Sued, alleging that he discharged due to his prounion activities, not because of poor job performance, as claimed by Delta. During discovery, report written by Delta flight operations manager was produced that stated: "More than a few crew members claimed that Conrad professed to being a leftist-activist. His overactivity with the local pilots' union, coupled with inquiries regarding company files to our secretary', lead to the conclusion that potential trouble will be avoided by acceptance of his resignation." Conrad claims that report is evidence of the antiunion motivation for his discharge. Delta made a summary judgment motion to the trial court. Should its summary judgment motion be granted?
