My husband is a green card holder. he is not able to get his citizenship because of a dui case and he hasn't complied with his AA classes.
My aunt sent in an application for my father, mother, and myself in march 01(form i130). Im not sure if I have to file an i130 with my husband or if I can file an i485.
I have two small children ages 2 and 5 years old. I just want to know which route I need to take.
Do I have to file the i130 and be sent to Mexico until it gets approved or can i file the i485 and be allowed to stay in the United States even though he is only a Permanent Resident and not a citizen.
