Temporary civil protection order

so this will not fall under criminal, is a lawyer necessary for when i go to the hearing, do i just tell my side of the story and can the party that filed it rebut in court?? also my 11 year old daughters name was in the description of why our neighbor is filing because she stuck her tongue out at the neighbors child

should she come to court as well?

It's impossible to advise whether you need a lawyer, because you give the impression that the substance of the protection order is that your daughter stuck her tongue out at the neighbor's child. That may not be the most ridiculous claim to get a protection order, but it's got to be close.

That said, temporary orders are exceedingly easy to obtain, and usually are granted without even the presence of the defendant. So if what you mean is that a temporary order already is in place, and the hearing is to determine whether it should be made permanent, by all means bring any witness you have, and a lawyer. Is a lawyer strictly necessary? No, but they generally can be a comfort in a fairly nerve-wracking arena, assuming they can stay awake and show up sober.

Good luck. And for heaven's sake, advise your daughter not to stick out her tongue at the judge.
