pay back the loan, and as it stands right now, you are personally liable to repay the loan, even though you are no longer on title. The bank is not a party to the divorce, and it is up to them whether or not they want to release you from the promissory note.
The only way this is usually done is with a refinance. The economy is not good for this right now, and if the bank does not want to refinance, you can't force it to refinance. It simply is not your husband's decision on who is going to be on the promissory note to the bank, and the joint debt that you signed is not considered a joint account.

The information in Mr. Roach's answer is mostly correct, but also mostly irrelevant to your question. Ms. Kock's answer is also correct, but leaves out the first step.
It is true that the lender is under no obligation and cannot be ordered to release you from the debt or give your ex a refinance to take you off the account. But that doesn't really matter. The bank must take the money if your husband pays off the loan, and there are two ways to do that. 1. is just pay it off if he has the cash, 2. is to take out a new loan in just his name. The divorce decree contemplates that he will do one or the other. He should not have signed the MSA, or accepted a court order that he remove you from the mortgage if he did not intend to or was incapable of doing one or the other. Your remedy is to file an "OSC" (order to show cause) why he should not be held in contempt of court for failing to comply with the terms of the divorce decree. If he is found in contempt he will be ordered to get a new loan within a certain time. If he fails to do so, you go in on a second contempt proceeding and ask that the house be sold.

If your father did not have testamentory capacity ( to be determined by a court, based upon the facts in evidence) any action he takes to amend or end his estate plan may be rescinded or altered by the court. Someitmes it is better to act as soon as you learn of the change. Other times it is advantageous to wait until the trust pays out. You should consutl idrelty with a probate or estate planniong attorney in your area, as to the specific facts of your matter. Many offer a free or low cost initial consultation. I suggest you take whatever documents or notes you have and go see one very soon.

You will need his written permission to relocate. If he does not want to provide you with permission then you must file a Petition with the court to allow you to relocate. In that Petition you will need to outline the reasons you want to move, highlight the job promotion and explain how the move is in the best interest of the child. Who issued you this check? What kind of insurance paid the medical center? Your question leaves out key facts and is difficult to understand.
If this new check is from the insurance company for the other driver, don't be quick to accept it as a settlement without consulting a personal injury attorney. If all you got was your medical expenses, and nothing for "pain and suffering," lost wages, lost earning capacity, etc. you're probably leaving money on the table. If you do take the check, have the issuer re-issue it, or have the medical center endorse it to you. If they give you a hard time have a lawyer write them a letter.

Your employer is not supposed to deduct the damages directly from your paycheck without going through a legal process to do so. However, if you do owe the money for the damages, reversing the process and going through all of the steps just to get back where you are now doesn't make a lot of sense.

After years of dissent between the board and the rest of us members, our WA non-profit corporation voted almost unanimously to dissolve, and to transfer all property to our sister organization (as directed in our articles of incorporation), although the board would continue operating our preschool subsidiary as a tenant of the sister org. One year later, we discovered that the board had decided not to dissolve or transfer the property, and instead had just sold a major part of the property in the name of the corporation, to fund their operations. About half of the members sued the board to enforce the dissolution (at first with the corporation listed as a defendant, then amended to be a plaintiff), but our lawyer has since withdrawn. I just wrote and filed a pro se motion for summary judgement, signed by all the individual plaintiffs (some of which will attend the hearing), and the opposing attorney has accused me of unauthorized practice of law. Can members of a non-profit corporation act pro se as plaintiffs against the board, with one serving as author, with the corporation also listed as a plaintiff?

As an association you are a self-governing entity. This means you can elect officers and board members who will do a better job of looking out for the interests of the members, and you can hire new management if you don't think the current ones are doing the job. For example, a more concerted effort should be made to collect the outstanding fees. You can propose new bylaws that better serve the members. If you can band together with similarly disgruntled members, you could seek the assistance of an attorney who is experienced in this field.

In your case EVERYTHING is dependent on your governing documents. If those documents state that certain areas are condo responsibility for maintenance and repair, then that cannot be changed except by amendment of the governing documents. That is unlikely.
But, the real problem is how you deal with a community that is failing due to lack of solvent owners to pay monthly fees. Unfortunately, this is not easy to diagnose or repair.
With regard to your specific circumstances, you may want to consult an attorney to chart a course. Condo law can be arcane and difficult to understand.

You may have the right to force the sale of the home, and you may also have the right to demand to be bought out by your other co-owners. You have options, but I can see how the executor is currently motivated to reside in the home and maintain the status quo. In 2003 a family friend of my mom's loaned me money to catch up on back mortgage payments. In early 2004 I was injured and had my neck broken. I lost the ability to work and my house went into foreclosure. I looked into selling the house prior to foreclosure and the family friend sent me to a lawyer for help who tried to rip me off. This lawyer lost his licsence to practice after this. The bank understood my situation and bought me out of my mortgage for $500.00 and they took over the house. I was released from all financial responsability. Then the bank sold the house to a private buyer who had a search done on the property for back attached debt and liens. There were none. Eight years went by and the family friend NEVER asked for any payments. Now, after all this time, he has approached me and asked me to start repaying. Aren't all debts ignored for seven years cleared legally if no collections actions were ever taken?

If the debt is outside of the statute of limitations, you have no legal obligation to repay the loan. The statute of limitations is six years on contract actions. Whether the debt is outside of the statute of limitations is very fact specific, and you should speak with a lawyer if the other party attempts to sue you.

A few years ago I went threw Friend of the Court when my ex girlfriend had my daughter. First, I was ordered to pay child support, and arrears (which have long since been caught up), and I had weekend visitation. About a year after that order was put in, she attempted to file a change of domicile, and during that time, we ended up going back to court because she was unfit to raise our child. The court agreed that my daughter should live with me, and they wrote up the order. She now stays with me Sunday night threw Friday night. In addition, the removed all of my child support fees. There however is still a fee coming out of my check ( and has been for awhile) for "current cash medical support". I provide all health coverage for my daughter threw my job, which I pay for out of my check. Is this just a fee that I have to deal with, even though I do not have support payments anymore, and I am taking care of my daughter, or can I get this removed?

Depending on the age of the tax bill, it may simply vanish in a court order. The older the bill, the more likely that is to happen.
If you are still within the timeframe that the state can collect taxes from your business, you will be personally liable for your business taxes if the business cannot pay them. If you cannot pay them, it's still very, very difficult to discharge them in bankruptcy. You'll need to work out a payment arrangement with the taxing authority. They're generally fairly easy to work with because they know that the money will come to them (with interest and penalties) regardless of the timeframe involved.

He is now suing me in civil court claiming he never gave me permission to use his checkbook. I am vigorously fighting this lawsuit, however now he is being sued by credit card companies and has told them they are not his debt and I used the cards fraudulently. My nephew was recently arrested in Savannah, Ga. Abuse of Power runs rampant in this great country. It needs to be addressed and examples made. He is 19 years old. Graduated from Ironton, Oh. He currently lives in SC with his father. He is a Kirby Vacuum Salesman. He was in Ga. with his company. He was in a customers house giving a demonstration. He is about 6'4" 250lbs. He picked up the end of her sofa to show her the difference in the carpet color. It scared the customer, due to his size and strength. She called the police, instead of asking him to leave. When the police arrived, his managers wife was next door giving a demonstration, she walked over. My nephew had no idea what was going on. He was simply doing his job. He has never had a complaint while with the company. He was never asked to leave by the customer, nor did he realize that he had scared her. He was arrested for Criminal Trespassing, Loitering, and Peddling without a license. The license should have been the responsibility of Kirby. The other two charges were fabricated to make an arrest. He was invited in by the customer, was giving his demonstration, and was never asked to leave. There should not have been charges filed. Is there something we can do within the legal system to ensure this abuse doesn't continue to happen without consequence? The officers response, was they shouldn't let a person his size be a door to door salesman. What happened to "Life, Liberty, and The Pursuit of Happiness?"

The characteristic that defines a boxer motor is that it must have multiple cylinders, all cylinders must lie in the same plane, and some of the cylinders must be on the opposite side of the crankshaft centerline from the other cylinders. The pistons in those cylinders "oppose" each other. Usually opposing pistons are paired such that the exhaust stroke of one occurs simultaneously with the power stroke of the other in the pair. The advantage of this layout is that it results in the lowest possible height of a motor with a given bore size. It can also result in a very smooth running vibration controlled engine if crankshaft and firing order are selected so that power strokes on each bank are exactly matched by power strokes on the opposing bank.
