Question

in san diego california, family court, how whould i ask for a reconsideration of a motion? based on facts and evidence that was not available at time of the hearing.

Answer

Reconsideration is granted for a very limited time and for limited reasons. You will need to file a motion with supporting declarations and a memorandum of legal authority for the judge to grant the motion. I would suggest that you get some good legal advice before your time to ask for reconsideration has expired. Good Luck, Pat McCrary

Answer

When? You are probably past your time already, so immediately. How? By filing a motion for reconsideration as Mr. McCrary said. Also, if you don't have a lawyer, count on losing. Most lawyers can't even get a motion for reconsideration granted. A lay person doesn't have a prayer.
