Question

I'm 19 years old and am in the military and my parents divorced when I was 3. I barely knew Julie, my biological mother, but I did later learn I have a sister who was 4 years younger than me. I don't know what happened to her father. However I would like to seek guardianship of my sister.Emily (15) has decided to drop out of high school to help my mother. Emily is a straight a student when she goes but she is already a semester behind. My mother has a drug problem and i am unsure if she is currently using. Also I am stationed in AlbuquerqueNM, whereas they are in Las Vegas, NV.

Answer

You will need to file a Petition for Guardianship in Las Vegas, presuming Emily still lives in Las Vegas. You might also need a co-guardian if you are claiming Albuquerque as your address. The Courts do allow military personnel to claim their original address instead of where they are stationed so you may not.

You mother can also give you a single page form giving you a temporary guardianship for six months and you would just renew it every six months. I doubt that the military would allow you to use that to give her benefits such as insurance, etc.

You may email me at [email protected]/* */ if you have any other questions or would like to hire me.
