I took my car to an auto body shop for repairs recently and my car was stolen because the shop left my keys in the car my car unlocked and the gate that should secure the car was also left unlocked. His insurance has assumed responsibility but I am going through pain and suffering due to this. Can I sue the shop for negligence and/or pain and suffering?

No, your pain and suffering are not compensable under these circumstances but only compensatory damages, i.e., the fair market value of the car at the time of

its loss (in my opinion).
