As I am aware once I turn 18 I am legally obligated to cut relations with my girlfriend. I was told there is such thing as a parental consent form from both parties that allows the relation. Does this exist? Her and I do not want to be separated for the 3 years until her own approach to legal age. Do you have any advice?

You are mistaken. If you mean sexual relations, there is no difference between being 17 and 18, it is still statutory rape, and if you are having sexual relations now you are both guilty now. The only difference is that once you are 18, she will not be guilty of statutory rape too. (Yes, it goes both ways, younger and older, male and female, if your partner is under 18 you are guilty no matter how old you are or your gender unless you were physically raped). Parents cannot consent to their children being statutorily raped. They can consent to a minor's marriage. I believe the minimum age for that is 16. That is the only way to make sex with a minor legal. If you only mean romantic relations but not sexual, then you are also wrong. Non-sexual romantic relations are perfectly legal between an adult and a minor as long as no other violations occur, such as contributing to the delinquency of a minor or child endangerment or something like that.

I feel my civil rights were severally violated in this matter. How could a person be found guilty when he had no notification whatsoever from the court of a court date. All communication from the magistrates office to me has been by registered mail. Once again I received NO notification of the new court date but I did show up in court on the date I was supposed to. Well you have the right to appeal. If it's a civil case you get a trial de novo in Common Pleas Court you have 30 days to appeal from the date of the decision. If it was a summary criminal case you can appeal that as well.

We are still separated now, due to the fact that I cannot afford to pay for a divorce, and he hides or flees the state and refuses to financially do ANYTHING. Court ordered child support was included in the separation agreement, and it has been active since the signing of the separation papers, though he has only ever paid twice. He was behind from the get go, refusing to pay the very first month. He started out 3 months behind and paid to get rid of the warrant. The 2nd time he paid was 8 months later, he had been arrested and had to pay in order to get out of jail. He also told the judge that he had re-enlisted into the military and was being deployed. TOTAL LIE!

That was 10 months ago. He had another warrant issued a few months after that, unknown to me at the time, he has ran to California, gotten in trouble and was/is facing alleged charges of impersonating a Police Officer, assault with a weapon, and wrongfully detaining people. (I called out to CA and talked to the station myself). My husband has been back in this state though, since at least 4 months ago. I have photos with time stamps to prove it, taken and given to me by a friend of his family.

About the time my husband took off to CA, we had had a court date, concerning his non-payment of child support again. The judge issued a bench warrant and when I inquired about his not showing up for visitation those previous months, she stated that she wasn't going to make me care anymore than he does. She told me I didn't need to continue to drive to our transfer location, and she suspended his visitation.

All the phone numbers I had for my husband and his family have been disconnected, they are never at my husbands parents home (where he was living), and I was verbally attacked and cussed out in an email from his sister out of the blue several months ago, where she also stated that she didn't know where her brother was, and wouldn't tell me even if she did know. (This was a month before their friend showed me the photos)

Over the course of the past 2 years, my husband has sent me emails and texts stating that he will sign over his rights to me if I drop child support. Of which when I try to reply to the emails, I find that they are deleted accounts, and before he changed his number, I was only met with yelling, and threats anytime I returned a call.

I'm tired of his verbal attacks, hiding, and in my opinion, abandonment. (He hasn't seen his son since December 2009).

My question is this:

If I can scrape up the money for a lawyer to initiate/complete our divorce, will the judge allow me to take my husbands rights?

I honestly have no clue if/how he will be served or if he would show up or respond to court.

The Court has the ability to terminate a parent's rights if you can prove willful failure to (a) visit the child or (b) pay child support for six months or more. However, just because the Court has the ability to do so does not guarantee that it will. For instance, the Court could suspend his visitation but still require him to pay child support.

Lack of a will is not, in itself, indicative that no probate proceeding is necessary. Some degree of formality of proceedings is required for all but small estates. Where the decedent owned real property and had a mortgage, the assistance of an attorney with probate experience is almost certainly going to be necessary to avoid a mess down the line. I'd guess that someone needs to petition the local court for formal appointment as the estate's representative, and should do so after consultation with an attorney.

Legally, if there is a will in the wife's possession she must file it with the Clark County court. However, wills are usually not filed unless someone needs to file the will to begin a probate proceeding. Often there is no need to do a probate since all of the property that has a title or a name (cars, bank accounts, real estate, etc.) may be in some form of joint ownership that avoids probate. There is no criminal penalty for failing to file the will.

If the wife starts a probate proceeding you are legally required to be given notice.

If the wife does not start a probate you can start a probate, but the downside of this is that as you have described the circumstances it is not clear if there is any money in the estate you will need to pay an attorney up front to start a probate proceeding that may or may not result in any money.

If your father took out a policy "on you" then he would be the beneficiary if you died.

It is unclear what type of document you are talking about. If it is a pleading or motion, an amended document can be filed. Of course you will be responsible for any additional cost incurred, including the attorneys fees for drafting the amended document. If it is a court order or judgment that has been signed, then it can not be easily changed. It requires the consent of the other side and the judge.

A creditor can get to non-exempt property. In Texas, the tax refund is non-exempt. I am unsure how they would get it directly from the IRS but if you put it in your bank account, you may have a problem. I recommend you talk to a bankruptcy attorney. Sometimes, they can get these writs lifted.

Actually based on the information about the "no members" clause in your corporate paperwork, the board CAN change the number of directors, because you have no other "members." The families are NOT members.

Members means the officially recognized people who are part of the organization. Since child can not be held to a contract, I assume that the actual "member" is their parents. Your articles of incorporation should define what a "member" is and how many votes each has. Clearly it is not limited to the BOD only because a Board member may not actually be a member of the voting population [if your board includes a manager or coach] and the section would have no meaning if it was limited to Board members.

It sounds to me like you should consult with an attorney. In all likelihood, you were ordered to pay child support by the Family support division. You had thirty days to request an administrative hearing, but apparently failed to do so. Or, it is possible that an attorney filed a suit against you and obtained a Judgment against you after you did not respond in court within thirty days. Either way, there maybe something that an attorney can do to help you. I handle these cases, and you may contact me if you do not already have an attorney.

You can attach your written and notarized agreement to form FL-355, Stipulation and Order for Custody and/or Visitation of Children. For support, you would use form FL-350. Be aware that if you are receiving public assistance, the Department of Child Support Services will have to sign form FL-350 as well.

If you move away from Texas, you are as married as anyone else. You have a valid TX marriage. If you want to be divorced, you would have to go through a divorce in the State of Texas in order to end your legal relationship.

As you can see from CR 2A states:

No agreement or consent between parties or attorneys in respect to the proceedings in a cause, the purport of which is disputed, will be regarded by the court unless the same shall have been made and assented to in open court on the record, or entered in the minutes, or unless the evidence thereof shall be in writing and subscribed by the attorneys denying the same.

So the question is: was it (1) made and assented to in open court on the record or (2) entered in the [court] minutes, or (3) in writing AND signed by your attorney [or, probably, by you]. It looks to me like the signature is critical (and you could also argue that the must be an attorney signature and not just the party).

Nevertheless, GR 30 has specific requirements for electronic signatures and I doubt if your email meets that requirement. If you are within 10 days of the commissioner's ruling, file a motion for reconsideration. This is an issue you should win unless you made an electronic signature that complies with the rule.

I think it depends on whether there was a lien recorded on the title. If not, then I think your trade would make you a bona fide buyer. However, if there was a recorded lien and you just didn't check, I think the bank would still have a claim to the bike.

Get your attorney to sign a substitution of attorney form so that you will represent yourself, as Liberty Mutual may refuse to deal with you as long as he is attorney of record. Obtain a copy of the paperwork you signed and see if it is a complete settlement of all of your benefit rights or not. If it is not, you may be able to get out of it on the argument that your attorney mislead you into believing that it was a full compromise and release.

We own a building under corporation A. We own the parking lot used by this building under corporation B. Both are C-corporations and all taxes are up to date for both properties.

However, corporation B which owns the parking lot has been "involuntarily dissolved" since 98'. This is because we stopped filing tax returns or really maintaining that corporation since it was just a way to not have the property publicly in any one person's name. It should also be noted that corporation B has never had any income whatsoever and is owned 100% by one person.

What would be the best route to get things back on the straight and narrow?

Reinstate the corporation? Transfer the land to a new corporation owned by the same individual (not sure if this is possible since its dissolution, even if owned 100% by one person)?

I understand I'll need a lawyer for this in the end, but would like to do some preliminary research.

The corporation will need to be revived in order for it to deal with the real estate, including to sell, refinance, evict, etc. My guess is that the defunct corporation may not be able to sell until it is revived.

Independent contractors do not need I-9. They do need to fill out a W-9 each year. Be careful. Just because you are calling them independent contractors and paying on a commission basis does not mean that the IRS or state (for workers' compensation and unemployment purposes) cannot retroactively re-classify them as employees.

The employer will generally reply within 2 pay periods, or less (Because if they ignore it, it's $100 a day against them). The California Vacant Land Purchase Agreement has a 17 Day "Buyer Investigation" period that allows buyers to cancel the agreement for "any reason" at all during that period. The contract states that any initial deposit sent to Escrow shall be returned to the buyer if the contract is cancelled within the 17 days, regardless of the reason. We cancelled the contract 3 business days after the acceptance of the contract by both parties - well within the 17 day Buyer Investigation period. Per the terms of the contract, we were NOT actually required to send in the initial deposit to Escrow until 3 BUSINESS DAYS after the acceptance date - this is clearly stated on Page 1 of the contract. Because we CANCELLED the contract BEFORE the "contractual deadline" for sending in the initial deposit, we could not possibly have breached the contract for this reason. We cancelled the contract BEFORE we would have been in breach. We would only have breached the contract if we had NOT sent the initial deposit in by the 3 business day DEADLINE, and then cancelled the contract AFTER that deadline.

Our issue here isn't whether or not we breached the contract - we've had various real estate agents confirm that we cancelled the contract within the right time frame and did absolutely nothing to breach the terms of the contract. What we would like to know is, from a "legal" perspective, why would the Seller be refusing to sign the cancellation form and what could he possibly take us to court for?

RESPONSE TO BELOW QUESTION

I assume you mean that you cancelled before he signed the agreement to sell, but you state the opposite. The only three day period I am aware of in the standard CAR purchase Agreement is Paragraph #34, page 9, which states the offer is considered cancelled if the seller does not sign and deliver the acceptance within three days of it being made. The offer is good for three days, not that you have three day to withdraw. Once the seller accepts and returns the acceptance to you within three days, unless there is a provision to the contrary, you are stuck with the contract. With the offer, you are supposed to put up a deposit which is normally deemed forfeited if you fail to go with the purchase. That you failed to deposit that agreed to sum does not mean you are not liable for it. So if you are using the standard CAR contract, the seller has you over a barrel. He can demand you pay the deposit sum to him; he can offer to take something else that you will agree to. Since you have breached the contract, he has the option to declare that it is breached and sue you for damages for your purchase of the property, or he can declare the contract still in effect and collect the liquiated damages.

You need to see a real estate attorney to present the contract and all the facts for them to determine if you are stuck. Do not trust the title Company to know anything about the law, as they often do not.

ORIGINAL QUESTION

I have an unusual question for you about the cancellation of a vacant land purchase agreement. The contract was mutually signed and then cancelled 3 business days later. We formally cancelled the contract by submitting CAR Form CC (contract cancellation form) to the Escrow Holder and to the Seller (who by the way is also a licensed California real estate agent). We sent the cancellation form by email with a return receipt showing it was received by both parties. Although the Seller is an agent, he went into the transaction as a private party because he wanted to save himself having to pay fees on any commission. So this land purchase was essentially a transaction between 2 private parties. Because we cancelled the contract on the 3rd business day after the contract acceptance date, we had not sent in any deposit and therefore there are no funds in dispute. The problem is that the Seller REFUSES to sign the contract cancellation form UNLESS we give him a survey we paid for which cost us $1750 and an appraisal we paid for which cost us $600. He sent us an email stating that he will not sign the cancellation form until we send these documents to him - which sounds like a thinly veiled attempt to extort us, or at the very least threaten us. Mind you, this person is a licensed California real estate agent!

How does this impact us? According to the Escrow Holder, she will keep the Escrow Account for this contract open "indefinitely" until the Seller signs and delivers the cancellation form. She also said the contract itself is still open until he signs the form. So does this mean he has some hold over us? We understand that he cannot sell his property to anyone else while he is still in the contract with us, but he doesn't seem to care. He seems to care more about trying to punish us, and trying to get us to send him documents he does not have a right to, and did not pay for. Can he at some point come back and take legal action against us as long as this contract is still open?

Also, isn't this behavior unethical? As a licensed California real estate agent, regardless of whether he was acting as one in the transaction or not, doesn't he have a fiduciary duty to follow real estate law and do the right thing? He has absolutely NO GROUNDS to refuse to sign the cancellation form. Yet that's exactly what he's doing. And worse, he is attempting to extort us by saying he refuses to do what he is "supposed" to do unless we give him something of "value" in exchange.

Can we simply walk away from this transaction since there is no money on the line and we formally cancelled within 3 business days?

Thank you for the additional information, but it does not change my opinion.

VLPA paragraph #19, page 6, states: "TIME PERIODS...CANCELLATION RIGHTS: ...Any cancellation under this paragraph ... must be exercised in good faith..." Buyer's remorse is not an exercise of good faith; yo can not cancel without it being a breach unless there is a valid reason. Any reason is not sufficient. If it were, then there would be no binding contract until the 17 days had passed. An agreement which provides that one party can withdraw for any reason at all is not a binding contract. Even if you had the 17 days, paragraph #34, page 9, is in conflict with your reasoning and being a specific discussion of time limits as opposed to the more general discussion of paragraph #19 which precedes it, overrules the 17 day period.

Real estate agents telling you that you are not in breach of the contract demonstrate why people involved in real estate transactions should not rely upon the real estate industry. They and title insurance agents often do not know the law. Luckily for you, the seller apparently also does not fully know the law.

As I am sure you already know, paying someone to get pain pills is just as illegal as taking medication which has been prescribed for someone else. More importantly, both the person who is "ordering" the pills, as well as the person who is buying the pills for someone else is committing a crime. I do not think it would be a good idea for your friend to go to the police to file a complaint against the other person who ripped him off because your friend will be admitting to the police that he committed a crime. I am not saying that $200 is a small sum, but by telling the police he was "ipped off", he will be admitting to the police that he was buying drugs and he can be charged and prosecuted for dealing in drugs.

Since buying pain pills from some one is an illegal contract neither the police or the courts will do anything to enforce that contract. Also as has pointed out you will be arrest when you report the "crime" to the police.
