One of the problems that a potential executor sometimes encounters is that the potential executor contacts a bank where the decedent has an account and the bank says, "We can't tell you anything until you are appointed as executor by the a court." But, there are different probate procedures depending on the size of the estate. So now the potential executor has a problem: Which probate procedure to start without knowing the size of the estate?
One solution is for the potential executor to do a special administration which lets the potential executor get a document from the court which will authorize the bank to disclose the assets so the potential executor can size up the estate and then know which probate procedure to do.
I can't tell from your post if this is what is going on in your case, but it may well be.

An executor handles administration of Probate. Your question also states that your step-sister is the successor trustee for some sort of trust. It is unclear whether your father had some assets that are in a trust and some assets outside of a trust that would require Probate administration. An attorney would need to review a copy of the will (which should be filed with the Court) and a copy of the trust (assuming you are even a beneficiary under the trust) to provide a clear answer to your questions. Given that there is a hearing pending, I urge you to hire an attorney as soon as possible to protect your rights.

Yes. A summons and complaint form from the court tells you that you need to answer the complaint in writing within 21 or 28 days after being served. (28 if by mail) So you went into default waiting for an initial court date that was not going to happen.

Generally Alabama child visitation verbiage states that neither party is to have members of the opposite sex unmarried persons in the home overnight while the child is with them. If this is in your divorce agreement then there is nothing you can do outside of marriage or an agreement between you and your ex-wife to allow your child to stay overnight with you and your girlfriend. The fact that she did this does not give you a negotiating point in the eyes of the law, in other words a judge wouldn't care (two wrongs don't make a right / you should of brought it up at the time of occurrence). DHR will not be interested in who is in your home with your children unless they feel your children are in danger. Your ex wife can refuse future overnight visitation. However, if nothing stipulating this is in your child visitation agreement then you have nothing to worry about. Just have a copy of your agreement ready along with any threats your ex has made against you in regards to contacting authorities based on these stipulations. If she does in fact restrict visitation on these grounds and they are not in your original visitation guidelines, then you can return to court for her contempt of refusing visitation.

On a friday morning FBI came to his door with a warrant that was issued to pick up all cameras, video, computers, hardrives, etc. The warrant was issued over 8 months after the occurrence was cited. They did not even know the name of who this family was in the house. He was told he was not being arrested but would like for him to go to the FBI building for a lie detector test and if he did not they would take his wife in also who was in the house with their 2 year old daughter. When at the building he told them he wanted a lawyer as he was able to call one as he was following them in his truck and he told him to say nothing and request a lawyer. The detective got very angry at that point and told him he was arrested and was charged with 15 counts. The arraignment was the following Tuesday. The charges was read by the prosecutor. His lawyer asked for a bail and the prosecutor then said " no judge we do not want this , the detective said this person has a young child at home and he had over 400 videos and photos and one was of a 18 month old girl with a male penis next to her vagina". The judge convicted him right then by going on about 5 minutes about how much trouble he was in and thus could be decades in prison, this person could only shake his head no on the video conference as he could only see the judge but we could see him. His family left the courtroom in shock and crying from the episode. The lawyer that is handling this said do not talk about the case at all to him as everything is recorded. He could not defend himself to anyone but the lawyer and at first he must have felt he was guilty of having these videos and photos. The court date was in county court over 40 days later. The county prosecutor said 13 of the 15 charges was dropped, the only renaming was 2 of downloading over state lines and 1 sending over state lines and they were handing the case back over to the federal court. They did not find any pornographic videos or photos on the seized equipment. The next day he was transported to a federal holding jail now awaiting a bail hearing as soon as one can be set but he is still in prison. The whole family stands behind this person. His 2 children, 2 and 7 years old have done nothing but cry and ask for there daddy to come home. Does this family have any rights or do anything as to the lie that was said at the first hearing?

Not exactly. Depending on the issues that were tried, the typical remedy is to bring a motion for "amended findings or new trial." This is a motion that is addressed to the judge who conducted the trial. The purpose of the motion is two fold: First, it requests that the court modify its order and/or hold a new trial because of irregularities at the original trial; Second, it can be an important step in preserving issues for a later appeal to the Minnesota Court of Appeals. If the trial court does not amend its order or grant a new trial, you can then appeal to the Court of Appeals. You are not required to bring a motion for amended findings/new trial before bringing an appeal to the court of appeals, but it is usually wise to do so.
You need to be aware that there are very strict deadlines for these remedies. A motion for amended findings/new trial must be served and filed within thirty days of the date the trial court filed its "Findings of Fact, Conclusions of Law, Order for Judgment and Judgment and Decree." (Actually, it must be served and filed within 30 days of a "notice of filing," but to be safe, you should start counting days from the date the Judgment and Decree was filed.) The motion must also be heard within 60 days of the date the Judgment and Decree was filed.
If you do not return to the trial court with a motion, you can go straight to the court of appeals, but you must do so within 60 days of the date the court files its Judgment and Decree.
If you miss these deadlines, you generally cannot contest the trial court's decision. If your attorney can convince the judge that there was absolutely no probable cause for the DUI arrest--which is difficult to do, but I have done it a time or two--then the arrest was illegal and any evidence found after the arrest, such as the marijuana and paraphernalia, was illegally seized and will be suppressed. However, if a cop "claims" he smelled marijuana--whether it is true or not does not matter because no attorney will be able to prove that he did not smell it--that gives him probable cause to search the car.

The sentence that could be imposed is a term of imprisionment up to 365 days and a manditory minimum fine of $750.00. You do not state how old you are so I am going to assume you are under 18 and are still a minor living in your parents' home. A parent has the right to restrict contact between her child and other children. So your mother can restrict your relationships to some degree. However, there is no law that says if you do not obey her wishes, she can put you in jail. She can do other things to restrict your behavior.
To get a protective order, your mother must show the person is a threat or danger to you. Merely being someone she does not want you to associate with will not get a protective order.
I am not sure why your mother and your girl friend's mother do not like each other's child but I would suggest you get to the bottom of the issue with your mother and your girlfriend do the same thing with her mother. Otherwise, the discord will continue until someone's parent decides to do something that could hurt either you or your girlfriend or both of you.
Good Luck. Once you are 18 legally your mother has no control of what you do. Financially, that may be a different story.

It's impossible to advise whether you need a lawyer, because you give the impression that the substance of the protection order is that your daughter stuck her tongue out at the neighbor's child. That may not be the most ridiculous claim to get a protection order, but it's got to be close.
That said, temporary orders are exceedingly easy to obtain, and usually are granted without even the presence of the defendant. So if what you mean is that a temporary order already is in place, and the hearing is to determine whether it should be made permanent, by all means bring any witness you have, and a lawyer. Is a lawyer strictly necessary? No, but they generally can be a comfort in a fairly nerve-wracking arena, assuming they can stay awake and show up sober.

If EDD decides he was an employee and not a 1099 contractor, he will get benefits, and you will get assessed all the back due withholdings you should have been paying to the state and federal governments, with interest and penalties. YOU used the word employee, and that is probably correct. Independent Contractor is not a status the employer gets to 'create' for their convenience to avoid costs. He would have to meet all the criteria of IC to qualify, and I'm guessing you don't know what those are. If you are serious about hiring counsel to help you in this, feel free to contact me.

Quite possibly. The EDD will assess whether the worker was actually an employee and not an indep. contractor. The analysis is based on the amount of control you had over the worker's performance of his/her duties. There are many factors that will be considered. It is very unwise to treat workers as indep. contractors if they are not since CA is cracking down on this type of abuse of the law. It may be well worth your time and money to consult with an employment law attorney to make sure you don't set yourself up to be audited by the EDD, IRS, Labor Commissioner's office, etc.

However, when they filed an annual report a year later, he was no longer listed as a member of the LLC. Then the LLS was administratively dissolved for not filing their latest annual report.
The tenants later vacated the property owing me 8 months rent. They also caused damage to the property while removing their equipment. I estimate total damages of $36,000 in unpaid rent plus app. $15,000 in damage to the property.
My question is - can I sue the original member of the LLC who signed the lease? Did he lose his LLC protection when he no longer appeared on the last LLC annual report fled in January, 2011?

I have gotten responses about getting a second DUI but this is not what happened. Also some resonses only focus on the part of the law that retro actively convicts for a crime that was not a crime at the time it was comitted. But what about the part that I put in all uppercase ( Extending terms). This is exactly what happened to me. I am a commercial driver who has been affected now for 13 years instead of the 7 that where part of the punishment when the crime was commited. I have personally interacted with this animal for the past three years and I cannot say that I trust the animal at all. He is a very anxious dog, jumps up on people when he gets excited, nips at finger tips when you try to pet him, can hurt you just by his shear strength and hardness of head when he comes at you quickly, and according to one of her daughters, has bit the mother previously. I would describe this animal as a large dog. It is of the pit bull breed. I am a bit upset that she never asked for my preference about the boundries I cared for when it came to the dog around my infant and she is quite pushy about the issue of introducing the animal to my daughter. In the past 9 months of her life, he has jumped up and tried to nip her dangling feet/hands several times, rammed her play pen with its head (luckily she wasn't inside-just her blanket), and gets overly excited and preoccupied with her presence when around. Is there a way that I can legally set the boundries in place that I want as her parent? My boyfriend's mother doesn't seem to understand that not everyone shares her love, enthusiasm, and trust for this dog.I offered her to begin slowly by using one of the baby's slept in pajamas to dress a doll in so she can practice with the dog in that way as I've seen many dog trainers do, but she dismisses the idea and wants to jump right in. I would make it clear to boyfriend and mother that the child will not be allowed at GM's home whether you are going to be there or not as long as GM refuses to put the dog up or otherwise control him around the child. Hello - About 5 months ago I wrote our HOA a letter telling them that there was a portable baseball net blocking the sidewalk (about 75% of it) and I was worried someone can fall over it and get hurt as there are lots of kids around. The net was never moved and last week I was going for a work and due to cars in the street I needed to step around the net. Oh also it the net was right in front of a utility box that says don't put anything around it for 8 feet (the net was about 2 feet). Anyway I tripped over it and needed emergency surgery on my ankle and fibula. I think the HOA was negligent and the homeowner also. Blocking the sidewalk is against the HOA rules so the HOA did not follow their own rules.

You can try seeking an informal settlement by presenting your bills and demanding they or their insurance carrier pay your expenses. If they refuse, they will likely state that their defense and reason is that you were simply negligent and this was not their fault, You will have to overcome that legal presumption in court if you sue.

I've owned a rental home in the past and have experienced both good renters and bad renters. I can really appreciate people that are nice and responsible such as you folks. Good for you. I'm sorry that being so considerate to your landlord backfired. That's really a shame.
Your options? Unfortunately, you don't have a lot of them. You can try talking with him. You know him, I don't. So only you know what sort of approach would be best. I can't advise you on that. Often we need to tailor our communications to a particular personality.
If talking with him doesn't work, you can try sending a letter and threaten to sue him. If you know a lawyer that would put such a letter on his/her letterhead, that often gets people's attention.
If the above doesn't work, then you can go to the Magistrates Court in the county where the home is. They will guide you on the process. They are not allowed to give you legal advise however.
I must strongly recommend that you consult with an attorney before doing any of this. I would also suggest taking a very careful look at the lease agreement, if there was one. Be absolutely sure that you understand everything in the lease that could apply to the deposit, terminating the lease, etc.

You don't state who the primary custodian of your sister is currently. This is the person who controls. If your sister would like her custodian to be changed and everyone agrees, it is a simple legal procedure to do when everyone agrees to sign the paperwork. You would need to retain a local attorney and have them draw up the change in paperwork. It can be done quickly since there is no waiting period for a change in custody. But I doubt that the boyfriend would qualify to be the new primary custodian of your sister -- if everyone agrees then you could ask the judge to appoint him.

You can take the police, sheriff or constable out with you and ask the lady to surrender the paperwork to you. Unfortunately, this sort of thing occurs frequently.
Call the local policing agency ahead of time and alert them ahead of time. See if they will help you. You will need a certified copy of your paperwork giving you legal custody of the children.
Regarding the furniture that you say that you purchased -- You will need receipts to prove that the belongings in her home belong to you. Otherwise, she will claim that the furniture belongs to her. The policing agencies don't have the authority to determine who owns the furniture. Plus they do not have the time to sort this type of stuff out. They are busy with crime.
You can always go to small claims court and sue her for your belongings. However, I doubt that you have the time to do this. A judge would have to hear the case. Again, you would have to have documentation to show that you paid for the furniture. Otherwise it is your word against hers and the furniture is in her home. The judge would normally assume that she purchased it since it is in her home.
Most of the paperwork can be replaced if you are their parent with custody - you can get the shot records from the doctor's office. Just call the doctor and send a copy of the legal paperwork to the doctor's office. The school records are the same thing. Birth certificates and social security cards, etc. can all be replaced since you are the parent with custody.
I cannot think of any TX laws or regulations - sorry!
My suggestion is to avoid any confrontation when you pick up the children so that you don't get arrested. Do not "touch" her during the exchange of the children. Any touching could be perceived as an assault and you will be arrested and charged with assault -- it happens all the time. If she attempts to hit you and you grab her arm to prevent it, that is considered "assault" in Texas -- you are a male & you will be arrested. So be very careful during the exchange.
Bring a witness with you during the exchange.

You are negotiating a lease termination. In such cases of course the security deposit will be part of the "mix". Legally? You moved out, abandoned, broke the lease . . . and while the landlord has a duty to "mitigate" meaning he or she should be attempting to relet, you owe damages. While security deposits often are related only to condition, most leases also say they can be applied to past-due rent. So check your lease. Otherwise, the fact that the landlord and/or his/her attorney is willing to work with you is a gift of sorts. Don't screw it up.

Once the judge signs the Final Decree of Divorce the judge loses jurisdiction over the divorce in 30 days and the final decree is "final". That means it is written in stone forever. If there are ny typos or errors then you are stuck with it. Therefore, if there are any typos you need to move NOW to get it fixed within the 30 day period. But don't wait -- you need to get your paperwork in front of the judge way before the 30 day period has run. So don't file your paperwork on day 30!
If only you and your soon to be ex-spouse have signed the paperwork and the judge has not signed the Final Decree of Divorce then the your divorce is not final.

Our sorority council then informed us that the people who caused the damage would pay for half and th rest of the sorority would cover the rest as a punishment for "our bad behavior" (despite the fact that only 3 sisters caused the damage). I was not even at the event in question so I was upset that I had was being forced to pay a fine. When I asked what authority they had to fine me (because there is nothing in our bylaws which states we could potentially be responsible for fines incurred by other sisters), they cited the fact that our National organization approved of the fine and I signed a contract a year ago saying I would "meet all financial obligations". Do they have any right to force me to pay this fine?
