Car a backs out of parking spot car b sees and continues to advance car b has small scratch on bumper car a ends up paying 1500 in damages to Car b isn't car b part at fault is this fair?
No, car b had the right of way. It was driver A's responsibilty to ensure his path was and remains clear while backing out of a parking space---haha "is this fair?" of course not, 'fair', but car B is just what you call an a$$hole. legally, car B is not at fault (how does car A's attorney prove car B saw you...just cant)
