Can a person that contracted to sell a product to one person for a price, then turn around and sell the product to another party for more money? The contract was oral. Can the seller be sued for breach and why or why not?



Answer

As a general rule, the statute of frauds governs contracts for the sale of goods of $500 or more and thus requires that such contracts be in writing.
