If you didn't have an attorney, that is the problem.
If I represented you in the deposition, I would have objected, and advised you not to comply until the dispute was resolved by the court. If the lawyer insisted, the attorneys would have called the court.
Now, the only thing you can do is object to any use of information during that time. Again, the court will determine if what the lawyer did was appropriate.

If you have the car, then you can file a quiet titel action to hav the court order the the Department of REvenue (DMV) issue you a clean title. If my mother turns over the title of this house to me will I still be under the Prop 13 umbrella or will my property taxes be raised? If so, how can I avoid this in the transfer of the property? There is a parent-child transfer exception to the Prop. 13 re-assessment rule. However, that is the least of your tax worries. First, there is a good chance your mother would be liable for gift tax on the equity in the house unless you pay her full market value. There are lots of loopholes in the gift tax law, and sometimes there are even temporary periods where the legislation expires. So you might dodge that one. The real killer though is the loss of the stepped up basis. If your mother transfers it to you while she is still alive, you get her capital gains tax basis. If you are asking about the Prop 13, it seems safe to assume that there is significant appreciation in the property since she bought it. If you are given the property while she is alive, whenever you go to sell it you will be subject to capital gains taxes (currently about 25% combined state and federal) on the entire appreciation (over the $250k exemption) since she bought it. If she puts it in an inter vivos trust, gives it to you by will, or otherwise arranges for you not to receive title until she passes, you only pay capital gains on the increase in value between the value when you get it, and when you sell it. So if she bought it for $100k, gives it to you now, and you sell it for $750k in the future, you will pay $100k in taxes (750-100 basis = 650 gain. 650-250 exemption = 400 taxable gain. 400x25%=100). Whereas if you receive it when she passes you get all of the appreciation up until the day she dies, plus another $250 in exempt appreciation, tax free. AND the Prop 13 exemption will still apply. One last thing I should also warn you about. The top two reasons people consider doing a gift transaction like this are to avoid creditors, or to qualify for benefits. Both those kinds of schemes are illegal and can cause a great deal of trouble and expense for both the parent and child, on top of the gift being voided by the courts. Not saying that's your situation, just a warning out there since this question and answer will be available to the public.

The parent-child transfer exemption was created by Proposition 58, and can be researched under that heading on the Board of Equalization's or the L.A. County Assessor's Web sites. The exemption from reassessment exists, but is not automatic, and you need to follow the assessor's rules in order to get it without a hassle later on.
However, the arguments against transferring appreciated property, or property likely to appreciate between now and the time your mother passes away, are pretty strong. It's worth studying and understanding the example in Mr. McCormick's answer, and doing the necessary family planning to minimize all taxes, not just property taxes. Property inherited by will or trust is also exempt from reassessment and has other tax advantages.

For property, you don't really need a restraining order - trespass law will generally suffice. If you are the propery owner or have some other legal right to the property i.e. a tenant, you may simply verbally inform the person not to come onto your property (you may want someone to witness that) . You may also inform them in writing (again you'll want to be able to prove it so sent the letter certified mail with a restricted delivery). If they do, then you may seek an order for arrest from your local magistrate. At Court, if the person is found guilty of trespass the Court will generally order the person not to go back onto your property as part of the judgment. If they trespass again after being ordered not to by the Court there is a whole host of nasty things that your local Disrtict Court Judge can do.

I do not believe your mother in law can gift the equity to you without paying the taxes. The trust is like a corporation, it is its only entity and has its own rules that apply. They are suing you to eliminate any right you may have to the property. If you have no right or do not want to have any right, then you need not appear and defend. Whether the loan was correct or not cannot be determined without additional information. There is nothing inherently wrong with loaning someone more than a property is worth. Not smart for the lender, but that is a decision of the lender.

That sounds like your son might have a claim for ineffective counsel. Whether it was due to the PD and DA dating or the PD was just a lousy lawyer makes no difference. That said such issues need to be taken up on appeal. There are time limits as time when you have to make an appeal. So that may come into play. Based on your description of events the conviction was not recent. So you maybe too late to make an appeal.

At the time we bought the house we received an affidavit to the effect that there were no easements or attachments to the property and an older survey showing the layout of structures on the property gave no indication that our neighbors porch was encroaching on our lot by about six to eight feet. The porch seems to have been added on to his house after the survey and is basically a simple protrusion off the end of his house.
My question is; do we have any legal remedy in the event our neighbors are unwilling to cooperate should I approach them with the offer of fixing the encroachment with my own labor and resources? As time goes by we would like to improve our property and increase it's value and there is no doubt in my mind that the present encroachment devalues our property as well as theirs by decreasing marketability.

You need to get a real estate lawyer to deal with this unless the neighbor agrees in writing to remove the encroachment and does remove it. Before you do that, do a survey now to make sure there really is an encroachment.

My name is on the title for 5% of the property. Another woman owns 20% of the property, and is not a borrower either. We both provided the cash down in return for a percentage of the property (and the right to stay there whenever we would travel to Southern California).
Now the borrower, who owns 74.5% of the property, has a loan balance that is greater than the current value of the property. He lost his job last fall and can no longer make payments. He would like to sell the house in a short sale. If that doesn't work, the property will be foreclosed.
Since I did not co-sign the loan, am I at risk to have my credit damaged? Is there greater risk if it is a foreclosure versus a short sale?

If you are in no way connected to the debt, it should not affect you in any way. In fact, if your interest in the property recorded before the debt, then the foreclosure will not even affect your interest in the property. If it was recorded after the deed of trust, you will be wiped out by a foreclosure. What you can claim and how to claim it as a loss in that case you should ask a tax accountant.

If the property title was held as tenants in common, with interest in the property specified by percentage, prior to a deed of trust, then a foreclosure would end up with either the lender or the person purchasing at the foreclosure sale becoming a tenant in common with the other owners who did not sign the deed of trust.

We should talk. This board is no way to deal with this. Self-help is not a good idea, especially since Arizona has most, but not all, of the trigger-happy "defenders."
Without background on the situation, I can't give you advice, but I can tell you that in the absence of detailed info, I would likely come to the residence or abode of the people who gated the easement. I would give them a copy of the easement. If they do not remove the gates or give up a copy of the key, I would simply leave and file the lawsuit.

Depends. If the debt is from a contract, there is a 3 year SOL from the date it was due. If the contract was signed under "SEAL" then there is a 10 year SOL. If the debt is due to negligence or wilful conduct (say, malpractice, wrongful death, etc) the SOL will very. In general, MOST debts have a 3 year SOL, but it would depend on the particulars of your situation.

Co-executors of a will or co-trustees are different. NC does not recognize co-agents for health care. A health care power of attorney concerns decisions for healthcare. A doctor does not want two different people yammering at him or her with possibly different decisions (example - should mom have surgery or not, son says yes and daughter says no and both son and daughter are co-agents).
Personally, my philosphy is that there should be one captain of the ship so to speak for everything. The reason is simple - do the co-executors or co-trustees agree on everything all of the time? The answer in most cases is no. A situation arises where they have different decisions or wishes as to what should be done. In such case, who has the final say so unless there is a mechanism for resolving disputes in the will or trust? To avoid problems, one person should be in charge at all times and have final decision-making party. That is not to say that the executor or trustee should not consult with or get help from anyone else. He/she can and should especially if they are related. But there should be only one boss at a time.
I will do this if a client requests, but I try to discourage people from naming co-executors or co-trustees.

I thought the case was set for 9:30 am but it was scheduled for 9am. I showed up at 9:20am. Can I file a trial de novo even though I lost by default? If so, will I have to have an attorney to try the case? The small claims case judgement ordered me to pay $1050. They tell me the cost to file an application trial denov is $200. I'm not sure it is economically worth it to file. I have to file by tomorrow to be within the 10 day time limit.

Where is the EGR valve on 2005 Dodge Dakota?
This Dodge EGR valve is a certain kind of device that is mounted right on your intake manifold which controls the amount of exhaust gasses back into your engine. On a 2005 Dakota with 4.7 liter engine (non-HO), the EGR valve is located near the intake manifold on the driver's side right up against the firewall. It's hard to spot as it sits lower than the intake manifold. To change it, remove the electrical connector. There's a red tab that needs to be pushed to one side and then you have to squeeze down on a tab to get it free. Using a 13 mm socket, remove the bolt that you can see. I had to use a 3 inch wobble extention and then a 8 inch extension with a deep well socket to reach it with my 3/8 inch ratchet. There's a second bolt that you can't see between the EGR valve and the firewall. With a little trial and error and a lot more luck, you can reach the hidden bolt with the 3 inch wobble extension and a 13 mm deep well socket. Attach the ratchet after the socket is on and remove. This one isn't easy and if there's any Dodge engineers reading this one, a couple of extra inches of clearance between the valve and the firewall wouldn't have killed you no matter what the cost accountants said. With both bolts removed, you should be able to pull out the metal pipe that connects the manifold to the EGR valve out of the manifold (Pull to the right) and then you can lift the valve out. For assembly, the metal pipe connecting the intake manifold the EGR valve has to be removed and reinstalled on the new valve. It's held on with 2 5/16th" bolts. You should put the rear bolt on tight, but leave the front bold loose for the reinstall as some adjustment is necessary to get it put back together and the rear is a pain to tighten when installed. Line up the bolts that attach the valve and get the rear 13 mm bolt (The one you couldn't see on disassembly) started. Do not start the other 13 mm bolt as you'll need to pivot the valve and pipe to the left in order to reinsert the pipe into the intake manifold. Once the pipe is in the intake manifold. Start the other 13 mm bolt and tighten both 13 mm bolts and then the 5/16" bolts holding the pipe onto the valve. Reinstall the electrical connection. Took me and a good friend about 2 1/2 hours. With these instructions, you should be able to do it in about an hour or hour and half. It's a major pain to change because of the tight space that the valve fits into and the less than generous clearances around the firewall.u find it dumbo

However to my dismay a few months ago I received an e-mail from him with a link which advertised for, illegal in the USA, Canadian drugs and pharmacies.I began to suspect that the attorney was somehow involved in illegal advertising and sale of medications or any other goods and that he sold or passed my personal information to these channels. I appealed to the ARDS and the attorney responded that his e-mail was hijacked.As a "proof" the attorney produced a few e-mails from his "friends" and family members whom, he claims,"were targeted by those illegal advertisers." However I don't believe it because,apparently, this attorney did not report his e-mail being hijacked to the Police. Also he did not inform me that his e-mail was hijacked when he first found out about it a few months ago. In any case all of my personal information such as name, address, Social Security Number,e-mail address, and all communications with that attorney regarding my case was stolen and maybe used by those criminals. I believe that by his actions the attorney breached a client confidence, did actual harm to me and also raises suspicion that this attorney is involved in some kind of Criminal activity. Did the attorney violate the Law by his lack of action to report to the Police the hijacking of his e-mail and investigate the crime and also his failure to properly secure the information of his Clients?

The "fact" that some internet hacker managed to hijack your former lawyer's email addressbook does not mean that they have gained access to your personal information at all. Bill Me Later did a fraud investigation and denied the allegation. I called the place where the purchase was performed and no record of this charge exists. I mailed Bill Me Later a dispute letter. I spent 3 hours today talking to Bill Me Later and the store where the charge was created. No one can help me. Meanwhile, I keep incurring late charges and interest. The bill is now $140.06. Do I pay the bill now and try and fight to get my money back, or keep trying to fight with the companies to clear the charge?

There is no difference legally once you're married. If you go to settlement before the wedding, you'll get a deed as an unmarried couple, either as joint tenants or tenants in common. After you get married you should re-write the deed to yourselves as tenants by the entirety, which acknowledges your marital relationship. As a real estate attorney, I've done this many times for couple in your shoes--it's quick and inexpensive. Or, depending on when you sign a contract, you could just wait until after the wedding and take title as a married couple.

There's no reason not to wait until after the wedding. Why go through the time and expense of property and then re-deeding it to yourselves as a married couple? And while I'm sure your relationship is rock solid, I've mediated disputes between folks who have purchased a house together in anticipation of getting married, but never walked down the aisle for one reason or another. You can't be forced to work any hours but your employer must pay you 1.5 times your regular rate of pay for hours over forty if you are not exempt from the overtime and minimum wage provisions under the FLSA and Texas Payday Act. If you are exempt from the overtime provisions then you do not have to be paid the overtime rate of pay. If you choose not to work the hours your employer has assigned then you can be terminated unless you work under contract that limits your hours.
So the bottom line is unless you work under a contract that limits your hours your employer can demand you work as many hours as there are in the week and it is free to discipline you for failing to work those hours.

Generally you will want to open up an estate to deal with any assets or liabilities only in the deceased person's name. If your late husband did not have enough assets in his name to cover all the expenses the law says what order the bills get paid in but they are not ordinarily paid by the surviving spouse. Unless someone else's name is on the debt the debt should be resolved in the estate. The lender might have a right to repossess but that is a separate issue.
Ordinarily a spouse does NOT continue to pay medical expenses or other debts of the decedent if the estate is insolvent (that is, if the estate doesn't have enough money to go around).

You need to discuss this with your father. He should be very concerned that his child is suffering while his ex is vacationing. Also, you are entitled to have your college costs (not only tuition, but also living expenses) paid for by your parents. Assuming your father is as outraged as you are, he can go to Court to get some fairness here. If he is not interested, you can retain your own lawyer to do so. Then 2 months ago my team was told that the whole team- 25 people- would all be losing our jobs and our work was being moved offshore. We were told we'd be let go in phases and that we'd receive at least 30 days notice, more if possible. We all scrambled to find other jobs in the company but becasue we're downsizing all over, all hiring is on hold. So many of us have looked elsewhere and I just found a new job and gave notice. Basically, 2 months ago my team was told we're all being let go, just not the exact date. In this instance, what constitutes notice? Was it when they told me we were being let go, or would I have to wait until they actually gave me a piece of paper with my final date? The wording in the promissory note is vague and I'm planning to make the argument that they eliminated my job and are sending it away and they told me as such and that's notice enough for me. Do I have any legal standing if they decide to pursue in court?

The company gave you a lay-off notice and you found a new job, I think you have a good defense to the terms of the note. They informed you, that your work was being transferred to another country, and that you would be laid-off at some point within a year. They did not ask you not to look for work elsewhere or to stay pending your lay-off period.
They might not give you severance, but I think you complied with the intent of the note and the agreement.

If you have conditional residency now, then you must file to remove the condition within 90 days of the expiration of your conditional residence card. If you are no longer married, I would highly recommend speaking with an experienced immigration attorney first, since you would need to file for a waiver of joint filing, which is more challenging than it may appear.

Maybe. Who owns the policy? If he is the owner, not merely the insured, it seems to be one of his assets that a creditor can reach. If the rent was to be paid monthly, the law presumes you became a month to month renter after the original lease period. you shoudl reread your lease agreement to see if it automatically renewed. If not, you are not likely ob;igated to pay any rent one month after you leave or give notice of your intention to terminate the month to month lease.

I have a primary residence I obtained free and clear in a divorce settlement this year that was financed in joint name with ex. The home has a 1st and 2nd mortgage that is 78% of the total appraised value of the property ( conservative ) I have been ordered to refi the property in my own name or else it will be sold. I have talked to the current mortgage holder and asked them to let me assume the exisiting mortgage with a quitclaim deed from my ex spouse. The original mortgagor ( 2003 ) sold this loan to a big bank a few years ago. The bank just got licensed a few months ago to do biz in Illinois. I asked the bank to help me and they said they could not because my DTI was too high ( due to credit card debt from the divorce bills - my score is now only 650 ) and they could not use the existing mortgage, they'd have to write a new loan. Is there any leverage or help I could get with an aggressive legal approach with representation to get the bank to reconsider in Illinois? I am sure i can continue to make the mortgage payments on both 1st and 2nd mortgages.

There is not anything you can do to force the bank to release your ex-spouse and allow you to assume the loan solely. Suggestions: (1) Consider whether there is anything you can do to handle some of the other debt. Are you expecting an income tax refund that may allow you to pay off certain bills in full, thereby reducing your required monthly debt payment? Would consolidation help (be careful not to make matters worse, however, with a high interest plan)? (2) Approach the lender again, either after you have taken steps toward Option 1 above, or simply try again, politely, to ask for the matter to be given further consideration. Perhaps another representative or supervisor would look at it differently. Perhaps you can offer additional funds to reduce the balance if you have anything available. (3) Have someone else join you as a co-signor. That person, however, should be advised by an attorney about the ramifications. (4) Refinance elsewhere. A well-recommended mortgage broker may be able to assist you. Sometimes, you will fare better with a small, area lender that keeps their loans in house. (5) Request an extension in your family law case that will allow you to pay down the loan a little and perhaps resolve some of the debt that is creating ratio issues. (6) Consider bankruptcy to eliminate other debt and reduce your ratios. This is a difficult analysis, however, as some lenders will look at it as a positive (you have reduced your debt load), but others will use it against you (your credit has been impacted by a bankruptcy filing). (7) Approach the department of the bank that handles loan modifications and see if they look at it any differently than the others you have been approaching (unless it is all one and the same). (8) Can you make any improvements to the property at modest cost to increase its value and make a refinance more likely?
Note, some of this may depend on how amicably you and your ex-spouse can handle things or how the family court judge would look at things. Are there children involved that the home will benefit now as far as you having a place and years from now as far as you maintaining and gaining the equity? Is your ex-spouse hoping to do something soon where having this on the credit report is limiting? Can you offer cash in a few years from the equity that is likely to be gained?
