If my childs father hasn't been present in her life, and after being put on child support he demands joint legal, physical custody, could he be granted that right?
Answer
He would have the burden to prove that it was in the child's best interests for that to happen. If he has not been in the child's life all along, it will be very difficult to prove that to the court's satisfaction.
Answer
He can demand all he wants but unless he files a parenting plan that you both agree on and Petition for Visitation , I can see where he would have any standing. Just cause he pays does not mean he gets to see this child without an order in place from the court.
Answer
Assuming he files a petition for paternity, he will likely be granted a parenting plan that allows him some form of timeshare ("visitation").
