Can a court restrict a persons only source of income? Such as a disabled person not on social security, not being allowed to have people rent rooms due to weekend visits by a child under joint custody.



Answer

I don't think the court will tell a person not to rent rooms. A court may have concerns for the child's welfare and safety in a household full of strangers. Being a landlord is not necessarily the safest way to make money. As a long-time landlord, I know the kinds of threats and damage tenants can make.

Moreover, you may be violating the law if you are renting to too many unrelated people as zoning ordinances and land use regulations were created for safety concerns (i.e. To reduce fire hazards, traffic congestion, or to maintain public services based on population density, etc.).

Some judges would say you should consider welfare or other sources of income.
