Can I be prosecuted for slapping someone on board a bus? The person I did this to wants to file charges against me, and I'm worried. I did this because this person deliberately bumped into me in a crowd, then slapped me after I confronted him about it. The next night, I saw him on another bus, smacked him lightly, he chased me out of the bus, knocked me to the ground, and kicked me in the head. Ten minutes later after me and a friend left the bus, this person (whom I know and had stopped speaking to a month ago) came stomping down the street brandishing a scissors and threatening to stab me with them. After nearly a half-hour of this person threatening me, he left, and then left hateful voice mails saying that he was going to get me again first chance he got. My question is, can he actually have me locked up merely for smacking him? Because what he did falls under assault itself.
Answer
Under the law, you are both guilty and should be charged with assault. Him with a weapon. The police may just ignore it if they weren't called to the scene right away. Tim Klisz kliszlaw.com
