I have asked for the Support to be offset - I have one child, my ex has the other. He owes me $1200 a month, I owe him $600 - why won't the courts offset? I pay mine, the ex doesn't to the tune of a $28000 judgement against him. Yet the court is hesitant to offset - Why is this a problem? Seems to me it's basic common sense - I owe you 20, you owe me 10 are you going to pay the 10 and hope I pay you back the entire 20 OR are you going to ask me for the difference of $10???
Answer
Think about it this way: Would he be likely to claim a violation against you for not paying your half at this point?
I do not recommend violating a court order, but there are options. Speak with an attorney in your area.
