I recently modified an existing child custody order giving visitation for 8 weeks, instead of 2 weeks, during the summer to the non-custodial parent. In the previous court order, he was required to give a 60 day notice of election of dates for summer visitation, so I (the custodial parent) could plan accordingly. I assume that he is still required to give this notice, as the modification just changed the length of time spent at the non-custodial parent's residence. However, as the children's summer vacation begins in a few days, I still wait for a request for summer visitation dates, although we are moving out of state in one month and need to know; and he is unwilling to acknowledge my requests for this information. Do I now choose the dates for him, or does he forfeit his visitation?

It depends on exactly what the new order says. Some orders state that unless otherwise modified, all prior orders remain in full force and effect. If your current order does not state that, then that can become an issue. I suggest that if you don't have counsel, that you retain one. In fact, you that that you are moving out of state, do you have a move-away order from the court allowing you to do so?

I had to read your question several times to figure out the capacities and actions of the various parties. It's still not clear to me what your mother is asking in her lawsuit against you, nor why or how title to the property is not held as joint tenants.

Also, if you are a defendant in a lawsuit initiated by your mother, who is represented by a lawyer, are you represented as well? You should at least be familiar with the laws protecting the elderly against financial abuse and allowing accelerated court proceedings in some cases and situations.

It isn't the borrower who forecloses, it's the lender. I assume you mean "I'll allow a foreclosure to occur against me (or us?)" rather than "I'll foreclose."

While I don't have any information about the first suit, I see no reason why a suit for partition couldn't be filed and run concurrently with the existing suit. The court might consolidate them for efficiency.

The realtor may not be correct in that the notice of title issue should be raised on or before the closing date. Nevertheless, if you agreed to change the closing date you might have to extend to 0ctober 19th. I strongly suggest you contact a real estate attorney in your area to review the documents you signed. You could take the position the 30 day extension expires 10/6/15, but there is no additional extension to close if this goes past 10/19 regardless.

Do not sign any more extensions to close without having the documents reviewed by an attorney.

Who is the closing attorney? I would contact him immediately to determine the status of the title and if you do not have your own attorney I would get one to review the documents and assist you with this matter. If the closing proceeds make sure you buy owner's title insurance.

The state "Rater" takes the Whole Person Impairment and converts it to a percentage of Permanent Disability. If the WCAB Judge tells the Insurer to pay that amount of Permanent Disability, that's what the insurer pays.

If the insurance doctor writes you have only 3% Whole Person Impairment and the Rater adjusts that for Age and Occupation and claims that the doctor's findings equal 6 Percent Permanent Disability, that's the LOWEST the adjuster should offer for a Stipulations with Request for Award.

Then if the Treating Physician (or the Panel QME) writes there is 25% Whole Person Impairment and the rater adjusts this out to 44% Permanent Disability, THAT's what you should request at trial... HOPE THAT HELPS A LITTLE.

The sand was supposed to have washed away weeks ago before this event, but it had not. The whole road was coated in this thick sand as well. The sheriff arrived on the scene, inspected, and took me the accident was technically my fault, but the sand is what did me in. He also took a picture of the sand with the tire marks. It is two months later, my family is out the money for a replacement car, and the sand is still on the road quite heavily. Infact, it is on almost all of the county roads. The sand has been a problem for many years in my county. A few years ago, some teenage girls were killed by the sand while driving down a steep hill. The sand has thrown my brothers car off before, although he was lucky to have not wrecked. It poses a great danger to motorists, yet the highway department will not clean up the mess they have created.

So hear is my question; How might I go about filing a small claim against the county highway department? I am an 18 year old male with a crystal clear driving record, and have no criminal history. The sheriff did take a photo of the sand and wreck, but the actual speed of the car was not recorded, although the sheriff estimated the speed to ahve been only 20 mph. The car I had could have been sold for around $6000 pre-accident, so I plan to sue for just that. I also want them to clean up the sand, because it is still very dangerous. Whenever there is sand on the state roads, the state highway department cleans up the mess, so why shouldn't the county highway department?

The terms of the agreement and payment should have been spelled out in advance, and in writing. If they spelled out that this was a work for hire, you should sign the agreement. However, oit sounds like you had an oral agreement only.

While the website -does- sound like it should be treated as a "work-for-hire," allowing ownership to go to the attorney, it does not sound like the attorney required this before you proceeded. Thus, the attorney is playing a game of "oops" hardball.

Your options are to sue for the fees due and let a court decide, or to sign the agreement. Because this seems like bad behavior for an attorney, I actually might tend to vote with filing a suit, especially if you can file in small claims.

If the will is silent and the deceased just made a gift then probably not. However, any attorney would need to review the entire document and know what the state law said, if anything about advancements.

Sorry but I am not sure what 3 eviction processes you mean. 3 Day notice to pay rental, 100% successful if no rental is ever paid. Termination of lease is 100% sueccessful if done correctly and based on the contract or law. Removal of holdover tenant is also successful as long as rules are followed. If no assistance givenin the completion of some form then leave it blank. Not sure what form you are referring to so hard ot know if notary needed.

I have a team of dedicated programmers/partners who I have known for a couple of years but only recently met face to face to discuss my concepts and ideas. We all signed Non-disclosure agreements, but no business contracts.

My question is that I am not sure as to the relative percentages of ownership between us. The whole idea/concept and business leg work is from me. They, as of now, have had no creative input but just the technical aspect of programming.

Should we be equally split? Or, as I have cultivated the concept for many years, do I have the right for a higher percentage?

With that saying, it brings me to prices and how they are structured. I would like to know how much it typically costs, to hire a laywer, for a situation like this.

Hello, Anne:

The question of ownership interests is entirely a matter of negotiations. As the creator of the idea, you are essentially in the driver's seat as to what to offer the others. Indeed, there is no law requiring you to offer any kind of ownership split. The programmers could be kept as employees, for example. You could certainly request a higher percentage than everyone else, or even a majority interest.

Each arrangement between you and the others involved has its advantages and disadvantages. The arrangement that makes sense for you can only be determined after some lengthy conversations about contributions to the business and future plans of everyone involved.

Your attorney's fees and costs will depend upon the complexity of the situation. A good attorney will not be afraid to estimate his or her fees whenever possible. Flat fee services are usually available for services and documents where the attorney can estimate fairly well how much time is required for the documents that must be provided. For instance, most attorneys can give you a flat-fee quote for creating a corporation, or for a standard 50/50 split between two people in a partnership or joint venture. Your situation sounds more complicated than that, however. Once you give the attorney an idea of what is involved, he or she should be able to provide at least a ballpark estimate of your fees. I would guess that a structure where you are the sole owner of the business and the others are employees would be less expensive to structure than a complicated LLC or corporate structure with the necessary shareholder or intra-ownership agreements.

You should also consider the investment of properly documenting everything as an investment or form of insurance, so that everyone is as clear as possible as to the terms of the relationship. It is much more costly to deal with a problem later on, when you have to resolve a problem arising from an oral agreement with people having vastly different recollections of the terms of the deal. You are also investing in the relationship with an attorney that you will likely need from time to time as your business develops and grows.

I disagree with Mr. Perry. The bare bones and rather vague facts you present in your question most certainly do not point exclusively to you being the owner and the others having no ownership other than what you negotiate with them. In fact if they have been working on this project doing programming without compensation, you are probably WAY better off dealing with them as partners, rather than anything else, because the other default option is that they will claim to be employees owed unpaid wages and overtime, or worse, independent contractors who own their work product until you pay for it. If you are serious about making a real business out of this, you need to get an attorney on board immediately.

I agree with Mr. McCormick to not treat them as employees as you may face a mutiny on your hands. I agree to treat them as partners to a degree, but not to forming a partnership with them, rather I recommend you form an S-Corporation and they would get shares issued to them to become part owners in the business. As an S-corp it would be like a partnership as the business is not taxed like a corporation as is a pass through (note California does have a 1.5% tax on distributions, whereas the IRS has 0% which is insignificant). Note there are annual taxes to the state with creating a business entity. But with an S-Corp, which for you might be what you're after, if you create a great product and some other company wants to buy the company you all would get bought out for your respective shares. With a partnership you could have a lot of trouble in that case. Otherwise the shares control the distributions. If you have 10% of the shares and do no work, you still get 10% of the profits. Thus if someone does 90% of the work with only 10% of the shares they still get 10% of the profit.

My cost of legal services for setting up the S-corp, issuing shares, articles of formation, etc. would be $1,500 (which is inclusive of the state filing fees). A partnership would be $1,000.

Since the damage was very minimal and barely over my deductible, I decided to close the claim and not have any of the repairs done. Two months after informing the roofing company that I closed the claim and that I will not have any repairs done, the roofing company sends me a bill for their "services"--initial consultation, estimate preparation and meeting the adjuster to look at the damage to the roof.

There is no requirement that a lease be witnessed by a notary. A notary is simply an individual that has been appointed by the state to act as a public witness. The validity of the document is not dependent on a notary having witnessed the signing and is enforceable between the parties.

As to the responsibility for the remaining rent, the short answer is yes. The landlord is required to use their best efforts to re-rent the property on your behalf however.

Principal of paying one's debts seems to be your problem. There are NO quick answers to your questions. If your husband has funds which will be yours after a Court order, then yu can pay debt. If not, and a choice of taking children elsewhere..is yours OR staying in house until legally evicted which means you still have the legal and possibly moral obligation to pay. Your employer cannot force you to work beyond the authorized doctor's restrictions. You need to consult an experienced Kansas workers compensation attorney asap. Based on what you have said, you should file an Application for Hearing, Application for Preliminary Hearing and get a order from the Workers compensation judge that the employer must offer you accomodated work within your restrictions or pay you Temporary Total Disability benefits (2/3 your average weekly wage) until your doctor releases you.

You are correct in getting a court hearing to check up on the status of your case. If your husband won't finalize the papers because he doesn't agree them your only option is to go forward on a contested basis for a trial. Sometimes people think that the other party is in agreement when they are actually not in agreement. You should probably consult with a local attorney to see what stage you are in, and to see how to get orders on a contested basis.

There are considerations to look at to determine what best works for each client. These concerns, however, are more the exception than the rule. The important thing to remember is that one size does not always fit all.

If you go to trial, you risk being convicted of a felony, but if you plea bargain, pay up front restitution for any injuries, have a clean record and can convince the DA that you deserve a break, your age would often permit a disposition where a misdemeanor record could be expunged following successful completion of your sentence. Do not count on mercy (or expungement) from either the judge or the jury, however, if you go to trial and lose. You are not a tenant; if anything you are your boyfriend's "subtenant". So his room mate could start evicting you, in part depending on how the lease is drawn up, which an attorney should look at. In situations like this, however, people in your position are normally considered like month-to-month tenants and therefore "30 days notice" is required. There's the EEO too, but that directly would probably take more time. Depends on how the fuse was blown in the first place. Maybe a short? But usually, no. Unless it is the main battery fuse, 80 AMP or higher, I wouldn't worry about it. If the fuse is screwed down, I would remove the batter cables just to be sure you do not accidentially arc a screwdriver.But otherwise, if it is a smiple 20 Amp fuse in the fuse block, go ahead and change it without removing the battery cable. If it blows as soon as you insert a new fuse, or activate what it was you were using, I.e. cigarette lighter, figure out what is causing the fuse to blow. Just make sure the key is off is the safe bet.Under no circumstances should you ever use a higher rated fuse than called for. It has the potential to melt wires and start a fire. I.e. Don't use a 30 Amp fuse in place of a 7 Amp if the 7 Amp keeps blowing.

My ex husband is taking me back to court for custody again third time in 6 year each time a new reason to show I am an unfit mom each time proven wrong. Ok latest accusations are he states in his declaration that school officials have approached him stating their concerned that I use drugs, I am parent volunteer so this upset me so I emailed the school principal and she responsed with no that school if they had concerns would call CPS and not approach an ex spouse. Is this blantant lie by my ex to smear my name allowed could that fall under perjury?

Also my son was been late to school by under 5 minutes 14 times this year and they are all on my days...so I dont argue that needs to be improved but I had no idea it was this much...I walk my child into school and before they head into class they run around the soccer field 2x. I was under the impression that as long as the gates were opened and we got to school in time to run we were on cutting it close but still made it on time...I emailed the school and said I thought we were only late if we got a tardy slip through the front office....the principal said that teachers can still mark the kids late if the gates are open., Ok so know I know...but do you think my ex will win his request to have our child moved to his school district because of this situation which I agree needs to be better but now its been addressed with school and I can fix it ...

I like to note that when I thought we cutting it close to being late but thinking we just made it is also because the parking lot is filled with parents still in line dropping thier kids off and lots of kids still going in through gate....the Vice Principal even told me the school has a lot of kids with tardies and I think its for the same reason......my child is in Third grade and all his latest progress report said he was doing an amazing job and improving and got satisfactories in everything ....I also have many emails from teacher saying how well our son is doing.

Also the current order states that child shall go to school in moms school district because father is more focused on negative attention towards mom than the welfare of the child.....I am a good mom not perfect but really a good mom I volunteer at school all the time...I am not worried about the drug abuse allegations thats easy to prove....but the tardies that the worst thing I have done ....please give me some advice on how to handle my response to the judge from what I wrote in this letter.

It may be a good idea to file a declaration with your response. His statements are hearsay until he brings in some proof other than "somebody told me...". The tardies do have to get under control, but your story sounds reasonable. You can show that judge that since you were put on notice that your behavior was going down on record as a tardy, there have been no further tardies (I hope). If nobody has said anything to you from the school, how would you know until he brought this up? Did he ever mention the situation before filing this, or was he just saving up ammo?

Focus on how well your child is doing, the friendships and stability his present situation give him, and how disruptive a change of school and teachers would be for him. Agree to a test that you will pay for if you test dirty, but he pays for if it isn't. The Court's purpose isn't to punish a parent for doing something wrong. It is to do what is in the best interests of the child. Reading this, it sounds like he is STILL focusing on negative attention towards mom...
