Can a video game parody website copyright a video which they created, that uses sprites+characters from an established franchise?

I have a youtube channel where I often post some of these videos, and I'm wondering if I'm liable to copyright infringement. I do give full credit to the creator.



Answer

Although parodies are likely to be "fair use" or otherwise not copyright violations, the use of the original creator's software (sprites, etc.) to carry out the parody is much more likely to be deemed an unlawful infringement. As a first step, I suggest you contact the creator or its copyright administrator to ask whether they strongly object.
