In an answer to petition for dissolution of marriage if I say the marriage is not irretrievably broken how might this affect the judgement?



Answer

It will increase the costs of litigation, but might save your marriage. If the parties disagree that the marriage is over, the need for mediation is greater. Denying that the marriage is broken won't prevent the Petitioner from getting a divorce, if they continue to want one. It just makes the case go forward in a more contested manner.
