Question

i cashed a check made out to me with my proper identification the person that gave the check

to me was employed by the account holder however the account holder informed police he did

not authorize the check and it was in fact a manufactured check that he had no knowledge

ofthe police are charging me with two class four felonies taking anothers identity and

impliment of a forgery device the plea the attourneys are trying to give me is changing the

two charges to one class class six solicitation of the check with as little as six months in

doc the problem is the charges of the two class fours i am not guilty but if they changed

the charge to solicitation then i would be guilty of taking the check but i didnot know

that it was not valid. the severity of the sentence and or plea is due to two felonies

from fifteen years ago that are non related the person that gave me the check has passed

away and cannot testify on my behalf i have chose to go to trial and i have been informed

that they will bring up these past felonies of fifteen years ago and i am looking at at

least five years in prison if i am found guilty. the problem with going to trial is because

their are two victims besides myself which is the account holder and the check cash place

that cashed it. i am also a victim i admit i cashed the check i thought it was good i do

not want to accept the plea because they would change the charge to i accepted the check

from my deceased friend and then i would be admitting guilt to a charge that i am not guilty

of because i had no knowledge of the desreponcy i am concerned because i have a public

defender i requested twice for them to file a motion to dismiss because i did not do what

they say. i feel i am a scapgoat because they cannot question or ccharge the individual

that is deceased. pleaase advise
