Question

my ex wife has full custody of my seven year old daughter. I pay child support and have visitation rights to see her as per our divorce decree. my ex wife has informed me that she intends to return to California with my daughter on a permenant basis. we all presently live I Arizona. my question is does she truly have the right to take my child out of the state without my consent or the court system? also how does this effect me paying child support?

Answer

You need to act immediately. You want to file a Notice of Objection to Relocation, and request a hearing to prevent her move. I would also suggest filing an underlying Petition to Modify your current Order as if Mother does relocate, you can seek primary custody of your child, here in AZ. I would however need more on formation regarding your specific case. We offer free consultations for up to 30 minutes. Feel free to schedule if you need further assistance. 623-748-8973
