Question

If you spin your tires on your vehicle, can you be arrested for reckless driving in florida? what if you are on private property - parking lot of a business/shopping center that is owned by a company and not the city?

Answer

Can you yes. Should you, maybe. Reckless means a wanton disregard for the safety of others. So on an empty lot, maybe, but on a crowded lot, probably. Officers can enforce criminal traffic violations on private property. (But there still may be defenses that you should discuss with an attorney).

Answer

Hello:

I read your question and the one answer. That lawyer is correct. It should also be mentioned that if you don't have any prior record, you would be able to negotiate a good disposition with the State Attorney. First, you might have an atty. look into the facts to see if a motion to dismiss or other motion is warranted.

If my office can be of assistance in North Fla. please give us a call. I have handled numerous cases involving driving charges over many years. Good luck. Tom Rosenblum
