I know someone who has a piece of real estate and is asking $10 million. I also know someone who is looking to buy the exact same kind of real estate. They may pay more than $10 million. Maybe like $11 or more million. Is there a legal way that I can profit the difference of $1 or more million without actually buying it and reselling it? For example, assigning the contract or have an agreement with the seller that I can make anything over $10 million?

You would not be able to broker the deal without a license in NJ (or any state that I am aware of), but you can certainly enter into a contract with the seller and accomplish this. This is done all the time, but the seller has to be on board.

You should consult a lawyer to assist you especially given the extent of the purchase. Attorney Gartenberg says he has experience in this area, perhaps you should give him a call.
