I work for a large county in Ca. I have been an excellent employee for over 24 years. When i first got my position the name of the position was wrong for whatI was doing but since I was new I new I kept quiet. As the years went by my position grew in responsbilities and the name and most fthe duties on the flier were outdated and the name was again wrong. I went to PSD starting in my 10th year to get the position reclassifed but the county had no position so they would have to create a new one. Going back and forth for several years the technology changed again and still no new position. Several studies were completed and thousands of man hours of research on my end and they still won't change the position. I am now nearing retirement and would like to sue the county for 27 years of back pay for the incorrect position title and the loss of income. The correct position through my studies would be approimately 10 dollars more an hour. So 10 dollars times an hour difference-26 paychecks per year-24 years=$499,200. I really think I have a good case and I know serveal other positions that are in the same boat. This would kick the HR people to start doing their jobs and give employees the correct job title and salary.-Thank You
Answer
The statute of limitations on wage claims is 3 years and sometimes 4 if an attorney sues under an unfair business practices claim. You won't be able to claim unpaid wages going back any further than the statute allows.
