I also purchased a vehicle from a Buy Here Pay here dealer in NC, but it was back in April of this year, 2014. I had lots of troubles with the car shimmying and they did a few things but it didn't fix it. They said they didn't feel the shimmy but it is still there. A mechanic told me it must need a front motor mount and they won't even look at it to see if it's the problem. I've been back numerous times! But thats not the main issue now. For 2 months when I am driving, all the dash lights come on for about a second or 2 at any speed and then go off. It seemed to have no effect on the car, but now as of 2 weeks ago, the car stops when it happens and I have no control of the accelerator. I can be doing 20 mph or 70 mph. It just dies. Then as soon as I can maneuver to the side of the road it starts right back up and may not do it again for 2 or 3 days. This is dangerous. The dealer looked at it and said they cant find anything wrong and the car displays no codes. I drive this car for a living (A courier) and I cant afford for this to continue. What can I do?? I want to turn the car in. I don't care about my down payment $1400 and 4 months of $300 a month. I just want it gone. I have a signed arbitration agreement.
Answer
You need to have a lawyer review your purchase agreement and get specific advice before you proceed further. Unfortunately, since this was a used car, unless you were given a warranty on the car or an extended warranty, the dealer is probably not going to be responsible for any further necessary repairs.
Surrendering the car will damage your credit rating and the dealer is not required to take the car back. You may either have to trade the car in and purchase a new car or pay for the necessary repairs yourself.
